WHEREAS, an increase 3n said contract in an amount not to exceed. $17,800.00 is required to cover the cost of necessary extra work involving the installation of two vertical oval backstops for the two new ballfields at Grapel..and Heights Park; and WHEREAS, the Director of Public Works, the Director of Parks and Recreation and the City Manager recommend the increase in said contract to cover the additional costs; and WHEREAS, the City Manager has made a written finding that a valid emergency existed for the work to continue to protect the health, safety and welfaxe of the citizens of the City; and. After a properly advertised public hearing, the findings of the City Manager set forth in the Preamble to this Resolution are hereby ratified by an affirmative vote of four -fifths of the Members of the City Commission, and are hereby adopted by reference thereto and incorporated herein as if fully set forth in this Section. Section 2. An increase in the contract, is hereby authorized, in an amount not to exceed $17,800.00, between the City Of Miami, Florida and Miri Construction, Ino., dated April 15, 1993, from $71,747.00 to $89,547.00, for "Grapeland Heights Park Ballfield Construction Project, B-2958-C", with funds therefor for said increase hereby allocated from Capital Improvement Project No. 331310, as previously appropriated by Ordizganoe No. 10938, as amended. BACKGROUND The Department of Public Works, in an effort to serve all residents of the ,City of Miami, has determined that it is now appropriate and in order for the City Commission to ratify the City Manager's decision to increase the contract dated April 15, 1993 between the City and Miri Construction, Inc. for construction of Grapeland Heights Park Ballfield Construction Project, B-2958C, in the amount of $17,800.00 for necessary extra work, and to ratify the City Manager's emergency finding that allowed the extra work to continue. The City Commission awarded a contract to Miri Construction, Inc. for the construction of Grapeland Heights Park Ballfield Construction Project, B-2958C, C.I.P. No. 331310, in the amount of $71,747.00 on April 15, 1993. Generally, the project consists of demolition, site preparation, and construction of two (2) ballfields at Grapeland Heights Park including installation of a twelve (12) foot high chainlink lateral fence, concrete sidewalk/slabs, dugouts with fencing and roof, players' benches and solid sod. The increase in contract is necessary for the installation of two (2) vertical oval backstops. Funds were not available for the two backstops' inclusion in the original contract. The vertical oval backstops have been determined by the City Manager and the Parks and Recreation Department to be necessary for the completion of the project in order to allow for the optimum protection of pedestrian and vehicular traffic in the nearby right of way and at other facilities in the park. 94- 207 Cesar H. Lee, Director Public Works Department ENCLOSURES: December 7, 1993 FILE : Grapeland Heights Park Ballfield Construction Project (B-2958-C) Increase in Contract It is this department's recommendation that an increase in contract be awarded to Miri Construction, Inc. for the Grapeland Heights Park - Ballfield Construction Project, B-2958-C, in the amount of $4,800 to pay for the change from additive alternate 2, which are two (2) "Heavy -Duty Backstops" to additive alternate 1, which are two (2) "Vertical Oval Backstops." This recommendation was reached after careful consideration by Parks and Recreation staff. The "Vertical Oval Backstops" will allow for the optimum of protection against foul balls leaving the playing fiell,-j and possibly disrupting the flow of pedestrian and vehicular traffic in and about the park area. This increase is needed on an emergency basis so that the contractor may immediately order the preferred item of equipment, a long -lead item, to ensure delivery at the appropriate point in the construction contract. Funds for the increase are available from monies already appropriated to the Capital Improvement Project No. 331310, Grapeland Heights Park Improvements. This •,is to request authorization to proceed with an increase in contract to Miri Construction, Inc. for the Grapeland Heights Park - BalIfield Construction Project, B-2958-C, in the amount of $13,000.00 to pay for Additive Alternate 2 which are two (2) Heavy -Duty Backstops. At the time of the original contract award, sufficient funds were not available for backstops when the City Commission approved the contract. Additional funds have not been allocated to this work and your approval is needed to increase the contract. Miri Construction, Inc. was the low bidder awarded the contract on the April 15, 1993 Commission meeting. The award amount was $71,747.00 for the base bid items not including the selection of backstops defined in Additive Alternates I and 2 of the Proposal. The increase in contract reflects the most economical selection of the two types of backstops specified. Please indicate your approval for an increase in contract to Miri Construction, Inc, in the amount of $13,000.00. Funds for the increase are available from monies already appropriated to the project in the CIP Account 331310.
