HomeMy WebLinkAboutR-94-0217J-94-241(a) 3/24/94 RESOLUTION NO. yL 217 A RESOLUTION UPHOLDING AN APPEAL AND REVERSING THE DECISION OF THE HISTORIC AND ENVIRONMENTAL PRESERVATION BOARD, WHICH DENIED AN APPLICATION FOR A CERTIFICATE OF APPROVAL FOR THE CONSTRUCTION OF A CHAIN LINK FENCE, AFTER -THE -FACT, AT 3370 ROYAL ROAD, MIAMI, FLORIDA, LOCATED ALONG THE MAIN HIGHWAY SCENIC TRANSPORTATION CORRIDOR. WHEREAS, the Historic and Environmental Preservation Board (HEPB) at its meeting of February 15, 1994, following an advertised public hearing adopted Resolution No. HEPB 94-1 by a seven to zero (7-0) vote, DENYING an application for a Certificate of Approval for the construction of a chain link fence, after -the -fact, at 3370 Royal Road, Miami, Florida, located along the Main Highway Scenic Transportation Corridor; i i and WHEREAS, pursuant to Section 17-15(b) of the Code of the ! City of Miami, Florida, an appeal to the City Commission from i said denial of an application for a Certificate of Approval has 1 been taken by Charles D. McCormick, et al., owner of the property located at 3370 Royal Road, Miami, Florida, on the grounds that the Historic and Environmental Preservation Board failed to follow the law, failed to follow the evidence, and ruled contrary CITY COM ES.S101F MEETING OF MAR ? 4 1994 Resolution No. 94- 217 to the fact that the law permits the construction of a fence as requested by the applicant; and WHEREAS, the City Commission after careful consideration of this matter and the facts presented finds no merit in appellant's objections to the actions of the Historic and Environmental Preservation Board, but finds that unique circumstances exist in this case that would permit the construction of a chain link fence due to the fact that a wire fence was previously located I here prior to Hurricane Andrew, and therefore, upholds the appeal subject to the appellant providing landscaping to ensure that foliage will cover the fence; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals contained in the Preamble to this Resolution are hereby adopted by reference thereto and incorporated here as if fully set forth in this Section. Section 2. Box 351027 Miami, FL 33135-1027 PROJECT ADDRESS: 3370 Royal Road PROJECT DESCRIPTION: Application for a Certificate of Approval for construction of a chain link fence, after -the -fact, along the Main Highway Scenic Transportation Corridor. ANALYSIS: The applicant is proposing to retain a chain link fence along Main Highway that was installed without either a Certificate of Approval or building permit. At issue is the chain link installed on top of the coral rock wall, as well as the 6' L-shaped section of chain link at the corner of the property at Royal Road. Although a fence had previously been located here prior to the hurricane, the new fence is completely different in character. The previous fence was a "historic" wire fence constructed of a very fine gauge wire with large square or rectangular openings. A chain link fence, by contrast, is very heavy in character and is not consistent with the character of the Main Highway Scenic Transportation Corridor. No chain link fences have ever been approved by the Board along this corridor. Although landscaping may tend to obscure the fence over time, there is no way to guarantee that said landscaping would not be removed by a future owner. (The section of fence along Royal Road is within an Environmental Preservation District, but outside the Scenic Transportation Corridor. As no trees were affected by its construction, this section of fence was approved after -the -fact.) STAFF RECOMMENDATION: Denial of Appeal The Planning, Building and Zoning Department recommends that the appeal of the HEP Board's denial of an application for a Certificate of Approval be denied because the chain link fence is completely out of character with the Main Highway Scenic Transportation Corridor. The Department further recommends that the decision of the HEP Board as contained in Resolution No. HEPB-94-1 be affirmed. The applicant is encouraged to submit a new application for a wrought iron or other appropriate fence. HEPB: Denial of Application, 7 - 0 Vote.
