OF THE CODE OF THE CITY OF MTAMT, AS AMENDED,
RELATING TO PEDDLING AND VENDING IN CITY
PARKS, SY ESTABLISHING CONCESSION PRIVILEGES
FOR QUALIFIED NONPROFIT ORGANIZATIONS THAT
OPERATE ONGOING WEEKLY PROGRAMS FOR YOUTH,
ELDERLY AND/OR DISABLED PERSONS IN CITY
PARKS; BY DESIGNATING SAME AS "NONPROFIT"
CONCESSION PERMITS; BY CHANGING THE
DESIGNATION OF "TEMPORARY" CONCESSION PERMITS
TO "SPECIAL EVENT" CONCESSION PERMITS, AND BY
AUTHORIZING THE FORMULATION OF RULES,
PROCEDURES AND FEES FOR SPECIAL EVENT AND
NONPROFIT CONCESSIONS IN PARKS BY THE PARKS
AND RECREATION DEPARTMENT DIRECTOR SUBJECT TO
APPROVAL BY THE CITY MANAGER AND REVIEW BY
THE CITY ATTORNEY; REPEALING INOPERATIVE
PROVISIONS PERTAINING TO BEER AND WINE
PERMITS; AND CORRECTING THE NAME OF THE
DEPARTMENT AS NECESSARY; CONTAINING A
REPEALER PROVISION AND A SEVERABILTTY CLAUSE;
AND PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, the City of Miami encourages and supports the use
of oity parks for recreation and cultural events and programs
.sponsored by civic minded organizations and nonprofit groups; and
WHEREAS, pursuant to Ordinance No. 10123 adopted
July 10, 1986, codified as Seotion 38-45 of the City of Miami
Code, the city established concession privileges for sponsors of
special events conducted in city parks; and
WHEREAS, the Parks and Recreation Department ("Department")
strives to form partnerships with local nonprofit organizations
to enhanoe and increase supervised sports and recreational
programs in the parks system, particularly for youth, senior
oitizens and disabled persons; and

WHEREAS, several nonprofit organizations have begun to
conduct ongoing youth sports programs in a number of parks,
incurring significant expenses for insurance, transportation,
equipment, supplies and the like; and
WHEREAS, as a means of raising funds to support said
programs and activities conducted by nonprofit organizations for
youth, elderly and/or disabled persons, the City Manager and the
Department director recommend that said organizations be granted
concession privileges, primarily for the sale of food and
beverages in connection with said programs; and
WHEREAS, such concession privileges have been similarly
granted to nonprofit groups running programs at Metropolitan Dade
County parks and at parks operated by other local municipalities;
and
WHEREAS, since the adoption of Ordinance No. 10123, changes
in the general nature of special events and in the administration
of the department have created the need to modify the controls
and fee regulations for special event concessions; and
WHEREAS, the City Manager recommends that the development of
day-to-day rules, regulations, procedures and fees for nonprofit
and special event concessions be delegated to the authority of
the Parks and Recreation Department director, subject to the
review and approval of the City Manager and the City Attorney, at
least annually; and
WHEREAS, such delegation .shall render inoperative an
additional provision pertaining to beer and wine sales, thereby
necessitating the repeal of the affected provision; and

WHEREAS, as a general housekeeping activity, the name of the
Department should be corrected to its ourrent name wherever it
appears in this Section;
NOW, THEREFORE, BE TT ORDAINED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section Z. The xeoitals and findings contained in the
Preamble to this Ordinance are hereby adopted by referenoe
thereto and inoorporated herein as if fully set forth in this
Section.
Section2. The Code of the City of Miami, as amended, is

(a) Prohibitions: No person, organization or
firm, other than the parks; recreation
department, or duly authorized
concessionaires, shall expose or offer for sale, rent,
ar trade, any article or service, or station or plane

or display of any merchandise within the limits of any
park.

(b) Grant of concession privilege: The city may
authorize concessions in city parks by means of
contractual agreement(s) or tEmgo~ary caneessian
permit(s). Wherever practicable, ~ .unless otherwise

by the city manager to particular vendors on the basis
of a request for proposals, competitive bid or other
competitive method.

revenue accrued as a result of the privilege granted.

