RESOLUTION NO. 9 4
A RESOLUTION, WITH ATTACHMENTS, ACCEPTING THE PLAT
ENTITLED OMNI ANNEX, A SUBDIVISION IN THE CITY OF
MIAMI, SUBJECT TO ALL OF THE CONDITIONS OF THE PLAT
AND STREET COMMITTEE, AND ACCEPTING THE DEDICATIONS
SHOWN ON SAID PLAT; AUTHORIZING AND DIRECTING THE
CITY MANAGER AND CITY CLERK TO EXECUTE THE PLAT;
AND PROVIDING FOR THE RECORDATION OF SAID PLAT IN
THE PUBLIC RECORDS OF DADE COUNTY, FLORIDA.
WHEREAS, the City Department of Public Works recommends the
acceptance of the plat;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The plat entitled Omni Annex is a replat of
portions of Blocks 1, 2 and 3, Robbins, Graham and Chillingworth,
Plat Book A, Page 49 112, and Lots 1 and 2, and portions of Lots 3
through 8, W.T. Heslington Subdivision, Plat Book B, Page 97, and a
portion of the plat entitled "Replat", Plat Book 57, Page 69, and
Lots 1 and 2, and the East 1/2 of Lot 3, Amended Map, Seitter
Addition, Plat Book 2, Page 60, and a portion of the South 112 of
the South 112 of the Northeast 1/4 of the Northeast 1/4 of Section
36, Township 53 South, Range 41 East, and portions of Northeast 1
Avenue and Northeast- 1 Court lying between Northeast 17 Street and
Northeast 17 Terrace, and a portion of Northeast 17 Terrace lying
between Northeast 2 Avenue and Northeast 1 Avenue, all lying in
Section 36, Township 54 South, Range 41 East, City of Miami, Dade

County, Florida, more particularly described as set forth on the
attached "Attachment 111, which plat by reference is made a part
hereof as if fully incorporated herein, and, subject to all of the
conditions required by the Plat and Street Committee as set forth
in Exhibit "A" attached hereto, is hereby accepted. The
dedications shown on the plat together with the dedications to the
perpetual use of the public of all existing and future planting,
trees and shrubbery on said property, are also hereby accepted and
confirmed by the City of Miami, Florida.
Section 2. The City Manager and City Clerk are hereby
authorized and directed to execute the plat and cause the same to
be recorded in the Public Records of Dade County, Florida.
Section 3. This Resolution shall become effective immediately
upon its adoption.

OMNI ANNEX - TENTATIVE PLAT *1434
The City of Miami Plat and Street Committee, at Its meeting of
June 12, 1992, approved the above tentative plat subject to the
following revisions being made to the tentative plat, additional
Information being provided and/or variances being granted. Please
be advised that the processing of your tentative plat cannot
proceed until these conditions have been satisfied.
- Indicate property as one tract.
- Show all existing trees.
- HC-1 Zoning designation Is not current. Correct
description to be shown on location sketch Is G/I.
- At the northwest corner of the plat, there Is a lot 3
remnant. Please provide an opinion of title regarding
the remnant ownership to G. Miriam Maer, Chief
Assistant City Attorney, 579-6700.
- Show all alleys to be vacated. Also vacate and close a
portion of N.E. 2 Avenue. Also note this In the
express purpose of the plat.
- Show all subdivisions and zoning districts In the
location sketch. Also, provide a north arrow and
fractional description.
- Calculate and show the areas of the rights of way,
streets, alley, etc., to be vacated. Indicate square
footages.
- All dedications shall be to zoned street -line.

