HomeMy WebLinkAboutO-11129J-94-202 3/?/94 11129 Ordinance No. AN EMERGENCY ORDINANCE ESTABLISHING A NEW SPECIAL REVENUE FUND ENTITLED "WATSON ISLAND AIR TRANSPORTATION FACILITIES PLANNING PROGRAM" AND APPROPRIATING FUNDS FOR THE PROGRAM IN THE TOTAL AMOUNT OF $210,000,, CONSISTING OF A $189,000 GRANT FROM THE UNITED STATES DEPARTMENT OF TRANSPORTATION: FEDERAL AVIATION ADMINISTRATION, A $10,500 GRANT FROM THE STATE OF FLORIDA DEPARTMENT OF TRANSPORTATION, AND A $10,500 CASH CONTRIBUTION FROM THE CITY OF MIAMI DEPARTMENT OF DEVELOPMENT AND HOUSING CONSERVATION; CONTAINING A REPEALER PROVISION AND A SEVERABILITY CLAUSE. WHEREAS, the City of Miami desires to conduct a master plan study for a proposed air transportation service facility at Watson Island, and WHEREAS, the City Commission adopted Resolution No. 93-333 on May 13, 1993 authorizing the City Manager to enter into an joint participation agreement with the State of Florida Department of Transportation for the purpose of implementing the Watson Island Air Transportation Planning Program, and WHEREAS, the City Commission adopted Resolution No. 93-563 authorizing the City Manager to accept a grant, in the amount of $189,000 from the United States Department of Transportation, Federal Aviation Administration, for City use exclusively in connection with the Watson Island Aviation Facilities Planning Program, and 11129 WHEREAS, also on September 7, 1993, the City Commission adopted Resolution No. 93-564 authorizing the City Manager to enter into a professional services agreement with Thompson Consultants International for aviation planning services at Watson Island and authorizing compensation for said services in an amount not to exceed $210,000.00 to be funded as follows: $189,000 from the United States Department of Transportation, Federal Aviation Administration, $10,500 from the State of Florida Department of Transportation, and $10,500 from the City of Miami; NOW THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The following Special -Revenue Fund is hereby established as described herein: Fund Title: Watson Island Air Transportation Facilities Planning Program Resources: United States Department of Transportation: Federal Aviation Administration $189,000 State of Florida Department of Transportation 10,500 Contribution from the City of Miami 10,500 Appropriation: Watson Island Air Transportation Facilities Planning Program 210,000 -2- Section 2. All ordinances or parts of ordinances insofar as they are inconsistent or in conflict with the provisions of this Ordinance are hereby repealed. Section 3. If any section, part of section, paragraph, clause, phrase or word of this Ordinance is declared invalid, the remaining provisions of this Ordinance shall not be affected. Section 4. This Ordinance is hereby declared to be an emergency measure on the grounds of urgent public need for the preservation of peace, health, safety, and property of the City of Miami, and upon the further grounds of the necessity to make the required and necessary payments to its employees and officers, payment of its debts, necessary and required purchases of goods and supplies, and to generally carry on the functions and duties of municipal affairs. Section 5. The requirement of reading this Ordinance on two separate days is hereby dispensed with by an affirmative vote of not less than four -fifths of the members of the Commission. Section 6. W4 FILE : Emergency Ordinance/ Special Revenue Fund/ Watson Island Agenda Item for City Commission Meeting of March 24, 1994 It is respectfully recommended that the attached emergency appropriation ordinance be approved establishing a new Special Revenue Fund entitled; "Watson Island Air Transportation Facilities Planning Program" and appropriating funds for the program in the total amount of $210,000 consisting of a $189,000 grant from the U.S. Department of Transportation Federal Aviation Administration, a $10,500 grant from the Florida Department of Transportation and a required $10, 500 cash contribution from the City of Miami, Department of Development and Housing Conservation. BACKGROUND: The Department of Development and Housing Conservation recommends the establishment of a special revenue fund for the Watson Island Air Transportation Facilities Planning Program as a necessary tool to efficiently receive the federal and state grant funds and to process payments to be made to the consultants for this project. On April 12, 1990, the City Commission, through Resolution No. 90-283, approved the issuance of a Request for Proposal for the acquisition of professional planning and design services for a proposed Air Transportation Facility at Watson Island. On May 13, 1993, the City Commission, through Resolution No. 93- 333, authorized the City Manager to enter into a joint participation agreement with the Florida Department of Transportation to provide funding to implement the Watson Island Air Transportation Facilities Planning Program. 40 J 3-- / 11129 Honorable Mayor and Members of the City Commission Page two On September 7, 1993, the City of Miami Commission adopted Resolution 93-563, authorizing the City Manager to accept a grant in the amount of $189,000 from the United States Department of Transportation, Federal Aviation Administration exclusively for the City of Miami's use in connection with the planning program. At the same Commission meeting the adoption of Resolution No. 93- 564 authorized the City Manager to enter into an agreement with Thompson Consultants International for aviation planning services at Watson Island. This agreement has been entered into by both parties. It is requested that this ordinance be passed as an emergency ordinance so that the consultants can be promptly paid on a monthly basis, thereby allowing for the planning services being provided under the aforementioned agreement to continue without interruption.
