HomeMy WebLinkAboutR-94-0081J-94-87 :. 2/9/94 c 9 4 - RESOLUTION NO. p A RESOLUTION AUTHORIZING THE CITY MANAGER TO EXECUTE A LEASE AGREEMENT, IN A FORM ACCEPTABLE TO THE CITY ATTORNEY, WITH THE UNITED STATES OF AMERICA DEPARTMENT OF TRANSPORTATION, FEDERAL AVIATION ADMINISTRATION, FOR THE USE OF A VACANT PARCEL OF LAND MEASURING APPROXIMATELY 300 FEET BY 200 FEET WHICH IS LOCATED ON VIRGINIA KEY, DIAGONALLY ACROSS THE NORTHWEST CORNER OF THE MIAMI-DADE WATER AND SEWER AUTHORITY TREATMENT PLANT, FOR THE CONSTRUCTION AND PLACEMENT OF AN AIR ROUTE NAVIGATIONAL FACILITY ON VIRGINIA KEY, FOR A TERM OF ONE YEAR, AT A BASE RENT WHICH SHALL BE DETERMINED BY AN APPRAISAL OF FAIR MARKET RENT, PAYABLE MONTHLY, PLUS SUCCESSIVE ANNUAL RENEWALS SUBJECT TO AN ANNUAL THREE PERCENT (3%) RENT ESCALATION; SAID ANNUAL RENEWALS SHALL NOT EXTEND BEYOND THE YEAR 2004.. WHEREAS, the United States of America Department of Transportation Federal Aviation Administration (FAA) utilized a Very High Frequency Omni -Directional Radio Range with Tactical t Air Command (VORTAC) device which was located in Biscayne Bay until it was destroyed by Hurricane Andrew; and WHEREAS, eighty percent (80%) of all aircraft traveling to Miami, utilized air routes generated by the Biscayne Bay VORTAC and loss of the Biscayne Bay VORTAC has greatly impacted Miami air traffic control procedures by eliminating essential air CITY CobnwsIOA MEETING OF FEB 17 1994 Rwoludon No. 94- R1_ c Sr j WHEREAS, the FAA's option of restoring the site was abandoned due to environmental sensitivity, technical difficulties and the need to move the facility to a land site; and WHEREAS, replacing the VORTAC facility on Virginia Key will maximize the use of the Miami airspace and establish a more reliable facility; and WHEREAS, on May 13, 1993, by Motion 93-326, the City commission unanimously referred the FAA's proposal for the reestablishment of the air navigational facility (VORTAC) on. Virginia Key, and further instructed the City Manager to negotiate with the FAA concerning said proposal and to come back before the Commission with a recommendation; and WHEREAS, the proposed City -ownedfacility is a remote, vacant area of Virginia Key, zoned G/I (Governmental Institutional) which allows the development of facilities for federal; state and local government activities including public utilities, and WHEREAS, an appraisal of fair market rent is currently being performed by Waronker & Associates, Inc.; and WHEREAS, the terms and conditions of a one year. Lease Agreement have been negotiated at a base rent consisting of the ,I is fair market rent which is currently being determined, plus 94- 81 2 ' r r it y successive annual renewals subject to an -annual three percent (3%) rent escalation with said annual renewals not to extend' beyond the year 2004 NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA:- Section 1. The recitals and findings contained in the Preamble to this Resolution are hereby adopted by reference thereto and incorporated herein as if fully set forth in this -.Section. Section 2. The City Manager is hereby authorized , to execute a Lease Agreement1.l in a form acceptable to the City Attorney, with the United States of America Department of Transportation, Federal Aviation Administration, for the use of a vacant parcel of land measuring approximately 300 feet by '200' feet which is located on Virginia Key, diagonally across the northwest corner of the Miami -Dade Water & Sewer Treatment Plant; for the construction and placement of an air route navigational facility on, Virginia Key, for a term of one year at fair market rent, payable, monthly, plus successive annual renewals subject to The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter and Code provisions. 94- 81 3 j i �.an annual three percent (3%) re id > n't`extending beyond the year 2( Section 3.