Section 3. All ordinances, or parts of ordinances
insofar as they are inconsistent or in conflict with the
provisions of this Ordinance are hereby repealed.
Section 4. Tf any section, part of section, paragraph,
clause, phrase ox word of this Ordinance is declared, invalid, the
remaining provisions of this Ordinance shall not be affected.
Seotion 6. This Ordinance is hereby declared to be an
emergency measure on the grounds of urgent public need for the
preservation of peace, health, safety, and property of the City
of Miami and upon the further grounds of the necessity to make
the required and necessary purchases and payments and to
generally carry out the functions and duties of municipal.

Section 6. The requirement of reading this Ordinance on
two separate days is hereby dispensed with by a vote of not less
than four-fifths of the members of the Commission.
Section 5. This Ordinance shall become effective
immediately upon its adoption.

RECOMMENDATION
It is respectfully recommended that the City Commission adopt the
attached emergency ordinance to amend Section 38-45 of the City
Code., by creating concession privileges for qualified not-for-
prof~~t organizations that operate regular, ongoing, weekly
programs for youth, elderly and disabled persons in city parks.
The ordinance would authorize the Parks and Recreation Department
director to establish rules, procedures and fees far both special
event and nonprofit concession operations, subject to the annual
review and approval of the City Attorney and City Manager. The
legislation also include housekeeping provisions to repeal
inoperative clauses and to correct the name of the Department.
~ACRGROUND
The Parks and Recreation Department strives to form partnerships
with local nonprofit organizations to enhance and increa:~e
supervised sports and recreational programs in the parks system,
particularly for youth, senior citizens and disabled persons.
Historically, we have made arrangements under which the City
provides the facility and its maintenance at no charge to the
organization. In return, the organization typically provides
supervision and required "consumable" equipment (e.g., tackle
football gear} for the given program. Additionally, the
organization provides the City with proper insurance. For years,
a number of baseball academies have been utilizing specified
parks under this type of arrangement.
We are pleased to report that in the past few years, the Liberty
City Optimist Club has joined our "family" of public-private
partnerships. The Club has been sponsoring a very successful
sports program at Hadley Park which includes such activities as

tackle football, cheer leading, basketball, and baseball.
According to this organization, more than 600 individuals are
being served by this program.
Very recently, two {21 other very promising non-profit
organizations have begun sports programs in two of our parks.
The Boys and Girls Club is sponsoring a tackle football program
at Armbrister Park and the Overtown Community Optimists Club has
initiated a similar program at Williams Park.
Although our facilities are provided free of charge to these
organizations, they still incur significant costs in operating
these programs. Fees are charged by the Clubs to cover
membership and equipment purchases, but many participants have
limited ability to pay all fees. As a result, it is often
difficult for the organization to meet all of its expenses for
insurance, transportation, equipment and the like.
One solution to this dilemma discussed with these groups has been
the possibility of providing them, by -permit, concession
privileges for the sale of food, beverages and program-related
novelties during their practices and games. This privilege would
assist these groups in raising funds to operate their individual
programs held in City parks. The grant of such concession
privileges affords other benefits as well. Several of these are
presented below for your consideration:
1. Enhance and Increase Programs in Parks for Youth, Elderly and
Disabled Persons - The grant of concession permits would
provide funding assistance to nonprofit service organizations
that conduct wholesome, constructive recreational
opportunities for the youth, elderly and disabled persons of
our community. Because of funding constraints, the City
cannot adequately provide a broad range and depth of programs
and activities with its currently available resources.
2. Foster New and Additional Partnerships - The availability of
concession privileges may encourage other organizations to
become involved and operate new programs in city parks.
3. Eliminate Illegal and Uncontrolled Concessions in Parks -
Except for temporary special events, present City Code
regulations do not allow concession vendors in parks unless

