HomeMy WebLinkAboutR-94-0080J-94-149 2/17/94 `` x5 RESOLUTION NO. 4 80 A RESOLUTION AUTHORIZING THE CITY MANAGER TO EXECUTE A MODIFICATION, IN A FORM ACCEPTABLE TO THE CITY ATTORNEY, TO THE AGREEMENT BETWEEN THE CITY OF MIAMI AND THE WACKENHUT CORPORATION FOR THE PROVISION OF ARMED PRIVATE SECURITY SERVICES FOR THE FLAGLER/CORE AREA SECURITY DISTRICT AND THE FLAGLER/CORE AREA SECURITY DISTRICT SPECIAL IMPROVEMENT DISTRICT EXPANSION DISTRICT BY EXTENDING SAID AGREEMENT FOR 48 DAYS, THROUGH APRIL 21, 1994; FUNDING FOR SAID SERVICES IN THE AMOUNT OF THIRTY NINE THOUSAND SEVEN HUNDRED AND SIXTEEN DOLLARS AND FIFTY-ONE CENTS ($39,716.51) TO BE FULLY PROVIDED BY A SPECIAL ASSESSMENT ON BENEFITED PROPERTIES WITHIN SAID DISTRICTS WHEREAS, on June 7, 1989, the City Commission adopted Resolution No. 89-548, as amended, establishing the Flagler/Core Area Security District Special Improvement District; and WHEREAS, on June 30, 1989, the City Commission adopted Resolution No. 89-626 establishing the assessment rates for said District; and WHEREAS, on September 14, 1989, the City Commission adopted Resolution No. 89-828 determining that security and street maintenanoe and similar services be provided for a period of one year in the Flagler/Core Area Security District Special Improvement District; and 4 WHEREAS, the City Commission levied special assessments against properties, in said district, benefiting through it ;;. provision of such services in accordance with the final assessment roll filed with the City Clerk; and WHEREAS, the District was expanded pursuant to Resolution r No: 91-468 (original and expansion districts collectively referred to herein as the "District"), extended for one year by Resolution No. 91-292, and extended for an additional ninety days by Resolution No. 92-248; and WHEREAS, on July 9, 1992, the City Commission adopted Resolution No. 92-473 extending the District for a period of one -hundred ninety-two (192) days (through March 7, 1993); and WHEREAS, on July 9, 1993, the City Commission also adopted Resolution No. 92-471 authorizing the Downtown Development Authority to issue a Request For Proposals for armed private security servioes for the District; and WHEREAS, on September 24, 1992, the City Commission adopted ResolutionNo. 92-576 authorizing a contract for armed private security services with the Wackenhut Corporation for the District through March 7, 1993; and WHEREAS, on February 28, 1993, the City Commission adopted Resolution No. 93-127 authorizing extension of the District and the Wackenhut Contract through March 7, 1994; and WHEREAS, on January 6, 1994, after all property owners within the District, presently being assessed for security and maintenance services, were notified, a Property Owners' Meeting was scheduled to elicit comments from the District's Property Owners; and 94_ 80 �� iS f, WHEREAS, included in said meeting's notification was a ` questionnaire intended to provide all property owners with the opportunity to express their opinions on the continuation of the District in lieu of, or in addition to, attending the meeting; and WHEREAS, twenty-nine (29) of the approximately one hundred forty-seven (147) property owners (20%) responded to the questionnaire; and WHEREAS, at a meeting on January 27, 1994, the following final recommendations, among others, were made concerning the district: 1) the District should be extended for an additional year to March 7, 1995; 2) private armed security services be continued and that a Request For Proposals be issued for said 1 services; and 3) the tax assessment rates for the District remain At the same level as the past year; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY f OF MIAMI, FLORIDA: Seotion 1. The recitals and findings contained in the i Preamble to this Resolution are hereby adopted by reference thereto and incorporated herein as if fully set forth in this Section. Section 2. The City Manager is hereby authorized to execute a modification, in a form acceptable to the City Attorney, to the Agreement between the City of Miami and the Wackenhut Corporation ("Agreement") for the provision of armed private security services for the Flagler/Core Area Security District and the Flagler/Core Area Security District Special -3- 9 4 — 80 04- 80 / rglw*74� or 900 S.W. First St, 3rd Floor, Miami Florida 33135 TELEPHONE: (305) 324-6260 Since we submit our 1994 proposal last month to the City of Miami, we were inform that such proposal was a duplicity of Crime Prevention and Awareness. We had follow the advice and we have elaborated another proposal that we believe will not