HomeMy WebLinkAboutO-11206J-94-904 10/24/94 ORDINANCE NO. 1.1206 AN ORDINANCE ESTABLISHING A NEW SPECIAL REVENUE FUND ENTITLED: "HOUSING OPPORTUNITIES FOR PERSONS WITH AIDS (HOPWA) GRANT PROGRAM (FY 1994)", AND APPROPRIATING FUNDS` -FOR THE SAME IN THE AMOUNT OF $5,155,000 FROM THE U.S. DEPARTMENT OF HOUSING AND URBAN DEVELOPMENT, FOR THE IMPLEMENTATION AND ADMINISTRATION OF THE 1994 HOUSING OPPORTUNITIES FOR PERSONS WITH AIDS PROGRAM; CONTAINING A REPEALER PROVISION AND A SEVERABILITY CLAUSE. WHEREAS, the Housing Opportunities for Persons With AIDS (HOPWA) Program was created under the AIDS Housing Opportunity Act, and revised under the Housing and Community Development Act of 1992; and WHEREAS, the U.S. Department of Housing and Urban Development (U.S. HUD) notified the City of Miami of funding. availability in the amount of $5,128,000 for the 1994 HOPWA Grant': Program on February 17,1994; and WHEREAS, U.S. HUD issueda revised notification to the City of Miami on April 15, 1994, which increased the 1994 HOPWA Grant amount to $5,155,000; and WHEREAS, in July of 1994, a grant application was submitted by the City of Miami in connection with the availability, of federal assistance under the HOPWA Program; and WHEREAS, in October of 1994, the City of Miami received HUD's funding approval of the HOPWA application submitted by the City; and 112O6 WHEREAS, the herein Ordinance is a proper vehicle to appropriate the aforesaid grant; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Ordinance are hereby adopted by reference thereto and incorporated herein as if fully set forth in this Section. Section 2. The following Special Revenue Fund is hereby established and resources are hereby appropriated as described herein: FUND TITLE: HOUSING OPPORTUNITIES FOR PERSONS WITH AIDS (HOPWA) PROGRAM GRANT (FY '94) RESOURCES: FEDERAL GRANT - U. S. DEPARTMENT OF HOUSING AND URBAN DEVELOPMENT $5,155,000 APPROPRIATION: HOUSING OPPORTUNITIES FOR PERSONS WITH AIDS (HOPWA) PROGRAM GRANT (FY '94) $5,155,000 Section 3. All ordinances or parts of ordinances insofar as they are inconsistent or in conflict with the provisions of this Ordinance are hereby repealed. Section 4. If any section, part of section, paragraph, clause, phrase, or word of this Ordinance is declared invalid, the remaining provisions of this Ordinance shall not be affected. - 2 - 11206 Section 5. The Department of Development and Housing Conservation recommends ratification of the attached appropriation ordinance. The ordinance identifies and appropriates Housing Opportunities for Persons With AIDS Program funds in the amount of $5,155,000 for implementation and administration of the HOPWA Program. .In February of 1994, U.S. HUD notified the City of Miami that for fiscal year 1994, HOPWA Program funding in the amount of $5,1551000 was available to provide services and other housing related activities to person with HIV/AIDS. Subsequently, the City's 1994 HOPWA application was approved by U.S. HUD for funding in the amount of $5,1551000. With the adoption of the attached ordinance the City can commence implementation of the HOPWA Program in order to make funding available as quickly as possible to those service providers of persons with HIV/AIDS.
