OF ORDINANCE NO. 10544, AS AMENDED, THE MIAMI

CHANGING THE LAND USE DESIGNATION FROM

FINDINGS; INSTRUCTING THE TRANSMITTAL OF A
COPY OF THIS ORDINANCE TO AFFECTED AGENCIES;
CONTAINING A REPEALER PROVISION AND
SEVERABILITY CLAUSE; AND PROVIDING FOR AN
EFFECTIVE DATE.
WHEREAS, the Planning Advisory Board, at its meeting of
November 10, 1993, Item No. 3, following an advertised hearing,
adopted by Resolution No. PAB 37-93, by a vote of seven to zero
(7-0), RECOMMENDING APPROVAL of an amendment to the Future Land
Use Map of Ordinance No. 10544, as amended, the Miami
Comprehensive Neighborhood Plan 1989-2000, as hereinafter set
forth; and
WHEREAS, the City Commission, after careful consideration of
this matter, deems it advisable and in the best interest of the,
general welfare of the City of Miami and its inhabitants to grant
this Comprehensive Plan change as hereinafter set forth;
NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:

Section 1. The Future Land Use Map of Ordinance No. 10544,
as amended, the Miami Comprehensive Neighborhood Plan 1989-2000,
is hereby amended by changing the land use designation from
Residential Duplex to Major Public Facilities, Transportation and
Utilities for the properties located at 1112-1120 Southwest 33rd
Avenue; 3300-3312-3314-3320-3338 Southwest llth Street and
1103-1135 Southwest 34th Avenue, Miami, Florida, more
particularly described as Tract 2 of "Boundaries of Woodlawn
Cemetery" SUBDIVISION, Plat Book 44 at Page 70 and all of Block 6
of "Tamiami Pines" SUBDIVISION, Plat Book 14 at Page 23, P.R.D.C.
Section 2. It is hereby found that this Comprehensive Plan
designation change:
(a) is necessary due to changed or changing conditions;
(b) involves a residential land use of 5 acres or less and a
density of 5 units per acre or less or involves other
land use categories, singularly or in combination with
residential use, of 3 acres or less and does not, in
combination with other changes during the last year,
produce a cumulative effect of having changed more than
30 acres;
(c) is one which involves property that has not been the
specific subject of a Comprehensive Plan change within
the last year; and

(d) is one which does not involve the same owner's property
within 200 feet of property that has been the subject of
a Comprehensive Plan change within the last year.
Section 3. The City Manager is hereby instructed to direct
the Director of Planning, Building and Zoning to transmit a copy
of this Ordinance immediately upon approval of second reading to
Linda Shelley, Secretary, Florida Department of Community
Affairs, Tallahassee, Florida, for 90 day review and comment.
Section 4. All ordinances or parts of ordinances insofar as
they are inconsistent or in conflict with the provisions of this
Ordinance are hereby repealed.
Section 5. If any section, part of section, paragraph,
clause, phrase, or word of this Ordinance is declared invalid,
the remaining provisions of this Ordinance shall not be affected.
Section 6. This Ordinance shall become effective ninety
(90) days after final reading and adoption thereof.

The City of Miami, on February 24, 1994, adopted Ordinance 11125 amending the
Miami Comprehensive Neighborhood Plan 1989-2000 (MCNP). This amendment is a
small scale development activity and, according to Chapter 163.3187, is
submitted without regard to statutory limits on the frequency of
consideration. Pursuant to the requirements of Chapter 163.3184 F.S. 1987,
Chapter 163.3187 (1)(c)4, F.S. 1993 (abbreviated review) and Rule 9J-11.011,
Florida Administrative Code, and the direction of the Department of Community
Affairs (DCA), I am pleased to provide you with five (5) copies of these
documents consisting of:
a) A response to the checklist provided by the Department of Community
Affairs (DCA), through Rule 9J-11.006, F.A.C. (Attachment A);
b) Analysis of the availability of, and demand on, public facilities
(Attachment B);
c) Analysis of the compatibility of the proposed land use change with
the land use element goals, objectives and policies, as well as
those of other affected elements (Attachment C);
d) A map illustrating the boundary of the subject property and its
location in relation to surrounding streets, and thoroughfare
networks; and the present land use designations of the property and

