AN ORDINANCE AMENDING THE FUTURE LAND USE MAP OF ORDINANCE NO. 10544, AS AMENDED, THE MIAMI COMPREHENSIVE NEIGHBORHOOD PLAN 1989-2000, FOR THE PROPERTY LOCATED AT APPROXIMATELY 401, 411 AND 455 SOUTHWEST 27TH AVENUE, MIAMI, FLORIDA (MORE PARTICULARLY DESCRIBED HEREIN), BY CHANGING THE LAND USE DESIGNATION FROM MAJOR PUBLIC FACILITIES, TRANSPORTATION AND UTILITIES TO OFFICE; MAKING FINDINGS; INSTRUCTING THE TRANSMITTAL OF A COPY OF THIS ORDINANCE TO AFFECTED AGENCIES; CONTAINING A REPEALER PROVISION, A SEVERABILITY CLAUSE, AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the Planning Advisory Board, at its meeting of February 16, 1994, Item No. 2, following an advertised hearing, adopted Resolution No. PAB 8-94, by a vote of nine to zero (9-0), RECOMMENDING APPROVAL of an amendment to the Future Land Use Map of Ordinance No. 10544, as amended, the Miami Comprehensive Neighborhood Plan 1989-2000, as hereinafter set forth; and WHEREAS, the City Commission, after careful consideration of this matter, deems it advisable and in the best interest of the general welfare of the City of Miami and its inhabitants to grant this Comprehensive Plan change as hereinafter set forth; NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: 11140 Section 1. The Future Land Use Map of Ordinance No. 10544, as amended, the Miami Comprehensive Neighborhood Plan 1989-2000, is hereby amended by changing the land use designation at approximately 401, 411 and 455 Southwest 27th Avenue, Miami, Florida, more particularly described as Lots 21-24, BEACOM MANOR, as recorded in Plat Book 8 at Page 121, of the Public Records of Dade County, Florida, from MAJOR PUBLIC FACILITIES, TRANSPORTATION AND UTILITIES to OFFICE. Section 2. It is hereby found that this Comprehensive Plan designation change: (a) is necessary due to changed or changing conditions; (b) involves a residential land use of 5 acres or less and a density of 5 units per acre or less or involves other land use categories, singularly or in combination with residential use, of 3 acres or less and does not, in combination with other changes during the last year, produce a cumulative effect of having changed more than 30 acres; (c) is one which involves property that has not been the specific subject of a Comprehensive Plan change within the last year; and (d) is one which does not involve the same owner's property within 200 feet of property that has been the subject of a Comprehensive Plan change within the last year. Section 3. The City Manager is hereby directed to instruct the Director of Planning, Building and Zoning to transmit a copy of this Ordinance immediately upon approval of second reading to -2- 11140 Linda Shelley, Secretary, Florida Department of Community Affairs, Tallahassee, Florida, for ninety (90) day review and comment. Section 4. All ordinances or parts of ordinances insofar as they are inconsistent or in conflict with the provisions of this Ordinance are hereby repealed. Section 5. If any section, part of section, paragraph, clause, phrase, or word of this Ordinance is declared invalid, the remaining provisions of this Ordinance shall not be affected. Section 6. PETITION Consideration of amending Ordinance 10544, as amended, the Miami Comprehensive Neighborhood Plan 1989-2000, Future Land Use Map, by changing the land use designation of approximately 401, 411 and 455 SW 27th Avenue from Major Public Facilities, Transportation and Utilities to Office. PLANNING Approval. RECOMMENDATION BACKGROUND AND During the 1989-90 updates of the City's Official Zoning Atlas and Comprehensive ANALYSIS Land Use Plan Map, there was an inadvertent ommission which resulted in an inconsistency between the zoning designations and land use classifications for those properties located on the east side of S.W. 27th Avenue from approximately S.W. 2nd Street to S.W. 7th Street. This application is one of several companion items being requested to correct the error. This specific application is requesting a land use plan amendment required to reconcile several lots which have inconsistencies between zoning and land use designations. The proposed change in this application is consistent with the actual uses on the subject properties and along with the accompanying zoning atlas amendment, will bring the properties into conformance. APPLICATION NUMBER 93-105 11140 04/11/94 Page 1 CASE # 94-105 P A B - ITEM #2 February 16, 1994 ANALYSIS OF PROPOSED COMPREHENSIVE PLAN AMENDMENT N0.94-1 Lots 21-24, located at approximately 401, 411 and 455 SW 27th Avenue. DISCUSSION Despite the care taken during the 1989-90 updates of the .City's official Zoning Atlas and Future Land Use Plan Map of the Miami Comprehensive Neighborhood Plan-1989-2000, there were scrivener's errors which resulted in inconsistencies between the zoning designation and the Future Land Use Plan Map classification for those properties located on the east side of SW 27th Avenue from SW 2nd to 7th Streets. This application is one of the companion items being requested to correct these errors. The subject properties is a 0.57 acre parcel consisting of four lots fronting SW 27th Avenue between SW 4th and 5th Streets, at approximately 401, 411 and 455 SW 27th Avenue, in the Pequena Habana Planning District4 MCNP Land Use Policy 1.6.1., establishes future land use categories according to the Future Land Use Plan Map and the "Interpretation of the Future Land Use Plan Map". The location is currently designated Major Public Facilities, Transportation and Utilities. The blocks to the south are similarly designated; to the east, there is a Single Family Residential designated area and, to the north and west, an Office land use designated area. The Major Public Facilities, Transportation and Utilities land use category permits major concentrations of national,state and local government activities, as well as major public health or educational facilities. 