AN EMMM CY ORDINANCE, ESTABLISHING INITIAL RESOURCES AND INITIAL APPROPRIATIONS FOR A SPECIAL REVENUE FUND ENTITLED "STREET GANGS TASK FORCE", AND AUTHORIZING THE CITY MANACMR TO ACCEPT A GRANT IN THE AMOUNT OF $12,359 FOR THE PURPOSE SPECIFIED HEREIN; FURTHER AUTHORIZING THE CITY MANAGER TO ENTER INTO THE NECESSARY AGREEMENTS, IN A FORM ACCEPTABLE TO THE CITY ATTORNEY, FOR THE ACCEPTANCE OF THE AFORIIMENTIONED GRANT; CONTAINING A REPEALER PROVISION AND A SEVERABILITY CLAUSE. WHEREAS, the City of Miami Police Department continues to investigate street gangs; and WHEREAS, there is a need to target specific gangs which have terrorized the South Florida area; and WHEREAS, the State of Florida has approved the award of $12,359 toward the payment of overtime, with no matching funds from the City of Miami to accomplish these investigations; and NOW, TARE, BE IT ORDAINED BY THE COdMSSION OF THE CITY OF MIAMII, Section 1. The recitals and findings contained in the Preamble to this Ordinance are hereby adopted by reference thereto and incorporated herein as if fully set forth in this Section. Section 2. The following Special Revenue Fund is hereby established and resources are hereby appropriated as described herein: 11176 FUND TITLE: STREET GANGS TASK FORCE RESOURCES: State of Florida $12,359 APPROPRIATIONS: Personnel Overtime $12,359 Section 3. The City Manager is hereby authorized to accept the grant as set forth in the Preamble to this Ordinance and to enter into the necessary agreement(s), in a form acceptable to the City Attorney,!/ for the acceptance of the aforesaid monies for the above -described purpose. Section 4. All ordinances or parts of ordinances insofar as they are inconsistent or in conflict with the provisions of this Ordinance are hereby repealed. Section 5. If any section, part of section, paragraph, clause, phrase, or word of this Ordinance is declared invalid, the remaining provisions of this Ordinance shall not be affected. Section 6. This Ordinance is hereby declared to be an emergency measure on the grounds of urgent public need for the preservation of peace, health, safety, and property of the City of Miami, and upon the further grounds of the necessity of the City of Miami to make the required and necessary payments to its employees and officers, payment of its debts, necessary and required purchases of goods and supplies, and to generally carry on the functions and duties of municipal affairs. Section 7. The requirement of reading this Ordinance on two separate days is hereby dispensed with by an affirmative vote of not less than four - fifths of the members of the Ccamission. 1� The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter and Code provisions. 111'76 -2- Section 8. BACKGROUND: The Miami Police Department, in conjunction with the Florida DPp» rtment of Law Enforcement, the Miami Beach Police Department, and the Dade County State Attorney's Office, has formed a Task Force targeting one specific gang for investigation. This gang has 14 core members and has terrorized South Florida for three years. The anticipated result from the efforts of this Task Force is the elimination of this one criminal organization. The monies being accepted will be utilized to pay officers, on an overtime basis, assigned to the Task Force. No matching funds are required by the City. This Ordinance is being requested on an emergency basis on the grounds of urgent public need for the preservation of peace, health, safety, and property of the City of Miami, by continuing an ongoing investigation and curtailing organized gang activity in the Miami area. 111'76 MIAMI DAILY BUSINESS REVIEW Published Deily except Saturday, Sunday and Legal Holidays Miami, Dade County, Florida.