RECOMMENDATION
BACKGROUND AND This cemetery expansion will have little, if any, additional impact
ANALYSIS beyond the boundaries of the cemetery. The subject properties constitute
a block abutting the Woodland Park Cemetery and the reason of this
petition is for the extension of the cemetery use. MCNP requires the City
to promote the efficient use of land use and minimize land use conflicts
and that all the areas of the City be protected from encroachment of
incompatible land uses. MCNP also requires the City to preserve and
enhance the general apperance and character of neighborhoods.

The subject 1.52 acre parcel is located in the block bounded by SW 33rd and
34th Avenues, SW llth street and the Woodlawn Park Cemetery property, at
approximately 1112-20 SW 33rd Avenue; 3300-12-14-20-38 SW llth St. and 1103-35
SW 34th Avenue, in the Little Havana Planning District.
MCNP Land Use Policy 1.6.1., establishes future land use categories according
to the Future Land Use Plan Map and the "Interpretation of the Future Land Use
Plan Map". The subject property is currently designated Residential Duplex.
Blocks to the north and west are similarly designated; to the east and south,
there is a Major Public Facilities, Transportation and Utilities land use
designated area.
The Duplex Residential land use category permits residential structures up to
two dwelling units each to a maximum density of 18 dwelling units per acre.
Permissible uses include places of worship, primary and secondary schools,
child day care centers and adult care centers in suitable locations subject to
planning director approval. Community -based residential facilities (14 clients
or less, not including drug, alcohol or correctional rehabilitation
facilities), also will be allowed pursuant to applicable state law.

The Major Public Facilities, Transportation and Utilities land use category
permits major concentration of national, state and local government
activities, as well as major public health or educational facilities.
Governmental, health, religious and educational activities may occur within
this land use designation. Public and private cemeteries are also provided for
in this land use category.
Actually, the subject properties constitute a block abutting the Woodland Park
Cemetery and the reason of this petition is for the extension of the cemetery
use. A change of land use designation to "Major Public Facilities,
Transportation and Utilities" for these lots will constitute an extension of
this designation to the block to the northwest.
MCNP Land Use Goal 1, requires the City to promote the efficient use of land
use and minimize land use conflicts. The change also, would be consistent
with Policy 1.1.3. which requires that all areas of the City be protected from
encroachment of incompatible land uses. Housing Policies 1.1.5. and 1.2.7.
require the City to preserve and enhance the general appearance and character
of the City neighborhoods. Together these goals and policies argue that the
existing land use pattern in this area should be changed.
In addition, Land Use Policy 1.1.1. requires development or redevelopment,
that results in an increase in density or intensity of land use, to be
contingent upon the availability of public facilities and services that meet
or exceed the minimum LOS standards adopted in the Capital Improvement Element
(CIE) (CIE Policy 1.2.3.). The attached Concurrency Management Analysis
pertaining to concurrency demonstrates that no levels of service would be
reduced below minimum levels.

Section 62-17 of the Code of the City of Miami, Periodic review, additions and'amendments to the
adopted comprehenstye plan, reads as follows:
Periodically, but not less often than once in
five .(5) years or more often than once in two
(2) years, adopted comprehensive plans, or a
portion thereof, shall be reviewed by the
Planning Advisory Board to determine whether
changes in the amount, kind or direction of
development and growth of the city or area
thereof or other reasons make it necessary or
beneficial to make additions or amendments to
the comprehensive plans, or portion thereof.
If the City Commission desires an amendment
or addition, it may on its own motion, direct
the Planning Department to prepare such
amendment for submission to and review by the
Planning Advisory Board. The Planning Advisory
Board shall make a recommendation on the
proposed plan amendment to the City Commission
within a reasonable time as established by the
City Commission. The procedure for revising,
adding to or amending comprehensive plans or
portions thereof shall be the same as the
procedure for original adoption.

