AOL k J--94-222 f� 2'/23/94 9"' 192 t RESOLUTION NO. zT A RESOLUTION RELATING TO THE.DISPOSITION AND CONVEYANCE OF AN EIGHT (8) UNIT CITY -OWNED ' MULTIFAMILY APARTMENT BUILDING LOCATED AT 240 NORTHWEST 11TH STREET, MIAMI, FLORIDA, IN THE r' OVERTOWN'NEIGHBORHOOD, TO ST. AGNES RAINBOW VILLAGE DEVELOPMENT CORPORATION, INC., A NOT -FOR --PROFIT CORPORATION, FOR THE PURPOSE OF PROVIDING HOUSING AFFORDABLE TO LOW AND MODERATE INCOME FAMILIES IN THE OVERTOWN NEIGHBORHOOD; AUTHORIZING THE CITY MANAGER TO CONVEY AND DISPOSE OF THE SUBJECT CITY -OWNED` -MULTIFAMILY BUILDING AT NO COST; FURTHER AUTHORIZING THE CITY ATTORNEY TO PROCEED .IN CONVEYING THE SUBJECT PROPERTY AFTER THE ABSTRACT OF TITLE HAS BEEN BROUGHT CURRENT. WHEREAS, there exists a severe shortage of standard housing in the City. of Miami affordable to families and individuals of low and moderate income; and WHEREAS, the City Commission recognizes that the participation of both the public and private sector is necessary." to foster the development of housing affordable to low and moderate income families and individuals; and WHEREAS, incorporated in the Overtown Redevelopment Plan was a concept that the City of Miami would acquire and rehabilitate a multifamily apartment located in the "Overtown Rehabilitation Demonstration Area" for the purpose of the City taking the initiative and leadership in promoting the rehabilitation of existing substandard multifamily apartment buildings in the area; It $ t t 04 L , W, WHEREAS, the concept was intended to demonstrate the eooriomio feasibility of undertaking such rehabilitation r ` activities and to serve as a model from which owners of similar t .multifamily apartment buildings could adopt construction techniques utilized and feasibility of rehabilitating their properties utilizing low -interest renovation loans from the City of Miami; and WHEREAS, in 1979 due the publicity generated in the media over the adoption of the Overtown Redevelopment Plan, Mr. W.R. Robbins, owner of a 14 unit multifamily apartment building, located at 240 N.W. 11th Street, offered to donate this property provided the City would assume responsibility for all the necessary renovations; and WHEREAS, utilizing a special allocation of CDBG funds, the City, rehabilitated and converted the formerly 14 unit apartment building into an 8 unit apartment building; and WHEREAS, it was envisioned that after a two -three year period of management of the property by the City, it would be conveyed to the tenants for cooperative ownership or to a neighborhood based not -for -profit organization for ownership and ' management; and WHEREAS, after more than a ten (10) year period of ` management by the City, the U.S. Department of Housing and Urban r Development, in a recent correspondence dated June 14, 1993, is 4s requiring that the City take the necessary steps to dispose of 4 the subject property; and 94- 192 5 � t 014 A 1t WHEREAS, in an effort to address this audit finding, the Department of Development and Housing Conservationrecommends that the subject City -owned 8 unit multifamily apartment building, located at 240 N.W. llth Street in the Overtown neighborhood, be conveyed to St. Agnes Rainbow Village Development Corporation for the purpose of providing affordable housing for low and moderate income families in the Overtown neighborhood; and WHEREAS, Section 29-B of the City Charter allows for the conveyance or disposition of pity -owned property in connection with the implementation of pity -assisted housing programsor projects which are intended to benefit persons or households of low and/or moderate income without being subject to 'competitive bidding _requirements and fair market value return to the city; and WHEREAS, the City Administration recommended the conveyance of the _subject city -owned multifamily apartment building at no cost for the aforementioned purpose; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are hereby adopted by reference thereto and incorporated herein as if fully set forth in this Section. Section 2. In 1979, they Overtt+wn Redevelopment `Plan which was approved and adopted by the City Commission, incorporated d concept,. which would involve the -City of Miami in the acquisition and rehabilitation of a multifamily apartment building located in the "Overtown Rehabilitation Demonstration Area". The primary purpose of this initiative involved the City of Miami taking a leadership role in promoting the rehabilitation of existing substandard multifamily apartment buildings in the area. Moreover, with the City taking the lead role in this endeavor, it would' demonstrate the economic feasibility of undertaking such rehabilitation activitiea, as well asserve as a model from which , other owners of similar multifamily apartment buildings could rehabilitate their properties, utilizing low interest loans provided through the city•s Multifamily Rehabilitation Loan Program. ` 94- 192