constitute a duplicity of any kind and for this purpose we carefully research in the last three weeks every program that is been funded by the City of Miami. PROGRAM CRITERIA PROPOSAL R First: We dr,velop a training to make Senior Citizens as to how to Run better when someone try U, hold them up. Second: We will teach them (Senior Citizens) how to select in any Hardware store, as to what type of Hammer they should purchase; we know that there are few style of hammers, and of course we have to trained them as to how to develop a mild intensity blow to the body of those criminals without killing them. This training will take approxi- mately 6 hours. Third: Since there are so many Cuban's rafter crossing the channel now -a -day, we need some volunteers plus their best raft to develop an outdoor activities in order to trained them (Senior Citizens) due the fact that when Fidel Castro leave Cuba, it won't be enough transportation to take back all those who will like to go back; of course we need plenty of life jacket, without them it won't be safe to send them back to the island. Fourth: We also will provide enough training as to how to select what type of tennis shoes or sneakers they should purchase due the fact that when person with criminal intent jump on the senior citizen; they have to be ready to run. Fifth: As part of the so call readyness againts criminals we need to provide our senior citizens with $0.25 cents so they can be ready to contact the police Department or Rescue. Sixth: Last but not least also our intention required that we also provide them with Perrier water for refreshmen. Our international recognition demands from the Community that harbors us:' CLEAN'STREETS; SAFE'ENVIRONMENT and'APPROPRIATE POLICE'PROTECT ION. The Management of the Seybold Building feels that our elected officials - with few exceptions - have not provided the downtown businesses with those essential, basic requirements. Downtown Property Owners are taxed, willingly or otherwise,` every time indulgent spenders elected to office think that a new project must be subsidized. The Downtown Community neecb the basic services from the Citv of Miami.which must be generated from the taxes. already beina naid.. Moreover, the City of Miami should ana.lze its performance in managing the existing resources and the benefits or hinderances it brought to its taxpayers. I would like to point out the fact that the main arteries of access into.Downtown Miami have been simultaneously closed for �. construction. Needless to say, the consumer traffic has decreased approximately 50% as.a combined result of tourist fear and endless `1 traffic jams. If any private entity in Downtown Miami had closed most of its means of egress for over a year, what would have happened? It would have been declared "Unsafe to Conduct Business" and be forced to comply with City Code or close its oper4ion. The City of Miami continues to conduct business, forcing many Downtown vendors out of business. Another area where there is ample room for improvement is in ' decision making. The Downtown area desperately need enhancement, cleanliness and more police protection in order to compete with I. other areas. The services provided by the Wackenhut Company do not ( compensate for the money being spent. WE BELIEVE TI3AT IT IS USELESS! Moreover, a questionnaire was sent for Property Owners' response to such significant: issues as security services anu sanitation, we were again overlooked! Please be informed that Flagler Street Associates as the managing entity for the Seybold Building will not attend said meeting but DOES NOT approve the extension of the District for an additional.year,,the funding of private security services nor any other services for additional tax assessments on Downtown Properties, nor are we willing to pay any additional taxes. The Seybold Building does not approve of private security surveillance. It is indicative of the disregard of the public's trust and mismanagement of City's funds when additional taxation is requested for such basic services to which we are entitled as taxpayers. The Seybold Building pays over $250,000.00 a year in Real Estate Property Tax for which we receive NOTHING in return a. from our elected officials. The Seybold Building urges the DDA to work in our behalf, not to our detriment, and unite as a monolithic force to enhance 1 Downtown Miami's image by adequately managing our existing resources. j. As an accountant and Property Manager I can offer a solution to your budget woes. When expenses rise uncontrola•ly beyond your income, it's time to go out of business.
