Home My WebLink AboutO-11144J-94-179 3/14/94 ORDINANCE NO. 11144 AN ORDINANCE AMENDING SECTIONS 54-8 AND 54-9 OF THE CODE OF THE CITY OF MIAMI, FLORIDA, AS AMENDED, THEREBY PROHIBITING THE DISPLAY OF GARAGE SALE OR SIMILAR SIGNS ON THE PUBLIC RIGHT-OF-WAY; CONTAINING A REPEALER PROVISION AND A SEVERABILITY CLAUSE; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the Miami Planning Advisory Board, at its meeting of February 16, 1994, Item No. 6, following an advertised hearing adopted Resolution No. PAB 13-94 by a vote of eight to zero (8-0), RECOMMENDING APPROVAL WITH CONDITIONS of amending the City Code of the City of Miami as hereinafter set forth; and WHEREAS, the City Commission after careful consideration of this matter deems it advisable and in the best interest of the general welfare of the City of Miami and its inhabitants to amend the City Code of the City of Miami as hereinafter set forth: NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. Sections 54-8 and 54-9 of the Code of the City of Miami, Florida, as amended, are hereby amended in the following particulars:/ 1/ Words and/or figures stricken through shall be deleted. Underscored words and/or figures shall be added. The remaining provisions are now in effect and remain unchanged. Ellipsis and asterisks indicate omitted and unchanged material. 11144 "Sec. 54-8. Using street or sidewalk for advertising or display purposes, exceptions; permit and fee. (a) It shall be unlawful to use any portion of a street. any-Dartion-off -the -Dub' ic_ xidht-of-way. or sidewalk in the city for advertising or display purposes, with the following exceptions if approved by the city commission: (1) For events or activities sponsored by charitable organizations. (2) For events or activities sponsored by the city. (b) Advertisements or displays covered by (1) and (2) as described above will require a permit from the department of public works prior to installation. The application for permit shall be in the form of a written request by the applicant to the director of public works. A processing fee in the amount of eighty dollars ($80.00) per advertisement, display, banner, sign, etc., shall accompany the written request. Fifty (50) percent of the processing fee will be returned to the applicant if the application is denied by public works." "Sec. 54-9. Placing signs on any portion of the public right-of-way, street or sidewalk surface. It shall be unlawful to stencil, write, paint, erect or place advertising signs or notes upon any portion of the public right-of-wav or the surface of any street or sidewalk, except signs or decorations placed by the city." Section 2. All ordinances or parts of ordinances insofar as they are inconsistent or in conflict with the provisions of this Ordinance are hereby repealed. Section 3. If any section, part of section, paragraph, clause, phrase or word of this Ordinance is declared invalid, the remaining provisions of this Ordinance shall not be affected. Section 4.
