RESOLUTION NO. 4 4^ 331
A RESOLUTION, AUTHORIZING AN INCREASE IN THE
AMOUNT OF $116,000, IN THE CONTRACT BETWEEN
THE CITY OF MIAMI, FLORIDA AND ASSOCIATES
CONSTRUCTION CORPORATION, A FLORIDA
CORPORATION, DATED DECEMBER 12, 1992 FROM
$2,258,000 TO $2,374,000 FOR THE "SAINT HUGH
OAKS VILLAGE HOUSING PROJECT", B-6206 CAPITAL
IMPROVEMENT PROJECT NO. 321040, IN CONNECTION
WITH THE DEVELOPMENT OF TWENTY-THREE (23) NEW
SINGLE FAMILY HOMES IN THE COCONUT GROVE
NEIGHBORHOOD; SAID FUNDS TO BE PROVIDED FROM
CAPITAL IMPROVEMENT PROJECT ENTITLED
"BUILDING SALES", PROJECT NO. 321034
(PROCEEDS FROM THE SALE OF AFFORDABLE HOUSING
UNITS); FURTHER RATIFYING THE CITY MANAGER'S
WRITTEN FINDING, BY AN AFFIRMATIVE VOTE OF
4/5THS OF THE MEMBERS OF THE CITY COMMISSION,
THAT THE HEREIN INCREASES RESULTED FROM
EMERGENCY CIRCUMSTANCES.
WHEREAS, there exists in the City of Miami a severe
shortage of housing within the affordability range of families
and individuals of low and moderate income; and
WHEREAS, in an effort to expand the availability and
affordability of housing for moderate income families and
individuals in the City of Miami, in September, 1988, the City
Commission authorized the acquisition of a three (3) acre parcel
of land located in the Coconut Grove neighborhood known as the
St. Hugh Oaks Academy property; and
WHEREAS, the City of Miami, serving as developer, is
presently developing a twenty-three (23) unit single family
residential sales housing development on the sail l;--e1-----

WHEREAS► the City Commission adopted Ordinance No. 10938,
on Deoember 5, 1991, appropriating funds for Capital Improvement
Projeots; and
WHEREAS, the estimated bid post of oonstruoting the twenty-
three (23) single family homes planned on the St. Hugh Oaks
paroel is $2,258,000; and
WHEREAS, funding has been made available from Speoial
Obligation Bonds - Series 1988A in the amount of $1,554,000 and
from prooeeds from the sale of affordable housing units in the
amount of $704,000;
WHEREAS, funds are available from •Capital Improvement
Projeot entitled "Building Sales"; and
WHEREAS, there exists a oontraot dated Deoember 12, 1992
betwen the City of Miami, Florida and Assooiates Construction
Corporation for the oonstruotion of the 23 homes of the St. Hugh
Oaks Village B-6208 Capital Improvement Projeot No. 321040; and
WHEREAS, the City Manager has made a written finding that a
valid emergenoy exists in order to oover the inorease in the oost
of raw oonstruotion materials, inoreases in oost resulting from
updated South Florida Building Codes established due to Hurricane
Andrew, as well as inoreases in oost due to Dade County
Department of Water and Sewer (WASA) requirements; and
WHEREAS, the Direotor of the Department of Development and
Housing Conservation and the City Manager reoommend the inorease
in oontraot to cover the additional oost;

NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF TEE
CITY OF MIAMI FLORIDA:
Section 1. After a properly advertised Public Hearing, the
findings of the City Manager set forth in the Preamble to this
Resolution are hereby ratified by an affirmative vote of 4/5ths
of the City Commission and are hereby incorporated by reference
thereto and adopted as if fully set forth in this Section.
Section 2. The Contract between the City of Miami, Florida
and Associates Construction Corporation dated December 12, 1992
B-6206 Capital Improvement Project No. 321040, for the
construction of the 23 homes of the St. Hugh Oaks Village
Condominium in the Coconut Grove neighborhood is hereby increased
in an amount not to exceed $118,000 from $2,258,000 to
$2,374,000, with funds for the increase to be provided from
monies available from Capital Improvement Project entitled
"Building Sales".
Section 3. This Resolution shall become effective
immediately upon its adoption.

It is respectfully recommended that the City Commission adopt the
attached Resolution approving an increase in the contract between
the City of Miami and Associates Construction, Corporation dated
December 12, 1992, in the amount of $116,000 in connection with
the development of twenty-three (23) new single family homes on
the city -owned St. Hugh Oaks parcel in the Coconut Grove
neighborhood.
The Department of Development and Housing Conservation recommends
ratification of the attached resolution approving an increase in
the contract between the City of Miami and Associates
Construction, Corporation dated December 12, 1992, in the amount
of $116,000, in connection with the development of twenty-three
(23) new single family homes on the 'city -owned St. Hugh Oaks
parcel in the Coconut Grove neighborhood.
In October of 1992, through Resolution No. 92-660, the City
Commission accepted the bid of Associates Construction,
Corporation in the amount of $2,258,000 and authorized the City
Manager to execute a contract in connection with the development
of twenty-three (23) new single family homes on the city -owned
St. Hugh Oaks parcel.
After the execution of the contract between the City and
Associates Construction, Corporation, a number of unexpected cost
increases have been experienced relative to the new South Florida
Building Code requirements imposed as a result of Hurricane
Andrew, increases in construction materials as well as new
requirements imposed by Dade County's Department of Water and
Sewer. The project cost overruns were further exacerbated by the
more than seven (7) month delay in the commencement of

construction on the St. Hugh Oaks Village Condominium Project due
to the new construction water/sewer moratorium imposed by
Metropolitan Dade County in early February of 1993.
In,an effort to ascertain whether the cost overruns submitted by
Associates Construction, Corporation were in fact realistic, the
Department of Development and Housing Conservation retained the
services of Mr. Henry Kaufman, a construction expert associated
with the architectural firm of Andres Duany and Elizabeth Plater-
Zyberk, Architects, and it has been determined that the cost
increases are in line with the cost increases which have been
experienced by the construction industry in South Florida over
the past year.
Funds in the amount of $116,000 are available from Capital
Improvement Program Project entitled "Building Sales", Project
No. 321034, (proceeds from the sale of affordable housing units)
to provide the aforementioned cost increase in connection with
the development of the city -sponsored St. Hugh Oaks Village
Condominium Project.
In an effort to complete the construction of the twenty-three
(23) new single family homes being developed on the St. Hugh Oaks
parcel, City Commission ratification of the attached resolution
is recommended.

NOTICE TO THE PUBLIC
PLEASE ALL TAKE NOTICE THAT a public hearing will be held by the
City Commission of the City of Miami, Florida, on May 5, 1994, at
10:00 a.m., in the City Commission Chambers at City Hall, 3500
Pan American Drive, Miami, Florida on the proposed increase in
the contract between the City of Miami, Florida and Associates
Contruction Corporation in the amount of $116,000 for the Saint
Hugh Oaks Village Housing Project.
All interested persons are invited to appear and may be heard
concerning this item. Should any person desire to appeal any
decision of the City Commission with respect to any matter
considered at this hearing, that person shall ensure that a
verbatim record of the proceedings is made, including all
testimony and evidence upon which any appeal may be based.
