HomeMy WebLinkAboutR-94-0342J-94-362 5/5/94 W RESOLUTION NO. 342 A RESOLUTION BY AN AFFIRMATIVE VOTE OF 4/5TH OF THE MEMBERS OF THE CITY COMMISSION WAIVING FORMAL COMPETITIVE NEGOTIATIONS FOR THE PROCUREMENT OF ARCHITECTURAL/ENGINEERING SERVICES TO BE PERFORMED FOR THE BISCAYNE BOULEVARD NEW WORLD DESIGN (BURLE MARX) PROJECT; RATIFYING, APPROVING AND CONFIRMING THE CITY MANAGER'S FINDING THAT AN EMERGENCY EXISTS JUSTIFYING SUCH WAIVER FOR SAID SERVICES; AUTHORIZING THE CITY MANAGER TO NEGOTIATE AND EXECUTE A PROFESSIONAL SERVICES AGREEMENT, IN A FORM ACCEPTABLE TO THE CITY ATTORNEY, WITH THE FIRM(S) OF CARR SMITH ASSOCIATES, INC., DAVID PLUMMER & ASSOCIATES, INC. AND/OR FREDERICK R. HARRIS INC. FOR PROFESSIONAL SERVICES RELATED TO THE BISCAYNE BOULEVARD NEW WORLD DESIGN (BURLE-MARX) PROJECT; AND ALLOCATING FUNDS THEREFOR FROM CAPITAL IMPROVEMENT PROJECT NO. 341172, AS PREVIOUSLY APPROPRIATED BY ORDINANCE NO. 11139. WHEREAS, to promote the economic revitalization and unification of downtown Miami along its major access road, the Internationally renown Landscape Architect, Roberto Burle-Marx was commissioned to create a distinctive new design for Biscayne Boulevard between the Miami River and N.E. 24 Street; and WHEREAS, representatives from the City of Miami have actively pursued sources of funding for this project and In Fiscal Year 1991 the United States Department of Transportation Appropriations Act (P.L. 101-519) provided $1.7 million In funding to be used on the State of Florida's Biscayne Boulevard Preliminary Engineering Demonstration Project In Miami, Florida; and CITY COMKISSIOIN' MEET%NG OF MAY r, 5 1994 Resolu� ll�a 4 �- WHEREAS, during Fiscal Year 1991, the Public Works Department had most of the necessary resources (Infrastructure records, engineers and architects) on hand to provide all engineering and design services necessary to produce construction plans, specifications and bidding documents to implement the approved Biscayne Boulevard master plan and on October 11, 1991 the City of Miami entered Into a "Memorandum of Agreement" with the Florida Department of Transportation to provide those services; and WHEREAS, since the time that the City of Miami entered Into the "Memorandum of Agreement" with the Florida Department of Transportation, many of the resources In the Public Works Department necessary to complete this project have changed, chiefly due to early retirement of experienced designers and "frozen" staff levels; and WHEREAS, an additional $2.4 million in federal funds have I been allocated to begin the construction of the Biscayne I Boulevard New World Design project; and WHEREAS, the City Manager has made a finding that the construction of the project for Biscayne Boulevard must be i authorized by the Florida Department of Transportation before September 30th, 1994 to avoid the loss of the currently allocated $2.4 million In federal funds that are due to expire on this date constitutes a valid public emergency; and 2 - i � .4- 342 ME WHEREAS, the nature of said emergency requires the Immediate procurement of Architectural/Engineering services to protect the health, safety and welfare of the citizens of the City; and WHEREAS, the normally required procedures and scheduling requirements for formal competitive negotiations for the procurement of Architectural/Engineering services will cause the loss of the aforesaid federal construction funds; and WHEREAS, Section 18-52.6 of the City Code makes provisions for the emergency procurement of required goods and services for I public work projects and Improvements; and WHEREAS, Metropolitan Dade County has completed a Request for Qualifications (RFQ) process, in accordance with Florida Statutes, for professional engineering services; and WHEREAS, Carr Smith Associates Inc., David Plummer & Associates, Inc. and/or Frederick R. Harris, Inc. were selected as qualified firms to perform professional architectural/engineering services by the Dade County RFQ; and WHEREAS, the Department of Public Works by means of the County's R.F.Q. process, has determined that the aforesaid firms are the most qualified to provide professional architectural/engineering services for the Biscayne Boulevard New World Design Project; and WHEREAS, the Fiscal Year 1993-1994 Capital Improvement Ordinance No. 11139, was adopted on April 14, 1994, and monies are available for the proposed amount of the professional services agreement(s) under Project No. 341172 of said Ordinance; - 3 - 4- 342 W NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings set forth In the Preamble