3 1 IAP 02/16/94 Item #2 Page 1 of 2 Governmental, health, religious and educational activities may occur within this land use designation. Public and private cemeteries are also provided for in this land use category. The Office category allow residential uses to a maximum density equivalent to "High Density Multifamily Residential" (150 dwelling units per acre) subject to the same limiting conditions; transitory residential facilities such as hotels and motels; general office use; clinics and laboratories; and limited commercial activities incidental to principal activities in designated areas. Supporting facilities such as auditoriums, libraries, convention facilities, places of worship, and primary and secondary schools may be allowed with the "Office" designation. MCNP Land Use Goal 1, requires the City to promote the efficient use of land use and minimize land use conflicts. The change also, would be consistent with Policy 1.1.3. which requires that all areas of the City be protected from encroachment of incompatible land uses. Housing Policies 1.1.5. and 1.2.7. require the City to preserve and enhance the general appearance and character of the City neighborhoods. Together these goals and policies argue that the existing land use pattern in this area should be changed. In addition, Land Use Policy 1.1.1. requires development or redevelopment, that results in an increase in density or intensity of land use, to be contingent upon the availability of public facilities and services that meet or exceed the minimum LOS standards adopted in the Capital Improvement Element (CIE) (CIE Policy 1.2.3.). This application is one of three companion items being requested to correct these errors. The subject properties are in two separate locations. The first (northern) location is a 0.57 acre parcel consisting of four lots fronting SW 27th Avenue between SW 4th and 5th Streets, at approximately 401, 411 and 455 SW 27th Avenue. The second (southern) location is a 0.61 acre parcel consisting of four lots fronting SW 7th Street, immediately northwest of SW 22nd Avenue Road (Beacom Boulevard), at approximately 2542 SW 6th Street and 2515 SW 7th Street, in the Pequena Habana Planning District. MCNP Land Use Policy 1.6.1., establishes future land use categories according to the Future Land Use Plan Map and the "Interpretation of the Future Land Use Plan Map". The first (northern) location is currently designated Major Public Facilities, Transportation and Utilities. The blocks to the south are similarly designated; to the east, there is a Single Family Residential PAB 02/16/94 Item #2 Page 1 of 2 11140 designated area and, to the north and west, an Office land use designated area. The second (southern) location is currently designated Single Family Residential. To the west, the rest of the block is designated Major Public Facilities, Transportation and Utilities and to the east, there is a Medium Density Residential land use designated area. The north part of the same block is designated Office and, to the south, there is a Restricted Commercial land use designated area. The Single Family Residential land use category permits single family structures of one dwelling unit each to a maximum density of 9 dwelling units per acre. Supporting services such as foster homes and family day care homes for children and/or adults and community based residential facilities also be allowed. Places of worship, primary and secondary schools, child care centers and adult day care center are permissible in suitable locations within single family residential areas. The Major Public Facilities, Transportation and Utilities land use category permits major concentrations of national, state and local government activities, as well as major public health or educational facilities. Governmental, health, religious and educational activities may occur within this land use designation. Public and private cemeteries are also provided for in this land use category. The Office category allow residential uses to a maximum density equivalent to "High Density Multifamily Residential" (150 dwelling units per acre) subject to the same limiting conditions; transitory residential facilities such as hotels and motels; general office use; clinics and laboratories; and limited commercial activities incidental to principal activities in designated areas. Supporting facilities such as auditoriums, libraries, convention facilities, places of worship, and primary and secondary schools may be allowed with the "Office" designation. MCNP Land Use Goal 1, requires the City to promote the efficient use of land use and minimize land use conflicts. The change also, would be consistent with Policy 1.1.3. which requires that all areas of the City be protected from encroachment of incompatible land uses. Housing Policies 1.1.5. and 1.2.7. require the City to preserve and enhance the general appearance and character of the City neighborhoods. Together these goals and policies argue that the existing land use pattern in this area should be changed. In addition, Land Use Policy 1.1.1. requires development or redevelopment, that results in an increase in density or intensity of land use, to be contingent upon the availability of public facilities and services that meet or exceed the minimum LOS standards adopted in the Capital Improvement Element (CIE) (CIE Policy 1.2.3.). The attached Concurrency Management Analysis pertaining to concurrency demonstrates that no levels of service would be reduced below minimum levels.
