AN ORDINANCE, AMENDING SECTION 1 OF ORDINANCE NO. 11139, ADOPTED APRIL 14, 1994, THE CAPITAL IMPROVEMENTS APPROPRIATIONS ORDINANCE BY INCREASING THE TOTAL APPROPRIATIONS FOR CAPITAL PROJECT ENTITLED "SAINT HUGH OAKS VILLAGE HOUSING PROJECT" PROJECT NO. 321040, FROM $2,258,000 TO $2,374,000; APPROPRIATING FUNDS THEREFOR IN THE AMOUNT OF $116,000 BUILDING SALES TO COVER THE COST OVERRUN INCURRED IN THE DEVELOPMENT OF TWENTY-THREE (23) NEW SINGLE FAMILY HOMES ON THE CITY - OWNED ST. HUGH OAKS PARCEL LOCATED IN THE COCONUT GROVE NEIGHBORHOOD; CONTAINING A REPEALER PROVISION AND SEVERABILITY CLAUSE. WHEREAS, there exists in the City of Miami a severe shortage of housing within the affordability range of families and individuals of low and moderate income; and WHEREAS, in an effort to expand the availability and affordability of housing for moderate income families and individuals in the City of Miami, in September, 1986, the City Commission authorized the acquisition of a three (3) acre parcel of land located in the Coconut Grove neighborhood known as the St. Hugh Oaks Academy property; and WHEREAS, the City of Miami, serving as developer, is presently developing a twenty-three (23) unit single family residential sales housing development on the said parcel; and 11145 -1- WHEREAS, the estimated bid cost of constructing the twenty- three (23) single family homes planned on the St. Hugh Oaks parcel is $2,258,000; and WHEREAS, funding from Special Obligation Bonds - Series 1986A in the amount of $1,554,000 and from proceeds from the sale of affordable housing units in the amount of $704,000 was made available to develop the project; and WHEREAS, the St. Hugh Oaks Village Housing Project has experienced cost overruns due to the delay in the commencement of construction due the Dade County imposed water/sewer moratorium, in addition to the escalating cost of construction due to Hurricane Andrew; and WHEREAS, funding is available from the proceeds from the sale of affordable housing units in the amount of $116,000 to cover the cost overrun experienced by the City in connection with the St. Hugh Oaks Village Housing Project; NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Ordinance are hereby adopted by reference thereto and incorporated herein as if fully set forth in this Section. 11145 W.� Section 2. Section 1 of Ordinance No. 11139, the Capital Improvement Appropriation Ordinance adopted April 14, 1994, as amended, is hereby amended in the following particulars: 1 "Section 1. The herein appropriations are hereby made for implementation of all municipal capital improvements of the City of Miami, including new capital improvement projects scheduled to begin during fiscal year 1993-94. The herein appropriations which are hereby designated by reference to descriptive project title and number also include appropriations for previously approved scheduled projects as well as reappropriations of prior fund appropriations. The source of revenues to support the herein appropriations is hereby identified by fund and project with the project appropriations with revenues therefor being set forth for seven program (I-VII) areas based upon use or functional category within said areas, as follows: Total Appropriations ($ x 000) * * * * * * * * * * III. All ordinances or parts of ordinances insofar as they are inconsistent or in conflict with the provisions of this Ordinance are hereby repealed. Section 4. If any section, part of section, paragraph, clause, phrase or word of this Ordinance is declared invalid, the remaining provisions of this Ordinance shall not be affected. Section 5. Condominium Project Cit #er City Commission Agenda ENCLOSURES Item - May 5, 1994 RECOMMENDATION• It is respectfully recommended that the City Commission adopt the attached Ordinance, amending Section 1 of Ordinance No. 11139, the Capital Improvement Appropriations Ordinance, adopted April 14, 1994, by increasing the total appropriations for Capital Improvement Program Project No. 321040, entitled "Saint Hugh Oaks Village Housing Project", from $2,258,000 to $2,374,000 to cover the cost overrun incurred in the development of twenty-three (23) new single family homes on the City -owned St. Hugh Oaks parcel in the Coconut Grove neighborhood. In November of 1988, through Resolution No. 88-1042, the City Commission approved the Administration's proposal which called for the development of a thirty (30) unit single family residential sales housing development on the city -owned St. Hugh Oaks property located in the Coconut Grove neighborhood. Subsequently, in May of 1991, through Resolution No. 91-403, the City Commission reduced the number of housing units which were being proposed from thirty (30) to twenty-three (23) homes. In July of 1992, the Department of Public Works solicited bid proposals from general contracting firms in connection with the development of the twenty-three (23) new single family homes planned on the St. Hugh Oaks parcel. On September 221 1992, bid proposals were received by the City with the lowest bid received from Associates Construction, Corporation in the amount of $2,258,000. After the execution of the contract between the City and Associates Construction, Corporation dated December 12, 1992, the commencement of construction on the St. Hugh Oaks -millafie: Condominium project was held up for approximately se,%Sin �w 1 - f 11145 Honorable Mayor and Members of the City Commission Page 2 months due to the water/sewer moratorium which was imposed on all new construction projects by Metropolitan Dade County back in February of 1993. Moreover, the project has experienced increases in the cost of construction materials and updated South Florida Building Code requirements as a result of Hurricane Andrew, as well as new requirements imposed by Dade County's Department of Water and Sewer for new construction type projects. The Department of Development and Housing Conservation recommends ratification of the attached emergency ordinance, amending Section 1, Ordinance No. 11139, the Capital Improvement Appropriations Ordinance, adopted April 14, 1994, by increasing the total appropriation for Capital Improvement Program Project No. 321040, entitled "Saint Hugh Oaks Village Housing Project", from $2,258,000 to $2,374,000, for the purpose of covering the projected cost increases which have been experienced by Associations Construction, Corporation in connection with the St. Hugh Oaks Village Condominium Project. d 11145 MIAMI DAILY BUSINESS REVIEW Published Daily except Saturday, Sunday and Legal Holidays Miami, Dade County, Florida.
