THE MEMBERS OF THE CITY COMMISSION AFTER A
DULY ADVERTISED PUBLIC HEARING, RATIFYING THE
CITY MANAGER'S FINDING THAT AN EMERGENCY NEED
EXISTED, WAIVING THE REQUIREMENTS FOR
COMPETITIVE SEALED BIDS AND APPROVING THE
ACQUISITION OF A PLASTIC CAGE FOR THE EAGER
BEAVER RECYCLER 23 FROM GENERAL ENGINES
COMPANY, INC., IN A PROPOSED AMOUNT OF
$7,280.00 FOR THE DEPARTMENT OF GENERAL
SERVICES ADMINISTRATION AND SOLID WASTE;
ALLOCATING FUNDS THEREFOR FROM THE FY'93
RECYCLING AND EDUCATIONAL GRANT FUND, ACCOUNT
CODE NO. 421303-840, PROJECT NO 197007.
WHEREAS, there was a need to purchase a cage for the Eager
Beaver Recyoler 23 Body from General Engines Company, Inc. on an
emergency basis due to time constraints. This needed equipment
was purchased out of the FY '93 State of Florida Recycling and
Education Grant fund before the September 30, 1993 deadline; and
WHEREAS, this equipment will be added to the existing fleet
for Citywide recycling, to improve upon the collection schedule;
and
WHEREAS, funds for this equipment are available from FY '93
State of Florida Recycling and Education Grant Fund, Account Code
No. 421303-840, Project Code No. 197007;

NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the
Preamble to this Resolution are hereby adopted by reference
thereto and incorporated herein as if fully set forth in this
Section.

Section 2. By a 4/5ths affirmative vote of the members
of the City Commission, after a duly advertised public hearing,
I the City Manager's written finding that a valid emergency need
f existed for the purchase of a cage for the Eager Beaver Recycler
23 Body from General Engine Company, Inc., in the proposed amount
of $7,280.00, is hereby ratified, confirmed and approved, with
funds therefor hereby allocated from the FY 193 State of Florida
Recycling and Education Grant Fund, Account Code No. 421303-840.
Section 3. The requirements for competitive sealed bids
is hereby waived for the Department of General Services
Administration and Solid Waste's acquisition of the above
equipment.
Section 4. The City Manager's action in authorizing the
Chief Procurement Officer to issue a purchase order for this

equipment is further ratified, confirmed and approved.
Section 5. This Resolution shall become effective
immediately upon its adoption.

ENCLOSURES
It is respectfully recommended that the City Commission pass the
attached resolution ratifying, approving and confirming the need
for an emergency purchase of a plastic cage for the Eager Beaver
Recycler 23 body, which is a design unique to their product from
General Engines Company, Inc. a non -minority vendor located at
4425 Highway 27, Lake Wales, Florida at a total proposed amount
of $7,280.00. Funding is available in the FY'93 State of Florida
Recycling and Education Grant Fund, Account Code No. 421303-840,
Project Code No. 197007.
The Department of General Services Administration and Solid Waste
has determined the need to secure this emergency purchase due to
the time constraints of replacing this needed equipment out of
the FY'93 State of Florida Recycling and Education Grant Fund
before the September 30, 1993 deadline for expending funds, so
that this truck will be added to the existing fleet for City-wide
recycling to improve the collection schedules.

This memorandum respectfully requests your approval for the
purchase of a plastic cage for the Eager Beaver Recycler 23 body
from General Engines Co., Inc. for a total amount of �280.00
They are a non -minority vendor located at 4425 Hwy. 27, Lake
Wales Fla. 33033.
This is an emergency purchase due to the time constraints of
replacing this needed equipment out of the FY'93 grant fund
before the September 30th deadline for reimbursement from the
state grant so that we can add this truck to our existing fleet
for City-wide recycling and to help ensure a timely collection
schedule.
We have available funding in the FY'93 Recycling and Education
Grant Fund, 197005-421303-840.
Subsequently, this item will scheduled for ratification on the
next available City Commission agenda.
Your favorable approval in this regard will ensure this action is
done in a timely manner.

IMPORTANT NOTICE
Terms and Conditions
1, Invoices must be mailed in duplicate to City of
Miami Accounting Division, Dept. of Finance, P.O.
Box 330708, Miami, Fla. 33133.
2. Always ship by least expensive route unless other-
wise specified.
3. A copy of the delivery slip must be left with the
receiving clerk.
4. Do not substitute or change this order without
authority from Procurement Management.
5. The right is reserved to inspect all shipments after
delivery and to reject any material which may be
defective or not in accordance with the stated
specifications.
6. Except by prior agreement, this order must not be
shipped or invoiced at prices higher than those
shown.
7. The seller has complied or will comply with all
Federal, State, and local laws or orders applicable
to the purchase, manufacture, processing, and
delivery of materials.
8. Where Federal excise tax applies, invoice must
show gross price, amount of tax and net price. Ex.
emption certificate will be furnished on request.
9. If delivery to destination cannot be made on or
before the specified date, notity the Procurement
Management Office promptly. This order will
become null and void after ninety (90) days unless
otherwise specified, or by agreement with Procure-
ment Management.
10. If the seller shall default in any respect or become
insolvent, or if a petition in bankruptcy is filed by
or against the seller under any Federal, Stale, or
local law; the City, in addition to other rights or
remedies, may terminate or cancel this order.

Apublic hearing will be held by the City commission of the City
of
Miami, Florida on 1994, at M. in the
City Commission Chambers at City Hall, 3500 Pan American Drive,
Miami, Florida, for the purpose of hearing any objections by the
City Commission from any interested parties affected by a
eso1 tion ratifying the City Manager's action in waiving
competitive soalrrd bids and purchasing a plastic cage for the
Eager Seaver 'Re-:ycler 23 Body from General Engines Company,
Inc., due to ;time constraints, as the deadline for the funding
available in the FY'93 State of Florida Recycling and Education
Grand Fund expired September 30, 1993.
All interested rsons are invited to appear ppear and may be heard
concerning this item. Should any person desire to appeal any
decision of the City Commission with respect to any matter
considered at� this hearing, that person shall ensure that a
verbatim record of the proceedings is made, including all
