LEVYING SPECIAL ASSESSMENTS AGAINST
PROPERTIESIN SAID DISTRICT BENEFITING BY THE
PROVISION OF SUCH SERVICES FOR SAID ONE YEAR, j

WHEREAS, Chapter 170, Florida Statutes (1991) authorizes the
levjr and collection of special assessments against property 1
1:,en.ef. S.i:ed for the purpose of stabilizing and improving retail
rind/or wholesale business districts and/or nationally recognized
h:iatorir, districts through promotion, management, marketing and

other similar services in business districts of the municipality;
and j
WHEREAS, on June 71 1989, by Resolution No. 89-548, the City
Cununissiondeclared the Flagler/Core Area Security District to be
i
t
a Special Improvement District for the provision of the above
specified services in accordance with applicable provisions of
Chapter 1.70, Florida Statutes, as amended; and
WIiEREAS, a preliminary assessment roll was filed with the+
S
Office of the City Clerk indicating the area to be improved, the
property to be assessed and the amount to be assessed against j
each parcel of property to be benefited, as required in Chapter
170 of the Florida Statutes; and
WHEREAS, on July 13, 1989, by Resolution No. 89-651, the

City Commission scheduled and thereafter held a public hearing on s
September 1.4 1989 to hear testimony from all
, � y property owners
and any other interested persons regarding the propriety,
advisability and cost of making improvements in the Flagler/Core;
Area 'Security District; and
WHEREAS, all affected property owners had received
appropriate notice of said public hearing as prescribed by
Chapter 170, Florida Statutes; and
WHEREAS, all complaints, comments and objections by
interested persons and affected property owners were received at

said hearing and thereafter treated on the basis of justice and
right as reflected herein in regard to the improvements and the
assessments; and
WHEREAS, said Flagler/Core Area Security District has been
deemed a successful element in the ongoing effort to stabilize

and improve the Flagler/Core Retail area; and

WHEREAS, on April 11, 1991, by Resolution No. 91-292, the
l
City Commission, after a public hearing, extended the term of the
Flagler/Core Area Security District for an additional year; and
WHEREAS, all affected property owners had received
appropriate notice of the above mentioned public hearing and were
given an opportunity to present testimony on the subject
extension; and
WHEREAS, on April 30, 1992, by Resolution No. 92-249, the
City Commission after a public hearing, extended the term of the
1!l.agler/Core Area Security District for an additional ninety (90)-
days to allow for additional property ownersinput regarding the
subject program; and
WHEREAS, subsequent to said Resolution No. 92-249, the;
affected property owners voted to continue the Flagler/Core Area
Special Assessment District through March 7, 199.3, for a period
of G1}e Hundred Ninety -Two (192) Days as per recommendations of
the Flagler/Core Area Security District Advisory Committee

("Advisory Committee"); and
WHEREAS, on July 9, 1992, by Resolution No. 92-473, the City'
Commission after a public hearing, extended the term of the
Flagler/Core Area Security District for an additional One Hundred
Ninely-Two (192) Days until March 7, 1993; and
WHEREAS, on February 25, 1993, by Resolution No. 93-127, the

Flagler/Core Area Security District for an additional year until

March.7, 1994; and
WHEREAS, the Advisory Committee and affected property owners
have met and discussed security concerns and further extension of
}
the term of the Flagler/Core Area Security District; and
WHEREAS, the City Commission is cognizant of the property
owners concerns, and is desirous of implementing the
recommendations of the Advisory Committee on this matter; and
WHEREAS, the property owners are now desirous of continuing
the •Flagler/Core Area Special Assessment District for an .
additional year;
NOW,.THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY
'OF MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the
Preamble to this Resolution are hereby adopted by reference
thereto and incorporated herein as if 'fully set forth in this
Section.
Section 2. Resolution No. 89-548, adopted June 7, 1989,
as amended, which ordered the creation of the Flagler/Core Area
Security District Special Improvement District is hereby
reconfirmed, and it is hereby determined that the properties
served by the security, street maintenance and other similar
services, as declared by Resolution No. 89-828, and extended by

