HomeMy WebLinkAboutR-94-0267J-94-236 3/15/94 RESOLUTION NO. 9 4` 267 A RESOLUTION AMENDING RESOLUTION NO. 93-729, ADOPTED NOVEMBER 23, 1993, WHICH APPROVED A GRANT OF AN EASEMENT, CONSISTING OF A 20 FOOT STRIP OF LAND ON BICENTENNIAL PARK, FOR THE PURPOSE OF CONSTRUCTING, INSTALLING AND MAINTAINING A 36-INCH WATER MAIN, THEREBY CHANGING THE NAME OF THE GRANTEE CONCERNING SAID GRANT OF EASEMENT, FROM "METROPOLITAN DADE COUNTY, MIAMI DADE WATER AND SEWER AUTHORITY DEPARTMENT" TO "METROPOLITAN DADE COUNTY"; FURTHER AUTHORIZING THE CITY MANAGER TO EXECUTE SAID GRANT OF EASEMENT, IN A FORM ACCEPTABLE TO THE CITY ATTORNEY, ON BEHALF OF THE CITY OF MIAMI TO IMPLEMENT SAID NAME CHANGE AND GRANT OF EASEMENT. WHEREAS, on November 23, 1993, the City Commission adopted Resolution No. 93-729 which approved a Grant of Easement to Metropolitan Dade County, Miami Dade Water and Sewer Authority Department, for a strip of land 20 feet in width located on Bicentennial Park; and WHEREAS, the Code of Metropolitan Dade County, Florida, makes no provision for a County department to own property in its own name; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: CITY COMMISSION ]MEETING OF APR 1 4 1994 Resolution No. '4- 26'7 Section 1. The recitals and findings contained in the Preamble to this Resolution are hereby adopted by reference thereto and incorporated herein as if fully set forth in this Section. Section 2. Resolution No. 93-729, adopted November 23, 1993, is hereby amended in the following particulars:l/ Section 2. The grant of an easement to Metropolitan Dade County, Xtaint Dade 'Vaber and Sewer Aabhortty Department —,consisting of a 20 ft. strip of land on Bicentennial Park, more particularly described in Exhibit A attached hereto, for the construction, installation and maintenance of a new 36-inch water main to service Watson Island and Miami Beach is hereby approved. Section 3. The City Manager is hereby authorized / to execute a Grant of Easement, in a form acceptable to the City Attorney, on behalf of the City of Miami to implement said name change and Grant of Easement. Section 4. This Resolution shall become effective immediately upon its adoption. Words and/or figures stricken through shall be deleted. The remaining provisions are now in effect and remain unchanged. Asterisks indicate omitted and unchanged material. BACKGROUND: On November 23, 1993, the City Commission approved a Grant of Easement to Dade County, Miami Dade Water and Sewer Authority Department for a strip of land 20 feet in width located on Bicentennial Park. The County Code prohibits WASA from directly owning land and instead Dade County holds title on all land used by WASA. It is appropriate at this time to amend Resolution 93-729 to change the name of the Grantee from Metropolitan Dade County, Miami Dade Water and Sewer Authority Department, to Metropolitan Dade County. This easement will be used for the installation of a new 36-inch water main which will replace the existing 20-inch water main which serves Watson Island and Miami Beach. As the existing 20-inch water main is located on the existing MacArthur Causeway bridge, it is necessary to have the new 36-inch water main installed and operational prior to demolition of the old bridge. In exchange for the privilege of this Grant of Easement, WASA will construct, install, operate and maintain two 12-inch ductile iron water main connections and construct and install for the City's future use one 12-inch ductile iron sanitary sewer main, crossing MacArthur Causeway. These improvements have an estimated value of $45,000.