under contract, which requires a lengthy competitive bid
process and payment of fair market compensation. However,
many parks are frequented by uncontrolled, and possibly
unlicensed, commercial vendors operating from private
vehicles. These vendors not only violate the law, but are
difficult to police and present a potential danger to park
users due to their movement through• the park and to their
unknown qualifications and compliance with health and
sanitary standards. Under the proposed ordinance,
prospective nonprofit operators will have to be fully
licensed and insured.
4. Improve Park Appearance - Nonprofit groups granted a
concession privilege would be required to clean the general
area they utilize for each day of use. This will relieve
City employees from cleanup duties, allowing them to assume
other tasks. It would also eliminate the problem of debris
..left by unauthorized concession vendors.
5. Bring City -into Line with Curzent Practices of Other Local
Parks Aepartments - Other municipalities and Metropolitan
Dade County already provide concession permits to youth-
serving and community service organizations as a matter of
course.
6. Provide New Revenue to City - The City does not receive any
compensation from unregulated concessionaires. Although we
intend concession permit fees to be nominal and affordable,
such income would represent revenue that we don't currently
receive.
7. Enhance Servjce to Park Users - By allowing the proposed
concession permit arrangement, we will be providing an
additional service to park users, affording them the
opportunity to purchase food and drink while visiting our
recreational facilities.
At the same time, since the adoption of Ordinance No. 1.0123 in
1.986, which initially created temporary concession permits for
special events in parks, the general nature of events and the
administration of the department have changed markedly. Because
of the complexity and variety of these activities, we have
identified the need to modify the controls and fee regulations
for special event concessions as well, suggesting that more

direct control be placed in the hands of the Department so that
it may keep pace with changing needs and demands, within the
prescribed limitations of the City Charter and Code.
For the above reasons, we recommend that the development of day-
to-day rules, regulations, procedures and fees for both nonprofit
and special event concessions be delegated to the authority of
the Parks and Recreation Department director, subject to the
review and approval of the City Attorney and the City Manager, at
least on an annual basis. The farm of all permits shall be
subject to the advance review and approval of the City Attorney.
A preliminary draft of proposed policies,. regulations and fees is
attached for your reference and comment.
This Ordinance is being requested on an emergency basis so that
nonprofit organizations currently operating fall football and
other programs stay have the iam-ediate financial support afforded
by the grant of concession privileges by the City. Additionally,
this will permit immediate control of unauthorized vendors in
parks for security and safety.

ENABLING LEOIS]LATION
The establishment of the concession privilege for nonprofit
groups shall be by ordinance amending the City Code,
specifically, Section 38-45. By said ordinance, the Director of
the Parks and Recreation Department (DIRECTOR) shall be
authorized to issue such permits and to formulate the rules,
regulations, and procedures for said permits and to establish
fees, subject to the review and approval of the City Manager, and
the City Attorney, at least on an annual basis.

The City of Miami Parks and Recreation Department {"Department")
shall- make available limited, non-exclusive concession privileges
to qualified organizations for the purposes of affording said
organizations a means of raising funds to support the programs
and activities that are operated in City parks by those same
organizations for. .youth, seniors and/or disabled persons.
Concession operations which do not conform to the intended
purpose shall not be permitted..

EI.iGIBILITY
To be eligible for a nonprofit concession permit, the
organization shall meet all of the following criteria.
• Organization must be nonprofit and community service-
oriented.
• Organization must operate a regular, ongoing program in a
City park at least one (1) day per week for not less than
three (3) consecutive months, or at least one (1) day per
week throughout and in connection with the Department's
summer program (regularly ten {10) weeks).
• The principal participants and beneficiaries of eligible
programs shall be youth, seniors, and/or disabled persons,
the majority of whom shall be city residents. Youth shall
be defined as persons under 1.7 years of age, and seniors
shall be defined as persons aged 60 years and older.
® Organization shall be sufficiently structured, staffed and
supported to fiscally safeguard the concession operation, as
deemed appropriate by the Parks and Recreation Department.

• Organization must have sufficient membership to staff the
concession as well as the program.
• Organization shall agree that proceeds from the concession
shall be utilized for the program it operates in the city
park. •

