HomeMy WebLinkAboutO-11185ORDINANCE N0. 11185 AN EMERGENCY ORDINANCE AMENDING SECTIONS 1, 3, 4, 5 AND 6 OF ORDINANCE NO. 11090, THE ANNUAL APPROPRIATIONS ORDINANCE, ADOPTED SEPTEMBER 27, 1993 FOR FISCAL YEAR ENDING SEPTEMBER 30, 1994, FOR THE PURPOSE OF INCREASING SAID APPROPRIATIONS RELATING TO OPERATIONAL REQUIREMENTS AND OTHER BUDGETARY ADJUSTMENTS REQUIRED FOR THE FY'94 BUDGET AS MORE PARTICULARLY DESCRIBED HEREIN• CONTAINING A REPEALER PROVISION AND SEVERABILITY CLAUSE. WHEREAS, the City Commission adopted Ordinance No. 11090, the Annual Appropriations Ordinance, on September 27, 1993, establishing revenues and appropriations for the City of Miami, Florida, for Fiscal Year ending September 30, 1994; and WHEREAS, it is anticipated that the Police Department will incur an estimated $1,525,000 in additional expenditures during FY194 for continued Police Civilianization and overtime related to neighborhood drug enforcement initiatives and repairs to donated helicopters; and WHEREAS, the Fire - Rescue Department will incur an estimated $2,715,000 in additional expenditures during FY194 for additional overtime costs resulting from minimum manning requirements; and WHEREAS, the Parks and Recreation Department will incur an estimated $220,000 during FY194 in additional expenditures for hiring temporary employees for the City's Summer Program; and 11185 WHEREAS, Special Programs and Accounts must contribute $616,000 to Pension and $488,000 to the Internal Service Fund to balance their FY194 budgets; and WHEREAS, additional funds in the amount of $3,807,000 are need to be appropriated to the Special Programs and Accounts to meet expendtiure requirements; and WHEREAS, the Conferences and Conventions Department will receive additional operating revenue of $151,032 during FY194 from the Parking Garage and appropriate same to the Off -Street Parking authority's operating budget; and WHEREAS, the City of Miami was supposed to contract with a private company to -operate the Dinner Key Boat Yard during FY'94, however, the City has decided to operate said facility, estimated revenues and expenditures for FY194 are $163,465; and WHEREAS, Tourist Bed Tax revenue received from Dade County has increased by $237,000; and WHEREAS, the General Services Administration Department, Heavy Equipment Maintenance Division, Motor Pool Maintenance Division, Property Maintenance Division and purchasing Division will incur an estimated $488,000 in additional expenditures during FY194 as a result of higher repair and maintenance costs for the City Fleet, additional maintenance costs for City owned buildings and higher bidding costs; and WHEREAS, the City Commission passed Resolution No. 94-92 on February 17, 1994, authorizing the City Manager to request a loan from the Sunshine State Governmental Financing 2 11185 Commission, in an amount not to exceed $15,000,000, to finance equipment acquisition; and WHEREAS, a sum of $4,200,000 was allocated to purchase police cars and related equipment and $4,500,000 was allocated to purchase heavy equipment; and WHEREAS, the City of Miami has received an additional $1, 718, 000 in pension receipts from the State of Florida for Police and Fire Personnel pursuant to Chapters 175 and 185 of the Florida Statutes; and WHEREAS, the General Fund has not been fully reimbursed in the amount of $6,500,000 for the costs incurred for the operations and maintenance of the Storm Water Utility function; and WHEREAS, said transfer shall take precedent over previous appropriations of Storm Water Utility revenue budgeted in the Capital Improvement Fund; and WHEREAS, insurance reimbursement in the amount of $1,752,100 related to Hurricane Andrew shall be deposited into the General Fund pending final disposition of same; and WHEREAS, $1,500,000 is available from additional Public Service taxes; and i WHEREAS, the City Manager is also authorized to transfer any excess unrestricted monies from other funds to the General i Fund; NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA; Section 1. The recitals and findings contained in the ` Preamble to this Ordinance are hereby adopted by reference ' 3 �i185 F - thereto and incorporated herein as if fully set forth in this section. Section 2. Sections 1, 3, 4, 5 and 6 of Ordinance No. 11090, adopted September 27, 1993, the Annual Appropriations Ordinance, for the Fiscal Year ending September 30, 1994, is hereby amended in the following particulars: "Section 1. All ordinances or parts of ordinances insofar as they are in conflict with provisions of this Ordinance are hereby repealed. Section 4. If any section, part of sections, paragraph, clause, phrase or word of this Ordinance is declared invalid, the remaining provision of this Ordinance shall not be affected. Section 5. This Ordinance is hereby declared to be an emergency measure on the grounds of urgent public need for the preservation of peace, health, safety, and property of the City of Miami and upon the further grounds of the necessity to make the required and necessary purchases and payments, and to generally carry out the functions and duties of municipal affairs. Section 6. The requirements of reading this Ordinance on two separate days is hereby dispensed with by a vote of not less than four -fifths of the members of the Commission. Section 7. Background: The Department of Management and Budget and the Finance Department have identified the need to make certain budgetary adjustments to the FY194 Annual Appropriations Ordinance, for the purpose of increasing said appropriations relating to operational requirements.
