HomeMy WebLinkAboutR-94-0200J-94-227 3/16/94 RESOLUTION NO. 9 4- 200 A RESOLUTION, BY A 4/5THS AFFIRMATIVE VOTE OF THE MEMBERS OF THE CITY COMMISSION, RATIFYING THE CITY MANAGER'S FINDING THAT AN EMERGENCY NEED EXISTED, WAIVING THE REQUIREMENTS FOR COMPETITIVE SEALED BIDS AND APPROVING THE AWARD OF THE INFORMAL BID TO FURNISH AND INSTALL PLAYGROUND EQUIPMENT AT HADLEY PARK TO LEADEX CORPORATION, THE LOWEST RESPONSIVE AND RESPONSIBLE BIDDER, IN THE AMOUNT OF $58,740; SAID ACTIONS OF THE CITY MANAGER WERE PURSUANT TO CITY COMMISSION MOTION NO. 93-528, ADOPTED SEPTEMBER 7, 1993; ALLOCATING FUNDS THEREFOR FROM THE CAPITAL IMPROVEMENT PROGRAM, PROJECT NO. 331311, ENTITLED "HADLEY PARK IMPROVEMENTS", ACCOUNT CODE NO. i 589301-830. WHEREAS, the City Commission adopted Motion No. 93-528 on September 7, 1993, directing the City Manager to waive formal competitive sealed bid procedures and to receive and award an informal bid for the furnishing and installation of a modular play structure (playground equipment) in Hadley Park; and WHEREAS, pursuant to said Motion, two (2) bids were received October 19, 1993 and award was made by the City Manager to Leadex Corporation, the lowest responsive and responsible bidder in the amount of $58,740; and CITY COMMISSION MEETING OF MAR 2 4 1994 R"Wution No. 94- 200 1 WHEREAS, in accordance with the City Manager's written finding of an emergency, this action was required to safeguard the health, safety and convenience of the City, and specifically to provide an immediate replacement for badly deteriorated recreational facilities serving residents of this area; and WHEREAS, funds for said purchase were available and provided from the Capital Improvement Program, Project No. 331311, entitled "Hadley Park Improvements", Account Code No. 589301-830; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are hereby adopted by reference thereto and incorporated herein as if fully set forth in this Section. Section 2. By a 415ths affirmative vote of the members of the City Commission, the City Manager's written finding that an emergency need existed for the purchase and installation of playground equipment at Hadley Park, in the proposed amount of $58,740, from Leadex Corporation, the lowest responsive and responsible bidder, is hereby ratified, approved and confirmed, with funds therefor hereby allocated from the Capital Improvement Program, Project No. 331311, entitled "Hadley Park Improvements", Account Code No. 589301-830. Section 3. The requirements for competitive sealed bids is hereby waived pursuant to Miami City Commission Motion No. 93-528, adopted September 7, 1993, for acquisition of this equipment. -2- 4- 200 Seotion 4. Resolution, Emergency ENCLOSURES Finding RECOMMENDATION It is respectfully recommended that the City Commission adopt the attached Resolution, as directed by Motion No. 93-528, ratifying, approving and confirming the City Manager's .finding of an emergency and his actions in waiving competitive sealed bid procedures and in awarding the informal bid to furnish and install playground equipment at Hadley Park to Leadex Corporation in the amount of $58,740. Funds for this purchase were allocated from the Capital Improvement Program, Project No. 331311 "Hadley Park Improvements". BACIZGROUND The Parks and Recreation Department has prepared the attached legislation. On September 7, 1993, the City Commission adopted Motion No. 93- 528 directing the City Manager to waive formal competitive sealed bid procedures and to receive and award an informal bid for the furnishing and installation of a modular play structure (playground equipment) in Hadley Park. In accordance with the City Manager's subsequent finding of an emergency, this action was required to safeguard the health, safety and conveniEnce of the City, and specifically to provide an immediate replacement for badly deteriorated recreational facilities serving residents of the Model Cities area. On October 19, 1993, two (2) written bids were received and award was made by the City Manager to Leadex Corporation, the lowest responsive and responsible bidder in the amount of $58,740. This company is a Hispanic -owned firm located at 42 NW 27th Avenue within the City of Miami. Funds for said purchase were available and provided from the Capital Improvement Program, Project 4331311 entitled "Hadley Park Improvements", Account Code No. 589301-830. As directed by said prior Motion, Commission ratification of this action is now requested. 94- J0� TO: FILE FROM �;es4j ti: 'pai City Vana er CITY OF MIAMI, FLORIDA INTER -OFFICE MEMORANDUM DATE FILE SUBJECT: Finding of an Emergency Hadley Park Playground REFERENCES ENCLOSURES. This memorandum serves as the writ'_f�-.n finding of a valid public emergency for the installation of playground equipment in Hadley Park, and is based on the following: • Hadley Park, located in the economically depressed Model Cities area, is a valuable recreational resource of the City and intrinsically enhances the quality of life for area residents, particularly the young children of the neighborhood. • The playground equipment at Hadley Park had seriously deteriorated to the point where its removal was required to safeguard the health and well-being of young park users. • The City had recently received formal bids and awarded a contract/purchase order for modi:L play equipment at Gibson Park, and the Parks and Recreati: :Department recommended that the identical equipment be instal...:a at Hadley Park to replace the deteriorated play structure. • By hastening the pace of the procurement process through the use of informal bids, the City could obtain better pricing on the required equipment and meet the critical and immediate need of Hadley Park area residents for adequate leisure and recreational facilities. • Adherence to normal competitive bid procedures for this project would impose a hardship on the City and area residents, deleterious to the health, safety and welfare of its residents and to the convenient,? of municipal affairs. Such conditions indicated the need for extraordinary measures. CA-23 A MOTION TO RECONSIDER RESOLUTION 93-523 M 93-530 (CLASSIFYING 300 FIREFIGHTING BUNKER GEAR SETS MOVED: DAWKINS AS CATEGORY "A" SURPLUS STOCK AND DONATING 250 SECONDED: ALONSO OF SAID SETS TO THE CITIES OF COMODORO, UNANIMOUS ARGENTINA, GALVEZ, ARGENTINA, LAS PALMAS: CANARY ISLANDS, CALI, COLOMBIA, SAN JOSE, COSTA RICA, SANTO DOMINGO, DOMINICAN REPUBLIC, AND MANAGUA, NICARAGUA; AND 50 SETS FOR PORT - AU -PRINCE, HAITI).
