HomeMy WebLinkAboutR-94-0256t J-94-497 4/14/94 RESOLUTION N0. 4 - 256 A RESOLUTION FORGIVING THE INDEBTEDNESS FOR PAYMENTS OWED TO THE CITY OF MIAMI BY BUS BENCH COMPANY IN THE AMOUNT OF $21,111.07 FOR THE PERIOD COVERING SEPTEMBER 1, 1992 THROUGH NOVEMBER 30, 1992. WHEREAS, pursuant to that certain agreement between the City of Miami ("City") and Bus Bench Company ("Company") dated June 4, 1990, Company is required to make payments to City based upon Company's monthly revenue; and WHEREAS, on or about October 29, 1993 the City's Department of Internal Audit and Review concluded that Company owed City $21,111.07 for the period covering September 1, 1992 through November 30, 1992; and WHEREAS, Company advised City that it had suffered more than $66,000.00 worth of destruction to benches during Hurricane Andrew necessitating substandard repairs and or replacements which directly affected the revenue stream and the gross revenue of Company; and WHEREAS, in light of the loss revenue, Company has requested that the City forgive the indebtedness owed in the amount of $21,111.07, NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: CITY Comussjojr MEETING OF APR 14 1994 Resolution No. �4- 256 0 Section 1. The recitals and findings contained in the Preamble to this Resolution are hereby adopted by reference thereto and incorporated herein as if fully set forth in this Section. Section 2. The indebtedness for payments owed to the City of Miami by Bus Bench Company in the amount of $21,111.07, for the period covering September 1, 1992 through November 30, 1992, is hereby forgiven. RE: City of Miami Bus Benches Contract Dear Wally: I wrote you on February 3, 1994, concerning the contract between the City of Miami and Bus Bench Company. I asked that you place the matter on the agenda for the City Commission, so that any apparent dispute between the City and Bus Bench Company could be resolved expeditiously. I have not received any response to our letter. Would you please let me know whether you will initiate a process to get this matter on the agenda of the City Commission.