b►. the stabilization and improvement resulting from

implementation of the subject district. Consequently said

services shall continue to be provided by the City of Miami on
t

the Flagler/Core Area security District for the time period set;
forth : below.
Section 3. The subject properties shall be assessed as
follows:
a. Buildings intended predominantly for
office use and surface parking lots
shall be assessed at $.175 per $1,000 of
assessed value;
b. All other buildings shall be assessed at
$.928 per $1,000 of assessed value.
Section 4. A final assessment roll shall be promptly
filed with the City Clerk's Office in accordance with this
Resolution and the applicable provisions of Chapter 170, Florida
Statutes. Such assessments contained in said assessment roll are
hereby levied and stand confirmed and remain legal, valid and
binding special assessment liens upon properties against which
such assessments are made, until paid. These assessments shall
be recorded in the "Improvement Lien Book" and the final
assessment roll shall list the lots and lands assessed and they
amount of benefit as to each lot or land and the manner of

payment of such assessment to be paid by all lots and lands

adjoining and contiguous or bounding and abutting upon such

More particularly described on "Exhibit A", attached hereto.
Section 5. An additional one year extension to the
Flaq)-er/Core Area Security District Special Improvement District
and attendant Special Assessments is hereby declared. Said
extension shall be supplemental to that authorized by Resolutions
No. 89-828, 91-292, 92-248, 92-473 and 93-127, 'and in accordance
;with. the final assessment roll to be filed forthwith with the
City Clerk.
Section 6. The final assessment roll, special
r!vessments 'levied therefrom, benefit period, and billing period;
ahal1. only be for, and restricted to, a one year time period.

Section 7. Resolutions numbered 89-548, 89-828, 91-292,
2-248, 92-473 and 93-127 are hereby incorporated herein by

Section 8. This Resolution shall become effective
immediately upon its adoption.

Background
On June.7.,, 198.9, the City .Commission passed Resolution No.'89-
"
548 ,. "as,, amended establishing' ;the Flagler/Core Area Security
Di atrict,.Specia1 Improvement District.
On 'June` 30, , 1989, the City Commission passed Resolution No. '89-`
.;626,'estab,lishing the assessment rates, for said District. }
On September 14, 1989, the City Commission passed Resolution No.
89-828 determining ,.that security a,nd street maintenance and.
81mifar services`r be provided for a period of one year `in the
'Flagler/Core Area Security District Special Improvement District.
They, Commission,. further levied special assessments against
properties, in said district, benefiting through provision of
such services in accordance` with the 'final `assessment roll"filed
with. the ,C,ity .Clerk.
The District was expanded by Resolution No. 91-468;' 'extendedfor
one ;year by. Resolution No. 91-292 and for ninety days by
Res$rlution No 92-248
-On;July_9, 1992, the City Commission passed Resolution No.""92-473
extending the District for a period of one hundred ninety-two
days through.-' March 7, 1993),.,
On`July. 9, 1993'y" the City Commission also passed Resolution No.,
92-471 authorizing.' the DDA to' 'issue a Request For Proposals for
armed private security ,services 'for the District.

On. -.September 24,.1992, the City Commission passed Reso%ution No.
92%576 a.,contract for armed private securit. services

with" the Wackenhut Corporation for the District through March. 7,
On ,February 255 1993, the City Commission passed Resolution No.
93-127'authorizing extension of the District and the .Wackenhut
Contract -through March 7., 1994.
On. January 6, 1994, a `Property Owners Meeting 'was scheduled to
elicit comments' from District Property Owners.All 'property
owners within the District, presently being assessed for security
and maintenance services, were notified of the meeting. Included
in,the notification was a questionnaire to provide all property
owners, with.. .the opportunity to express their opinions on
continuation of the District in lieu of, or in addition to,
attending the meeting. A total of 29 out of'approximately 147
property owners (20%) responded to the questionnaire (See
' .
Attached),.
AT; A MEETING ON JANUARY 27, 1994, THE FOLLOWING' FINAL
RECOMMENDATIONS WERE MADE CONCERNING THE DISTRICT:
„1)f, The District should be extended for an 'additional- year to
March.7, 1995.
That Private Armed Security Services be continued and that a
Request F,or Propos.als;be issued for said services.
3) That the Tax Assessment Rates for the District remain 'sit' the ,