• The Director shall formulate, review and/or revise the Day-
tv-day rules, regulations, procedures and fees for nonprofit
concessions at least on an annual basis, and shall submit
same for the review and approval .of the City Attorney and
City Manager.
• Authorization to operate a nonprofit concession shall be in
the form of by permit issued by the Parks and Recreation
Department Director (the "DIRECTOR"). The City, City
j Manager or DIRECTOR may approve or reject any permit
i application with or without cause.
• The form of the nonprofit concession permit shall have the
~ prior approval of the City Attorney.
• Organization shall make application to the Parks and
Recreation Department, supplying all information pertinent
to the concession and the organization's ability to operate
same. Supplied information shall include, without
limitation, the scheduled days of the program, the scheduled
days of the concession, items to be offered for sale and
price lists, size and construction of concession stand, and
names, addresses, and phone numbers of organization members
responsible for the operation•of the concession.
• Permits will be issued on a first come, first serve basis.
• Permits will be limited to a single park per program, unless
otherwise authorized by the Director or designee, as may be
desirable for intrapark games or competitions.
• Organization (PERMITTEE) must obtain, and maintain
throughout the period of the concession permit, all required
licenses, including without limitation, a City of Miami
certificate of use permit and a City occupational license,
and both a Dade County health department license and an
occupational license.
• Organization (PERMITTEE) must obtain, and maintain
throughout the period of the concession permit, liability
.insurance in a form and in amounts acceptable to the City's
risk management division, and may include product liability,
automobile liability. The City shall be named an additional
insured in all policies as required.

• Organization (PERMITTEE) shall indemnify and hold harmless
the city, its agents, officers and employees, from and
against any and all claims whatsoever arising out of the
concession permit.
• Organization (PERMITTEE) shall maintain all records of
purchases, sales and all transactions that arise from the
operation of the concession in a City park. Said records
shall be made available to the City for audit purposes upon
request.
• Organizations (PERMITTEE) shall submit to the department a
monthly financial statement or treasurer's report of the
receipts derived from the operation of the concession and of
expenditures made from such receipts. The Director may
adjust the frequency of such reports at his discretion.
• The maximum .term for any permit shall be one (1) year.
Permits must be re-issued annually for multi-year programs
by the DIRECTOR.
• The City, City Manager or DIRECTOR shall have the right to
.suspend and/or terminate the concession permit at any time.
~ Permits issued hereunder shall not be transferred, assigned
or sublet.
• The DIRECTOR may issue multiple nonprofit concession permits
for the same site, where warranted by the size of the site,
number of facilities and schedule of activities.

• Organization (PERMITTEE) shall be responsible to furnish its
own portable or mobile stand or structure, the size,
construction, and location of which shall be subject to the
approval of the DIRECTOR, or designee.
• PERMTTEE shall utilize [accepts) the designated area of the
park property "as is" and shall make no modifications,
alterations and/or improvements to said area without the
expressed written consent of the DIRECTOR or designee. Any
modifications, alteration and/or improvements so authorized
shall be performed at PERMITTEE'S soi~ cost. PERMITTEE
shall obtain all applicable licenses and permits required
for such modification, alteration and/or improvement.
• The DIRECTOR, or designee, shall have the right and
authority to review and approve all products and pricing
offered at the concession. Items not so approved may be
removed from the site by City personnel. The sale of /~~7

alcoholic beverages is expressly prohibited. The concession
shall offer food and beverages for public consumption as its
primary function. The Directar, however, at his discretion,
may authorize the sale of non-food items at the request of
PERMITTEE, provided that such items are program-related
novelties.
• PERMITTEE shall have and maintain in full view of the public
a posting of all prices and items offered for sale.
PERMITTEE shall have and display all permits and licenses, ,
including the nonprofit concession permit, at all times
during the operation of the concession.
• Organization (PERMITTEE) shall operate the concession only
during the designated times and days irid:icated on the
permit, and~only when such operation is not iri conflict with
other scheduled park activities. This shall generally
conform to the. times and days of PERMITTEE'S scheduled youth
activities, games, andJor practices.
• PERMITTEE shall dispense all food and beverages in soft
(paper or plastic) containers and wrappers. Canned beverages
shall be allowed at the Director's discretion. Dispensing
in glass containers is expressly prohibited.
• PERMITTEE shall be required to clean and .remove trash from
all areas affected by the concession, and shall provide its
own disposable trash receptacles. Collected rubbish and
bagged trash shall be placed in designated City dumpsters.
• City shall provide utility services to concessions only as
may be reasonably consumed and readily available as
determined by the Director or designee. PERMITTEE shall
provide at its own expense such professional traffic and
security control pErsonnel as may be required by the
DIRECTOR, or designee.
PROPfpSED PERMIT ]FEES (FIRST YEAR)
• The following fees are hereby established for nonprofit
.concessions. All fees shall apply on a per site basis, unless
otherwise provided herein.:
• Daily Fee - $15 per concession operating day
• Monthly Fee - $40 per month
• Yearly Fee - $300 per year