Addendum No. 1
As stated above, the existing plan designation for the subject
property is "Residential Duplex", but the Woodlawn Park Cemetery
Company plans to laterally expand into the subject property in
order to enlarge the now depleted burial facilities at the Woodlawn
Park Cemetery and Mausoleum. A "Residential Duplex" plan
designation will not permit this intended use of the subject
property. Therefore, Woodlawn Park Cemetery Company respectfully
'requests a change in the subject property's plan designation from
"Residential Duplex"to "Major Public Facilities, Transportation and
Utilities," which plan designation will permit the intended use of
the subject property.

Addendum No. 2
The Woodlawn Park Cemetery and Mausoleum (the "Cemetery") located
at 3260 S.W. 8th Street, Miami, Florida, has been servicing the
neighboring community since 1913. When the Cemetery first opened
there were no residential developments within miles 'of the
Cemetery. However, over the years, due to the growth of the
community, the Cemetery is now located a short distance from a
residential neighborhood.
This creates a problem, because the Woodlawn Park Cemetery
Company has determined (based on conservative projections) that the
Cemetery does not have a sufficient reserve of burial sites to
accommodate the community. As alluded to above, the existing
problem is a result of surrounding urban growth and a rapidly
increasing population.
Despite its systematic planning over time to provide maximum
burial services to the community, the Woodlawn Park Cemetery
Company believes that the only way to ameliorate this hardship is
through lateral expansion into the subject property. The proposed.
lateral expansion is a logical extension of the Cemetery's existing
facilities. This expansion would give the Cemetery the reserve of
burial sites needed to adequately service the needs of the
community.

Woodlawn Cemetery
The following information is provided in response to questions you
have raised concerning the proposed inclusion of the 1.8-acre
parcel within the cemetery boundaries:
1. Number of burial plots. I misspoke on the number of
burial plots. The rule of thumb is 1,200 (not 1,000)
burial plots per acre. This would result in a total of
2,160 burial plots on the 1.8-acre site (including the
street) proposed for inclusion.
2. Mausoleum. Woodlawn would agree to provide a
covenant that no mausoleum will be constructed on
the 1.8-acre addition to the cemetery if the
amendment to the Comprehensive Plan and the zoning
change is approved.
3. Access from 33rd Avenue. Woodlawn would agree to
provide a covenant that the access to tY: cemetery
from 33rd Avenue will remain mainte-lance and
delivery only.

4. Present number of events at cemetery. The Woodlawn
cemetery currently conducts an average of 95 events
(burial, ceremony, disinterment, etc.) per month.
The average annual total is 1,141 and the weekly
average is 22. The daily average is 3.65 events,
based on a six day week (there are only one to two
Sunday events per year). Absent some unexpected
increase in Miami's death rate, Woodlawn does not
foresee or intend that the proposed addition to the
cemetery will generate any changes in these rates;
the additional capacity will simply extend the life
of the cemetery facility.
5. Weekday P.M. Traffic. Woodlawn Cemetery reports
that only under rare circumstances (such as an
event for a dignitary or police officer that is for
some reason specifically scheduled for that time
period), are events scheduled for the weekday p.m.
traffic peak period. Woodlawn estimates that over
the past several years, no more than one or two
events per year have taken place during that time.
With respect to visitation of gravesites, Woodlawn
reports that very. little visitation is observed
during the weekday p.m. traffic peak period.
I hope that this information and the assurances with respect to the
number of grave sites, mausoleum, and limitation of access from
33rd Avenue are sufficient to obtain a favorable recommendation
from staff. We will be pleased to meet with you and further
discuss the matter at your convenience. A site plan is being
prepared by Brownell & Associates and will be available within the
next several days to serve as a point of discussion for the
requested covenants, if appropriate.
