AN ORDINANCE AMENDING CHAPTER 22, ENTITLED
"GARBAGE AND TRASH", OF THE CODE OF THE CITY
OF MIAMI, FLORIDA, AS AMENDED, THEREBY
ELIMINATING RESIDENTIAL BACKYARD GARBAGE
COLLECTION AND REQUIRING RESIDENTS FROM
SINGLE AND DUPLEX RESIDENCES TO PLACE THEIR
GARBAGE AT CURBSIDE ON THEIR REQUIRED
SCHEDULED COLLECTION DAYS, SAID COLLECTION
DAYS TO BE PRESCRIBED BY THE DIRECTOR OF THE
DEPARTMENT OF SOLID WASTE; MORE PARTICULARLY
BY AMENDING SECTION 22-2 OF THE CITY CODE;
CONTAINING A REPEALER PROVISION, A
SEVERABILITY CLAUSE, AND PROVIDING FOR AN
EFFECTIVE DATE.
WHEREAS, pursuant to a straw ballot held in November 1982,
the residents of the City of Miami approved a change in
residential garbage collection from backyard to curbside; and
WHEREAS, no change in the residential garbage collection
method was ever effectuated by the City administrators; and
WHEREAS, tipping fees paid to dispose of garbage have almost
tripled since November 1982;
NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the
Preamble to this Ordinance are hereby adopted by reference
thereto and incorporated herein as if fully set forth in this
Section.

Section 2. Section 22-2 of the Code of the City of
Miami, Florida, as amended, is hereby amended in the following
particulars: J/
"Sec. 22-2. Collection services, container usage,
condition and requirements for placement
location.
(a) Every commercial establishment shall utilize
the waste collection services of the city or that of a
licensed waste hauler authorized to perform such
services by the director of the department. Each
residence or commercial establishment in the city shall
have a sufficient number of garbage cans, plastic bags
or portable containers to accommodate all garbage,
bundled garden trash or rubbish to be removed by the
city or other approved contractors. All bundled garden

city shall be placed at curbside in front of the
property, for removal by the city as scheduled by the
director of the Delpartment of Solid Waste, in such a
manner as not to obstruct pedestrian passage , except

Director of the Department of Solid Waste may make
exceptions to these rules to accommodate disabled and
elderly persons,
Any private hauling company providing waste
collection services who will be discontinuing its
collection service to a commercial establishment shall
give the director at least seven (7) business days
prior notice of its intention to discontinue such
service. The private hauler shall additionally mail to
the commercial establishment a notice that it is
discontinuing waste collection services for that
commercial establishment. A duplicate copy of this
notice shall be simultaneously mailed by the private
hauler to the director. A commercial establishment
which does not have current waste collection services
being furnished will be subject to having an

Section 3. All ordinances or parts of ordinances insofar
as they are inconsistent or in conflict with the provisions of
this Ordinance are hereby repealed.
Section 4. If any section, part of section, paragraph,
clause, phrase, or word of this Ordinance is declared invalid,
the remaining provisions of this Ordinance shall not be affected.
Section 5. This Ordinance shall become effective thirty
(30) days after final reading and adoption thereof.

At the request of the Mayor's Office, the proposed
amendatory ordinance concerning curbside garbage collection has
been modified. The modification, located in the last sentence of
Section 22-2(a)(Page 2 of the proposed ordinance), now reflects
that "... The Director of the Department of Solid Waste may make
exceptions to these rules to accommodate disabled and elderly
persons". The language in the proposed amendatory ordinance in
your Agenda Packet only addresses handicapped persons and does
not address elderly persons.
Please substitute the attached modified proposed amendatory
ordinance for the one in your Agenda Packet for the January 13,
1994 City Commission Meeting, Item #13.

By way of background, the City's General Fund currently
subsidizes the Solid Waste Department budget by approximately $17
million estimated for FY 194. In an effort to begin to resolve
this subsidy the City can either make operations more efficient
and cost effective by collecting residential garbage at curbside
or alternatively raise garbage fees.
The Curbside Program will provide cost savings of approximately
$1,200,000 annually as a result of $900,000 in estimated savings
in tipping fees and $300,000 in estimated savings in personnel
overtime costs. Service improvement and environmental
enhancements will be achieved by redirecting personnel and newly
available resources to concentrate efforts on the cleanup of
Downtown, city parks, vacant lots and increased city-wide street
sweeping. Favorable consideration will result in a considerable
cost avoidance for the City in effect relieving the incurrence of
additional salary costs as a result of the present understaffing
in SEA. For each waste collector not hired, approximately
$40,000 in payroll and related costs are avoided. In order to
properly staff garbage routes for backyard collection the
Department would need to add 75 employees to present levels.
Therefore, this operational change will eliminate the need to add
employees and avoid the additional associated payroll costs.
Support of the proposed ordinance is further evidenced by a
letter from the SEA Attorney and as agreed upon in the Labor
Management Summit meeting with SEA.
Failure to pass this ordinance will consequently force the
administration to propose the latter alternative, raising garbage
fees, which undoubtedly will receive citizen concern.

