NOW, THEREFORE, BE IT RESOLVED BY THE -COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the
Preamble to this Resolution are hereby adopted by reference
thereto and incorporated herein as if fully set forth in this
i

Section 2. The City Manager- is hereby authorized to=
}
accept the findings of the Selection Committee concerning the use
of vacant retail Space Ill in the Overtown Shopping Center.
Section 3. The City Manager is hereby authorizedl" to E
negotiate and execute a Revocable Permit, in a form acceptable to s
the City Attorney, with The Gift of Beauty Hair & Nail Salon for
the. use of Space 111 in the Overtown Shopping Center, located at
1490 Northwest 3rd Avenue, Miami, Florida, said Revocable Permit
shallbe negotiated to include amongst other provisions (a) the
use ofthespace on a yearly basis, subject to a thirty (30) day
revocation notice, (b) payment of Use Fee, (c) payment of utility
and telephone charges, (d) provision of insurance as prescribed
by the City Manager or his designee, (e) maintenance of the
interior space, and (f) commencement of retail operations within`
90 days of the date of execution of said Revocable Permit.
1 The herein authorization is further subject to compliance with
all requirements that may be imposed by the City Attorney,
including but not limited to those prescribed by applicable
City Charter and Code provisions.

RECOMMENDATION
It 'is respectfully -recommended that the City Co' ission adopt the
attached Resolution authorizing the City Manager.`to accept the -
findings of°'the selection .committee which reviewed eight
proposals received from retail business operators for the use`of ,
vacant retail space in the City -owned Overtown Shopping Centerr,
and. to further authorize the City Manager to negotiate and
execute a' Revocable Permit with The Gift of Beauty Hair & Nail
Salon, in a form acceptable to the City`Attorney;' for,th.e use''of
space 111 in the Overtown Shopping Center,'located at 1490-N.W. 3
Avenue, as a hair and nail care shop.
BACKGROUND
In order to solicit retail business operators for the use of our
vacant spaces in the Overtown Shopping Center through competitive'
negotiations, advertisements were published in Miami Herald
(Local and "Neighbors" sections), Miami Times, and E1 Nuevo.
Herald (Local section) announcing a pre -proposal conference which
was held at the Overtown Shopping Center on December 8, 1993.
Additionally, a sign was placed at the site and announcements
were mailed to interested parties and were also hand -distributed
throughout the Overtown neighborhood,
During the pre -proposal conference, eighteen (18) proposers
picked up ;Request for Proposals packages and staff provided an in
depth explanation regarding all the necessary elements required
of :.proposers, i.e., the application form; Business and Operating
Plan; financial statements or tax returns; and refundable
corporate deposit. The selection criteria was explicitly
detailed and business assistance resources were made available.
On December 20, 199,3, eight (8) sealed proposals were received
which were evaluated on January 14, 1994 by a four member
selection `committee on the basis of the proposers' Business and
Operating Plans; applications; and financial disclosure.