to this Resolution are hereby adopted by reference thereto and Incorporated herein as if fully set forth In this Section. Section 2. The City Manager's finding that a valid public emergency exists justifying such waiver for architectural/engineering services Is hereby ratified, approved and confirmed. Section 3. By an affirmative vote of 4/5ths of the Members of the City Commission, formal competitive negotiation procedures for the procurement of architectural/engineering services for the Biscayne Boulevard New World Design project are hereby waived. Section 4. The City Manager Is hereby authorized /, to negotiate and execute a professional services agreement(s), In a form acceptable to the City Attorney, with the firms of Carr Smith Associates Inc., David Plummer & Associates, Inc. and/or Frederick R. Harris, Inc. for professional architectural engineering services for the Biscayne Boulevard New World Design Project, with funds therefor hereby allocated from the Capital Improvement Project No. 341172, as previously appropriated by Ordinance No. 11139. The herein authorization Is further subject to compliance with all requirements that may be Imposed by the City Attorney, Including but not limited to those prescribed by applicable City Code and Charter provisions. - 4 - 14- 342 r� Section 5. Harris, Inc. for professional engineering services related to the Biscayne Boulevard New World Design (Burle-Marx) project. BACKGROUND: To promote the economic revitalization and unification of downtown Miami along its major access road, the internationally renown Landscape Architect, Roberto Burle-Marx was commissioned to create a distinctive new design for Biscayne Boulevard. The master plan and conceptual designs prepared by Burle-Marx were approved by the City Commission in July 1988. The project is known as the Biscayne Boulevarad New World Design and extends from the Miami River to N.E. 24th Street. Representatives from the City of Miami have actively pursued sources of funding for this project and in Fiscal Year 1991 the United States Department of Transportation Appropriations Act (P.L. 101-519) provided $1.7 million in funding to be used on the State of Florida's Biscayne Boulevard Preliminary Engineering Demonstration Project in Miami, Florida. The Florida Department of Transportation is currently authorized to distribute these preliminary design and engineering funds. During Fiscal Year 1991, the Public Works Department had most of the necessary resources (infrastructure records, engineers and architects) on hand to provide all engineering and design services necessary to produce construction plans, specifications and bidding documents to implement the approved Biscayne Boulevard master plan and on October 11, 1991 the City of Miami entered into a "Memorandum of Agreement" with the Florida Department of Transportation to provide those services. Page 1 of 2 4W 342 S?r- Honorable Mayor and Members of the City Commission j Since the time that the City of Miami entered into the "Memorandum of Agreement" with the Florida Department of Transportation, many of the resources in the Public Works Department necessary to complete this project have changed, chiefly due to early retirement of experienced designers and "frozen" staff levels. And. although the City of Miami has not contracted with the Florida Department of Transportatioan for this project, that .Department now requires adherence to their "Sequence of Plans Preparation", a requirement not anticipated or included in the "Memorandum of Agreement" at the date of execution. In order to expedite the timely completion of this important project and demonstrate the City's commitment in the ongoing search for adequate construction funding, the utilization of private engineering firms is necessary. Since time is of the essence, the lengthy Request for Qualifications (RFQ) process to select a professional engineering consultant is not possible. However, Metropolitan Dade County has recently completed the RFQ process following the appropriate State Statutes to identify qualified firms (identified above) and execute Professional Services Agreements for professional engineering services. Therefore, the attached Resolution authorizes the City Manager to negotiate and execute •a professional services agreement for engineering services related to the Biscayne Boulevard New World Design with one or more of the above identified qualified firms based on the the County's selection process. All costs for these services shall be paid from the $1.7 million Federal Grant. Page 2 of 2 a 4_