RE: Tentative Agreement for Curbside Garbage Collection
Thank you for your prompt response to our discussion regarding
solid waste collection procedures. It is clearly progressive and
precedent setting to have the City of Miami Administration and
the Sanitation Employees Association in concert with regards to
the issue of curbside garbage collection.
With regards to your summary of agreement, I have only two (2)
concerns:
1. We have agreed that the bin route commercial program will
stay in effect with no immediate reassignments of employees;
however, because of the financial consideration that I
discussed with you, I believe it to be beneficial to all
that we continue to evaluate the bin routes with emphasis on
determining the most cost-effective method of continuing
these commercial collections.
2. As for staffing levels, it is impossible to guarantee a
fixed number of bargaining unit employees for various
reasons, including resignations, promotions, etc. The
number of employees could fluctuate. It is the City's
intention to budget for a minimum of 330 Operations Section
employees through the life of your current agreement with
the City of Miami.

OLD BUSINESS:
1. Promotion of Stand-Bys:
After much discussion, everyone agreed to promote
the 39 stand-bys to full-time employee status thereby
eliminating the 99 stand-by program. Ron pointed out that
the cost to do this is approximately $500,000 but that
there will be savings in the long run with reduction of
overtime, reduction of absenteeism, reduction of injuries,
improved moral, etc.
The SEA inquired about future vacancies and Ron
indicated that they will be filled. The hiring process may
take a month or more. In the meantime, they can fill in
with the day workers from the County's labor pool contract.
The Committee could not agree upon a final number
of employees until the operation was more clearly defined.
Ron will try to make the promotions before
Christmas.

2. Curbside Pick-up: C: i.y C; leak
The SEA agreed to curbside pick-up if management
can guarantee there will be no layoffs. Ron confirmed that
there would be no layoffs. He emphasized that those
employees not assigned to a route will be reassigned to many
other duties such as the work at Virginia Rey, filling
holes, illegal dumping, alleys, NET neighborhoods and more.
The SEA also requested there be no reduction in
routes. There are currently 38 routes. Ron agreed but
asked that the routes be looked at in a year. Some routes
will be easier than others and it may be necessary to
balance or reduce them. Everyone agreed.
James asked if the hours will be fixed at Virginia
Key whereby the incentive plan will not apply. Ron said it
is likely that the hours would be fixed and that he wi--7.1
discuss this more with Henry Jackson and James Gause.
3. Vacation Scheduling:
According to the SEA contract, management must
begin the vacation schedule for the upcoming year in
November. Two weeks ago they asked for an extention. Bob
asked why the scheduling is not being done on time. Ron
explained that they are still working out the scheduling
problems in 193. The additional work generated by the
hurricane, the shortage of staff and absenteeism has made it
difficult to schedule and then let the employees take the
vacation time.
Bob asked for a commitment that no one would lose
time. There are about 50 employees with more than 100 hours
and 20 employees with more than 80. The plan at this point
is to pay employees with less than 40 hours and extend the
time limit to June for those employees with 40 hours
remaining.
Anyone with a floating holiday must use that time
before the end of the year.
4. 193 Christmas Holiday Pay:
Mayshack pointed out that a question exists
regarding employees that work Saturdays. The City is paying
holiday pay for the 24th and not the 25th. Some employees
that would work the 25th will want to observe the Christmas
with their families. Will they be paid?
Everyone agreed that Solid Waste employees will
work on Friday the 24th and receive holiday pay for the
25th. Bob will confirm this with Sue Weller.
5. Garbaae Routes:
Bob explained that management is changing people
around in the routes. The perception is that often people
are moved to another route when their route was not finished
the day before.

At one point the supervisor told the workers that
they could not take lunch or breaks until the route was
finished.
Ron responded by saying 1) the supervisor was
wrong to not permit the workers lunch & break time; 2) as
long as there is a shortage of workers there can not be
ownership of the routes. In the mornings, the supervisor
has 15 minutes to evaluate attendance and assign the routes.
He must put the teams together as he see fit. Bob explained
that HOW he does that makes a difference.
Ron asked about computerizing the rotation of the
routes so that all the drivers become familiar with all the
routes. Felix explained that rotation would cause more
overtime as the drivers miss some of the streets. Felix
also asked that management check the tonage in those areas
that are incomplete.
Ron and Jose Rilo agreed to speak with the
supervisors to develop greater sensitivity and interpersonal
skills when dealing with the workers.
6. Call -ins:
Many times employees are running late and call in
to a machine taking messages. The employee arrives and
sometimes they are assigned work and sometimes sent home.
Could the employee call in to a person and speak to their
supervisor to prevent this. Ron pointed out that that is
difficult. The person answering the phone will not be able
to contact the supervisor and can only guess what will
happen. We must rely on the employee arriving to work on
time.