- Mlaml-Dade Water & Sewer Authority Department will
require a 12-Inch water main extension In N.E. 17
Street from N.E. 1 Avenue to N.E. Miami Place and in
N.E. Miami Place from N.E. 17 Street to N.E. 17
Terrace. Contact M-DWASAD regardlnig sewer
modifications.
- Miami Fire Department will require two hydrants: one
at the southeast corner of N. Miami Place and N.E. 17
Terrace and one also at the cul-de-sac.
- Provide 25' Inside radius at cul-de-sac.
- Meet all requirements of utility companies.
Underground utilities exist In N.E. 17 Terrace,
Including a 42-Inch storm sewer. N.E. 17 Terrace
either must remain as a 30-foot easement or all
utilities must be relocated within new easement at
owner's expense.
The Plat and Street Committee has reviewed the public
Interest requirements set forth In Section 54.5-16 of
the City Code for the street vacation and closure. It
Is the finding of the Committee that the application
for the vacations and closures of N.E. 17 Street,
portions of N.E. 2 Avenue, N.E. 14 Avenue, N.E. 1 Court
and three (3) 10-foot alleys meet the requirements of
the Miami City Code and should be forwarded to the
Miami Zoning Board with a recommendation of approval.
In addit-lon to the above requirements, you should be aware of
the following:
1. State and local laws require the Installation of various
physical Improvements in the public rights -of -way when
property Is platted. These subdivision Improvements
include paving, drainage, landscaping, sidewalks, etc. In
some cases this could represent a substantial Investment
on your part.

2. The alteration, relocation or installation of utilities
such as storm and sanitary sewers, electric, telephone,
water, etc., caused by this plat will be at the property
owner's expense. Also, utility easements may be required
on the property being platted.
3. A building permit will not be Issued on the property being
platted until the final plat Is recorded. Also, the
Certificate of Occupancy for any building construction will
be Issued only after all the required subdivision
Improvements have been completed.
4. Approval for fire flow requirements must be obtained from
the Fire, Rescue and inspection Services Department prior
to the Issuance of a building permit.
5. Additional Items must be provided to the City of Miami
Department of Public Works before the final plat Is
submitted to the City Commission for approval. You will be
notified In writing as to what these Items are after the
amount of the bond has been determined for the necessary
subdivision Improvements.
6. Tentative plat approval is only valid for one (1) year from
the date of the Plat and Street Committee Meeting at which
time it was approved.

LOCATED ON NORTHEAST 17 STREET AND NORTHEAST 17 TERRACE
BETWEEN NORTHEAST MIAMI PLACE AND NORTHEAST 2 AVENUE
A SUBDIVISION IN THE CITY OF MIAMI, FLORIDA
The accompanying Plat entitled OMNI ANNEX was prepared by
Biscayne Engineering Company, Inc. It is in correct form for
submission to the City Commission and is forwarded with a
recommendation that it be approved.
PERTINENT INFORMATION REGARDING THE PLAT:
1. The property platted is a replat of portions of Blocks 1, 2
and 3, Robbins, Graham and Chillingworth, Plat Book A, Page
49 112, and Lots 1 and 2, and portions of Lots 3 through 8,
W.T. Heslington Subdivision, Plat Book B, Page 97, and a
portion of the plat entitled "Replat", Plat Book 57, Page
69, and Lots 1 and 2, and the East 1/2 of Lot 3, Amended
Map, Seitter Addition, Plat Book 2, Page 60, and a portion
of the South 112 of the South 112 of the Northeast 1/4 of
the Northeast 1/4, of Section 36, Township 53 South, Range
41 East, and portions of Northeast 1 Avenue and Northeast 1
Court lying between Northeast 17 Street and Northeast 17
Terrace, and a portion of Northeast 17 Terrace lying between

2. The location of the streets and the widths conform with the
standards of the Department of Public Works of the City of
Miami, Florida.
3. As certified to by Alfred B. Mohr, Registered Land Surveyor,
this Plat complies with the plat filing Laws of the State of
Florida.
4. The City Zoning Board of Miami, Florida, after Public
Hearing, has recommended the closing of the following:
a. Northeast 1 Avenue and Northeast 1 Court lying
between Northeast 17 Street and Northeast 17
Terrace;
b. Northeast 17 Terrace between Northeast 2 Avenue
and Northeast 1 Avenue; and
c. The North --South Alley lying in that block bounded
on the North by Northeast 17 Terrace, on the West
by Northeast Miami Place, on the South by
Northeast 17 Street and on the East by Northeast 1
Avenue.
This action was confirmed by City Commision Resolution No.
93--131 .
5. The Certificate of Title Examination dated November 1, 1993,
signed by Maynard J. Hellman, Attorney, indicates that the
fee simple title to the property platted is correctly vested
in OMNI LAND COMPANY, INC., a Florida Corporation, and that
the Plat has been correctly executed.

time beyond the one year time limit allowed to obtain final
plat approval by the City Commission, from the date of

when a plat cannot be processed for approval by the Dade

sanitary sewer restrictions (the Moratorium) imposed by the
