HomeMy WebLinkAboutO-11156J-94-415 5/24/94 ORDINANCE NO. 11156 AN EMERGENCY ORDINANCE, ESTABLISHING INITIAL RESOURCES AND INITIAL APPROPRIATIONS FOR A SPECIAL REVENUE FUND ENTITLED "HIDTA HOOKEM," ACCEPTING A GRANT IN THE ANIXUNI' OF $50,787 FROM THE U.S. DEPARTHRU OF JUSTICE, OFFICE OF JUSTICE PROGRAMS, AND AUTHORIZING THE CITY MANAGER TO EXECUTE ANY AND ALL DOCUMENTS NECESSARY TO ACCEPT SAID GRANT; CONTAINING A REPEALER PROVISION AND A SEVERABILITY CLAUSE. WHEREAS, the City of Miami Police Department continues to investigate narcotics trafficking, and money laundering; and WHEREAS, there is a need to target specific geographical areas; and WHEREAS, the Department of Justice, Office of Justice Programs, has approved the award of $50,787 toward the payment of overtime, and purchase of equipment, with no matching funds from the City of Miami to accomplish these investigations; and WHEREAS, any purchases would have to ccenply with applicable city code purchasing requirements; NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Ordinance are hereby adopted by reference thereto and incorporated herein as if fully set forth in this Section. 11156 Section 2. The following Special Revenue Fund is hereby established and resources are hereby appropriated as described herein: FUND TITLE: HIDTA HOOIEM RESOURCES: U.S. Department of Justice $50,787 APPROPRIATIONS: Personnel Overtime $37,708 Office Equipment $13,079 Section 3. The City Manager is hereby authorized to accept the grant as set forth in the Preamble to this Ordinance and to enter into the necessary contract(s) and/or agreement(s), in a fonn acceptable to the City Attorney,l/ for the acceptance of the aforesaid monies for the compensation of personnel, and other related costs. Section 4. All ordinances or parts of ordinances insofar as they are inconsistent or in conflict with the provisions of this Ordinance are hereby repealed. Section 5. If any section, part of section, paragraph, clause, phrase, or word of this Ordinance is declared invalid, the remaining provisions of this Ordinance shall not be affected. Section 6. This Ordinance is hereby declared to be an emergency measure on the grounds of urgent public need for the preservation of peace, health, safety, and property of the City of Miami, and upon the further grounds of the necessity of the City of Miami to make the required and necessary payments to its employees and officers, payment of its debts, necessary and required purchases of goods and supplies, and to carry on the functions and duties of municipal affairs. l/ The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter and Code provisions. -2- 11156 Section 7. The requirement of reading this Ordinance on two separate days is hereby dispensed with by an affirmative vote of not less than four - fifths of the members of the Commission. Section 8. MAY 3 I 1994 FILE SUBJECT: Ordinance Establishing a Special Revenue Fund REFERENCES: ENCLOSURES: It is respectfully recommended that an Ordinance establishing a Special Revenue Fund entitled: "HIDTr Hookem," accepting a grant from the U.S. Department of Justice, office of Justice Programs, in the amount of $50,787 and appropriating funds for the operat._.,n of same, be adopted. BACKGROUND: The Miami Police Department is continuing its efforts at combatting narcotics trafficking and money laundering, and has received assistance in this endeavor from the federal gc rnment, through High Intensity Drug Trafficking Area Grants. These grants provide an additional incentive for the City of Miami Police Department to target organizations involved in narcotics trafficking based on geographic location. This specific grant is being administered by the U.S. At°-orney's Office, in conjunction with the Special Investigations Section of the Miami Police Department. Additional organizations that impact up n the City of Miami are being identified as the investigation continues. No matching funds are required by the City.
