A RESOLUTION AUTHORIZING AN INCREASE IN THE
CONTRACT IN AN AMOUNT NOT TO EXCEED $9,570.00
IN THE CONTRACT BETWEEN THE CITY OF MIAMI,
FLORIDA AND RESOL, INC., DATED JULY 8, 1993,
FROM $164,430.00 TO $174,000.00, FOR
"NORTHWEST 15 AVENUE PAVING, B-4548";
ALLOCATING FUNDS THEREFOR FROM CAPITAL
IMPROVEMENT PROJECT NO. 341175, AS PREVIOUSLY
APPROPRIATED BY ORDINANCE NO. 10938, AS
AMENDED; FURTHER RATIFYING THE CITY MANAGER'S
WRITTEN FINDING THAT THE HEREIN INCREASE
RESULTED FROM EMERGENCY CIRCUMSTANCES BY AN
AFFIRMATIVE VOTE OF FOUR -FIFTHS OF THE
MEMBERS OF THE CITY COMMISSION.
WHEREAS, there exists a contract dated July 8, 1993 between
the City of Miami, Florida and Resol, Inc. for construction of
"Northwest 15 Avenue Paving Project, B-4548", Capital Improvement
Project No. 341175; and
WHEREAS, an increase in said contract in an amount not to
exceed $9,570.00, is required to cover the cost of necessary
extra landscape work due to the relocation of the median curb,
allowing for on -street parking; and
WHEREAS, the Director of Public Works and the City Manager,
recommend the increase in said contract to cover the additional
costs; and

WHEREAS, the City Manager has made a written finding that a
valid emergency existed for the work to continue, to protect the
health, safety and welfare of the citizens of the City; and
WHEREAS, funds to cover the increase are available from
monies already appropriated to said project;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. After a properly advertised public hearing,
the findings of the City Manager set forth in the Preamble to
this Resolution, are hereby ratified by an affirmative vote of
four -fifths of the Members of the City Commission, and are
hereby adopted by reference thereto and incorporated herein as if
fully set forth in this Section.
Section 2. The contract between the City of Miami,
Florida, and Resol, Inc., dated July 8, 1993 for "Northwest 15
Avenue Paving Project, B-454811, is hereby increased in an amount
not to exceed $9,570.00, from $164,430.00 to $174,000.00, with
funds therefor for said increase hereby allocated from Capital
Improvement Project No. 341175, as previously appropriated by

Section 3. This Resolution shall become effective
immediately upon its adoption.

RECOMMENDATION:
It is respectfully recommended that the City Commission adopt the
attached Resolution authorizing an increase in the contract
between Resol, Inc. and the City of Miami for NW 15 Avenue Paving
Project in the amount of $9,570.00; and further ratifying the
City Managers written finding that the increase resulted from
emergency circumstances.
BACKGROUND
The Department of Public Works, in an effort to serve all
residents of the City of Miami, has determined that it is now
appropriate and in order for the City Commission to ratify the
City Manager's decision to increase the -contract dated July 8,
1993 between the City and Resol, Inc. for construction of NW 15
Avenue Paving Project in the amount of $9,570.00 for necessary
extra work, and to ratify the City Manager's emergency finding
that allowed the extra work to continue.
The City Commission awarded a contract to Resol, Inc. for the
construction NW 15 Avenue Paving Project No. 341175, in the
amount of $164,430.00 on July 8, 1993. Generally, the project
consisted of clearing and grading, construction of asphaltic
pavement, concrete sidewalk and curb and gutter, median curb and
landscaping in the public right of•way of NW 15 Avenue between NW
46 Street and NW 50 Street. After the contract was awarded, the
Public' Works Department responded to a request by the
neighborhood property owners to provide for on street parking.
This request resulted in an increase in landscape costs for
twenty two new trees that replaced existing, trees that had to be
removed. Funds for the increase in contract are available from
monies already appropriated for the project in the City's Capital
Improvement Appropriation Ordinance, Project Number 341175.

ENCLOSURES
Based on information supplied to me by the Director of the
Department of Public Works, I have found that an EMERGENCY
existed justifying additional work on the N.W. 15 Avenue Paving
Project beyond the original scope which resulted in an increase
in the contract.
The reasons for the emergency need and subsequent authorization
to perform additional work and increase in contract are as
follows:
The City Commission awarded a contract to Resol, Inc. for the
construction N.W. 15 Avenue Paving Project, B--4548, Capital
Improvement Project No. 341175, on July 8, 1993 in the amount of
$164,430.00.
The project consists of the construction of asphaltic pavement,
concrete curbs and gutters, concrete sidewalks, and landscaping
for approximately 0.25 miles of N.W. 15 Avenue between N.W. 46
Street and N.W. 50 Street.
The existing median parkway was reduced in width as shown on the
revised design plans for the project. During the construction
demolition phase the reduced median required that 14 existing
trees be removed due to their interference with the proposed
median curbing.
Additionally, there were 22 new trees (15 ft. high, by 10 ft.
spread) that' were needed to be planted to replace the trees that
were removed. The cost of the removal and replacement of the
trees resulted in a net extra cost of $9,5.70.00 above the
original contract amount.
Funds for the increase in contract due to said tree removal and
replacement, are available from monies already appropriated in
the City's Capital Tmprovement Appropriation Ordinance 10938,
Project No. 341175.
