HomeMy WebLinkAboutR-94-0041d-94-148 1/13/94 94- 41 RESOLUTION NO, A RESOLUTION AUTHORIZING THE CITY MANAGER TO ENTER INTO GOOD FAITH NEGOTIATIONS TO ACQUIRE THAT CERTAIN PARCEL OF REAL PROPERTY LOCATED AT THE INTERSECTION OF SOUTHWEST 32ND ROAD, SOUTHWEST 1ST AVENUE AND SOUTHWEST 22ND TERRACE (APPROXIMATELY 168-200 SOUTHWEST 32ND ROAD, 3200-3202 SOUTHWEST 1ST AVENUE AND 1100-1139 SOUTHWEST 22ND TERRACE), MIAMI, FLORIDA, AND ALSO KNOWN AS THE "VIZCATRAN PROPERTY"; AUTHORIZING APPRAISALS AND TITLE STATUS; PROVIDING FOR INTENT; ESTABLISHING PARAMETERS; AND REQUIRING REVIEW BY THE CITY COMMISSION UPON THE CONCLUSION OF SAID NEGOTIATIONS. WHEREAS, the City Commission is of the opinion that it would be in the best interest of the City of Miami to acquire the property which is subjeot of the herein resolution; and WHEREAS, legal counsel for the subject property owner has pledged, during the public hearing on this date regarding this matter, that the property owner(s) will act in "good faith" during the pendency of the herein authorized negotiations between the City and subject property owner(s) relative to such acquisition, and will "not expend money unnecessarily" or otherwise act in a manner which would unnecessarily raise the purchase price of the subject property beyond the fair market value of said property as of the date of this resolution; and CITY CONIIUSSION MEnXQ OF JA N 1 3 1994 Resolution No, y 94_ 41 ► WHEREAS, the herein resolution is intended solely for purposes of initiating negotiations by the City relative to the possible acquisition of said property, and is not intended nor shall said resolution be interpreted or construed as granting any f additional rights to the property's owner(s), waiving any rights of the City, or obligating the City or property owner(s) to buy or sell any real property relative to the subject resolution; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are hereby adopted by reference thereto and incorporated herein as if fully set forth in this Section. Section 2. The City Manager is hereby authorized to enter into Good Faith negotiations with the owner(s) of that certain parcel of real property located at the intersection of I� Southwest 32nd Road, Southwest 1st Avenue and Southwest 1 22nd Terrace (approximately 168-200 Southwest 32nd Road, 3200-3202 Southwest 1st Avenue and 1100-1139 Southwest 22nd Terrace), Miami, Florida, and also known as the "Vizoatran Property" (the "Property"), to acquire via purchase or an exchange of real property or a combination thereof, said Property for the benefit and public purpose use of the City of Miami. 94- 41 -2- Section 3. The City Manager or his designee is further authorized to expend funds necessary to obtain two (2) appraisals on the Property and to ascertain title status. Section 4. The herein authorizations are contingent upon representations made by Property owners' legal counsel during the herein Public Hearing that said Property's owner(s) will act in good faith during pendency of the herein authorized negotiations. Section 5. All negotiations with the Parcel's property owner(s) shall proceed in an expeditious manner and shall be in good faith, and any recommendations to the City Commission emanating therefrom shall be subject to a determination by the City Attorney that all applicable legal requirements regarding the disposition of interest in any affected City real property can be satisfied. Section 6. The authorizations contained herein are solely for purposes of initiating good faith negotiations, and are fully contingent upon and subject to the City Commission's final approval of any future agreement, tentative, preliminary or otherwise, regarding the acquisition of the subject Parcel by the ` City of Miami.
