SAID SERVICES.
WHEREAS, the City Com ission adopted. Resolution No. 91-139 on
February 14, 1991, which approvled the engagement of the law firm of Greenberg,
Traurig to serve as outside counsel in connection with the claim by the EPA
against the City of Miami with regard to the PPC VPL site, with the interim
fee for such services not to exoeed $10,000; and
WHE AS, with Greenberg, Traurig's recommendations, the City joined the
group of settling Potentially Responsible Parties ("PRP") making a good faith
offer of settlement for the cleaning costs of Operable Unit No. One ("OU--1")
at the PPC NPL site; and
WHEREAS, the group of settling PRPs has started the remedial
design/remedial action proposed for OU-1 and continues negotiation with EPA
regaxiing the cleanup costs of Operable Units Nos. Two ("OU-2") and Three
("OU-3"); and

WHEREAS, there will be additional fees and costs incurred by Greenberg,
Traurig in connection with the completion of the remedial design/remedial
action for OU-1 and the negotiations with the EPA for OU-2 and OU-3;
NOW, TfEREbRE, BE IT RESOLVED BY THE OOMrISSION OF THE CITY OF MIAML,
Section 1. The recitals and findings contained in the Preamble to this
Resolution axe hereby adopted by reference thereto and incorporated herein as
if fully set forth in this Section.
Section 2. The City Attorney's continuing engagement of the law firm of
Greenberg, Traurig, Hoffman, Lipoff, Rosen & Quentel, P.A. to serve as
counsel, at an interim fee not to exceed $25,000, is hereby approved. 9n
connection with the Environmental. Protection Agency ("EPA") claim against the
City of Miami, United. States of America, v. (Reserved), with regard to the
i Petroleum Products Corporation ("PPC") National Priority List ("NPL") Site,
i with funds therefor hereby allocated from the City of Miami's Self -Insurance
and Insurance Trust Fund for said services.
Section 3. This Resolution sha1.1 become effective immediately upon its
adoption.
PASSED AND ADOPTED this 13 th day of January 1994.

It is respectfully recommended that the City Commission
approve the attached Resolution approving the continuing
engagement of the law firm of Greenberg, Traurig, Hoffman,
Lipoff, Rosen & Quentel, P.A. for services rendered and to be
rendered in connection with the claim by the Environmental
Protection Agency against the City of Miami with regard to the
Petroleum Products Corporation NPL site, with funds for said
services to be allocated from the Self -Insurance and Insurance
Trust Fund. The Resolution further authorizes expenditures for
necessary costs and expenses in connection with these
proceedings.
