AN ORDINANCE ESTABLISHING A NEW SPECIAL REVENUE FUND ENTITLED: "FEDERAL HOME INVESTMENT PARTNERSHIP GRANT PROGRAM (THIRD YEAR)", AND APPROPRIATING $3,757,000 FOR EXECUTION OF SAME AS APPROVED BY THE DEPARTMENT OF HOUSING AND URBAN DEVELOPMENT (HUD) FOR IMPLEMENTATION OF THE HOME INVESTMENT PARTNERSHIP PROGRAM; CONTAINING A REPEALER PROVISION AND A SEVERABILITY CLAUSE. WHEREAS, in November, 1990, the Cranston -Gonzalez National Affordable Housing (NAHA) Act was signed into law; and WHEREAS, the centerpiece of the Cranston -Gonzalez Act is the Home Investment Partnership Program (HOME Program), which represents the most significant and far-reaching piece of federal housing legislation to come out of Washington in over ten (10) years; and WHEREAS, for fiscal year 1994-1995, Congress approved $1.275 billion for the HOME Program which will be distributed by formula to participating states and units of local government to enable such entities to design affordable housing strategies tailored to the needs of their local markets; and WHEREAS, the Department of Housing and Urban Development has awarded to the City of Miami a grant of $3,757,000 entitled "Federal Home Investment Partnership Grant Program (Third Year)", to provide housing activities for the period commencing July 1, 1994, and ending June 30, 1995; and WHEREAS, the herein Ordinance is a proper vehicle to appropriate the aforesaid grant; -1- I _t6 4 NOW THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble of this Ordinance are hereby adopted by reference thereto and incorporated herein as if fully set forth in this Section. Section 2. The following Special Revenue Fund is hereby established and resources are hereby appropriated as described herein: FUND TITLE: Federal Home Investment Partnership Grant Program (Third Year RESOURCES: Federal Grant -,U.S. Department of Housing and Urban Development S3,757,000 APPROPRIATION: Federal Home Investment Partner- ship Grant Program (Third Year) TOTAL: $3,757,000 Section 3. The herein total appropriation of $3,757,000 for housing activities refers to those publicly supported housing activities being carried out within a reasonable period of time in accordance with the approved Grant Program Application. Section 4. All ordinances or parts of ordinances insofar as they are in conflict with the provisions of this Ordinance are hereby repealed. Section 5. If any section, part of section, paragraph, clause, phrase, or word of this Ordinance is declared invalid, the remaining provisions of this Ordinance shall not be affected. Section 6. I YOE The Department of Development and Housing Conservation recommends ratification of the attached appropriation ordinance. The ordinance identifies and appropriates Home Investment Partnership Grant Program funds in the amount of $3,757,000 for implementation of the HOME Program in the City of Miami. In November of 1990, the Cranston -Gonzalez National Affordable Housing Act was signed into law. Approximately $1.275 billion has been appropriated nationwide for fiscal year 1994-95. The centerpiece of the Cranston -Gonzalez National Affordable Housing Act is the Home Investment Partnership Program (HOME Program). The HOME Program is a federal housing block grant which affords states and local governments the flexibility to fund a wide range of low-income housing activities through a creative and unique housing partnerships among states and localities, the private housing industry, and not -for -profit community based organizations. In February of 1992, the City of Miami was designated as a participating jurisdiction (Pi) and is eligible to receive $3,757,000 in Home Investment Partnership Program funding in connection with the implementation of the HOME Program in the City. 11164 e,�_/ Honorable Mayor and Members of the City Commission Page 2 In April of 1994, the City of Miami was officially notified that its HOME Program Description guidelines were conditionally approved by U.S. HUD and that funding in the amount of $3,757,000 is available, subject to the execution of the Funding Approval and Home Investment Partnership Agreement between both parties.
