ORDINANCE NO.
AN ORDINANCE AMENDING ORDINANCE NO. 11130
WHICH ESTABLISHED THE STANDARDS FOR CREATION
AND REVIEW OF BOARDS BY: (1) PROVIDING THAT
SAID STANDARDS, AS CONTAINED IN ARTICLE XIII
OF CHAPTER 2 OF THE CODE OF THE CITY OF
MIAMI, FLORIDA, AS AMENDED, SHALL NOT APPLY
TO CITY BOARDS WHEN THERE IS A CHARTER
PROVISION TO THE CONTRARY; (2) PROVIDING THAT
THOSE PERSONS OWNING REAL PROPERTY IN THE
CITY OF MIAMI ARE ELIGIBLE FOR MEMBERSHIP ON
CITY BOARDS; (3) PROVIDING FOR A PROCEDURE
FOR THE REMOVAL OF BOARD MEMBERS WHO HAVE
CEASED TO COMPLY WITH THE ELIGIBILITY
REQUIREMENTS FOR MEMBERSHIP OF CITY BOARDS;
(4) PROVIDING THAT THE CITY CLERK SHALL
INFORM THE CITY COMMISSION WHENEVER A BOARD
MEMBER HAS RESIGNED FROM A BOARD; AND (5)
PROVIDING THAT THE REQUIREMENT THAT EACH NET
ADMINISTRATOR SHALL BE A LIAISON TO BOARDS
WHICH OPERATE WITHIN ITS GEOGRAPHICAL AREA OF
RESPONSIBILITY DOES NOT PRECLUDE THE
APPOINTMENT AS LIAISON OF ANY OTHER PERSON
WHICH THE CITY COMMISSION OR THE CITY
ADMINISTRATION MAY WISH TO APPOINT TO SERVE
IN SAID CAPACITY; MORE PARTICULARLY, BY
AMENDING SECTIONS 2-425, 2-428, 2-433 AND 2-
435 OF THE CITY CODE; CONTAINING A REPEALER
PROVISION AND SEVERABILITY CLAUSE AND
PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, pursuant to Ordinance No. 11130, adopted March 24,
1994, the City Commission established the standards for the
creation and review of boards in the City of Miami; and
WHEREAS, the City Commission wishes to amend Ordinance No.
11130 to clarify those standards contained in Ordinance No. 11130
which have been found to be in need of clarification.

NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the
Preamble to this Ordinance are hereby adopted by reference
thereto and incorporated herein as if fully set forth in this
section.
Section 2. Section 2-425 of the Code of the City of
Miami, Florida, as amended, is hereby amended in the following
particulars:V
"Sec. 2--425. All of the requirements contained in this
Article shaL1. apply to all Boards of the City of Miami unless
there is any statutory = City Charter provision to the contrary.

2. Off -Street Park= Board of the City of Miami.

4. Plan= Advisory Board.
5. Zoning Board"
Section 3. Section 2-428 of the Code of the City of Miami,
Florida, as amended, is hereby amended in the following
particulars:l/
"Sec. 2-428. Membership on Boards.
All members of city boards shall either be permanent
residents of the City of Miami, own real prQ=ty in the City of
Mom, or work or maintain a business in the City of Miami, and
sha11have good reputations for integrity and com mnity service.
( In addition, all boards members should have demonstrated an

The primaxy consideration in appointing board members shall
be to provide the board with the needed tecluitoal, professional.,
financial, business or administrative expertise. The membership
of each board should be representative of the community at -large
and should reflect the racial, ethnic and cultural make-up of the
community.
No member of any City board shall become a candidate for
elective pol itical. office during his or her term. Should any
member of a City board qualify as a candidate for elective
political office, such qualification shall be deemed a tender of
resignation from such board.°
Section 4. Section 2-433 of the Code of the City of
Miami, Florida, as amended, is hereby amended in the following
particulars:I/
"Sec. 2-433. City Clerk to Keep Records of Boards.
The City Clerk or his/her designee shall serve as liaison
between the City Commission and all City boards. He/she shall
prepare a standard form to be used by all boards to report their
members' atce to their meetings. All City boards shall
submit copies of the Minutes of their meetings and records of
their members' attendance to said meetings to the City Clerk
within five (5) days after each meeting. The City Clerk small
inform the City Commission whenever a board member has res,igd
from a board or has exceeded the number of permissible absences
and said board member will be automatically removed from the
boaz+d. The City Clerk shall then inform the City Commission in

writing that the position has been deolwed vacant and a successor
member must be promptly appointed to fill the vacancy."
Section S. Section 2-435 of the Code of the City of
Miami, Florida, as amended, is hereby amended in the following
particulars:/
"Section 2-435. NET Administrator as Liaison to Hoards.
Each NET (Neighborhood Enhancement Team) Administrator of
the City shall be th-e a City Administration's liaison to boards
which operate within itts his/her geographical area of
responsibility. This provision does not preclude the appointment
as liaison of any other person which the City Commission or the
City_ Administration may wish to appoint to serve in said
oapao_ i ttv . "
Section 6. All ordinances or parts of ordinances insofar
as they are inconsistent or in conflict with the provisions of
this Ordinance are hereby repealed.
Section 7. If any section, part of section, paragraph,
clause, phrase, or word of this Ordinance is declared invalid,
the remaining provisions of this Ordinance shall not be affected.
Section 8. This Ordinance shall become effective thirty
(30) days after final reading and adoption thereof.

ENCLOSURES:
It is respectfully recommended that the City Commission
adopt the attached ordinance amending Ordinance No. 11130, which
established the standards for creation and review of boards as
follows:
1. To provide that the standards for creation and review
of boards do not apply when there is a City Charter provision to
the contrary; and
2. To provide that those persons owning real property in
the City of Miami are eligible for membership on City boards; and
3. To provide for a procedure for the removal of board
members who have ceased to comply with the eligibility
requirements for board membership; and
4. To provide that the City Clerk shall inform the City
Commission whenever a board member has resigned from a board; and
5. To provide that the requirement that each NET
administrator shall be a liaison to boards which operate within
his/her geographical area of responsibility does not preclude the
appointment of any other person which the City Commission or the
City Administration may wish to appoint to serve in said
capacity.
