ORDINANCE NO.
AN ORDINANCE AMENDING CHAPTER 54 OF THE CODE
OF THE CITY OF MIAMI, FLORIDA, AS AMENDED,
ENTITLED "STREETS AND SIDEWALKS" BY AMENDING
SECTION 54-104 ENTITLED "NONSTANDARD STREET
WIDTHS" BY MODIFYING THE WIDTH OF A CERTAIN
STREET; CONTAINING A REPEALER PROVISION, A
SEVERABILITY CLAUSE, AND PROVIDING FOR AN
EFFECTIVE DATE.
WHEREAS, Article V of Chapter 54 of the Miami City Code
establishes base building line locations for all public streets
within the City of Miami; and
WHEREAS, Royal Road between Main Highway southeasterly to
Its terminus at Biscayne Bay is landscaped and developed in
harmony with the scale and style of the residences in the
neighborhood; and
WHEREAS, the property owners abutting Royal Road have
expressed a strong desire in preserving the landscaping and
character of the roadway; and
WHEREAS, the City Administration explained that to preserve
the landscaping and scale of the aforementioned roadway In
relation to the neighborhood residences, the zoned street width
of this section of Royal Road would have to be reduced from 40
feet to 30 feet; and
WHEREAS, the Police, Fire, Rescue and Inspection Services
and Solid Waste Departments have evaluated the effects of the
reduction of the zoned street width of this section of Royal Road
on their operations and have no substantial objections;

NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE
CITY OF MIAMI, FLORIDA:
Section 1. Section 54-104 of the Code of the City of
Miami, Florida, as amended, is hereby amended in the following
particulars:

ARTICLE V. BASE BUILDING LINES
Sec. 54-104. Nonstandard street widths.
Base building lines shall be located from the centerline as
specified for each of the following streets:
(267) Royal Road, Main
Highway to
Biscayne Bay ............................Ee 15
Section 2. All Ordinances, or parts of Ordinances Insofar
as they are Inconsistent or in conflict with provisions of this
Ordinance are hereby repealed.
Words and/or figures stricken through shall be deleted.
Underscored words and/or figures shall be added. The
remaining provisions are now in effect and remain unchanged.
Asterisks indicate omitted and unchanged material.

Section 3. If any section, part of section, paragraph,
clause, phrase or word of this Ordinance is declared invalid, the
remaining provisions of this Ordinance shall not be affected.
Section 4. This Ordinance shall become effective (30)
thirty days after final reading and adoption thereof.

PASSED AND ADOPTED ON SECOND AND FINAL READING this 13th

It Is respectfully recommended that the City Commission adopt
the attached Ordinance amending Chapter 54 of the Code of the
City of Miami entitled "Streets and Sidewalks" by amending
Section 54-104 entitled "Nonstandard Street Widths".
BACKGROUND:
Article V of Chapter 54 of the Miami City Code eatabllshes the
width of all public streets within the City by establishing base
building line locations. The Department of Public Works IS
proposing to change the base building IIne location for Royal
Road from Main Highway southeasterly to its terminus at Biscayne
Bay by amending the street width In Section 64-104 entitled
".Nonstandard Street Widtha f. .
Royal Road Is currently zoned 40 feet In width, however, the
original subdivisions that created this roadway dedicated a.
total width of only 30 feet. The residences along Royal Road
were constructed In harmony and scale to the original
subdivision street width of 30 feet along Its entire length and
100% of the abutting property owners have expressed a strong
desire, by petition, In preserving the character of the road and
the neighborhood. The Public Works Department, working with the
property owners on Royal Road, has determined that a 30 foot
roadway width Is In scale with the existing residences,
Preserve* the front yard landscaping and provides for the
necessary City vehicles that must serve the -R-1" zoned
neighborhood.
The Public Works Department. with concurrence of the Fire,
Rescue and Inspection Services, Police and Solid Waste
Departments, recommends that the zoned width of Royal Road be
reduced from 40 feet to 30 feet.

ENCLOSURES:
Per your request the Fire Department has evaluated a request from
the property owners along Royal Road between Main Highway and
Biscayne Bay to reduce the width of Royal Road from 40 feet wide
to 30 feet wide. It is our recommendation that this request be
disapproved. A reduction in the width of the road will make it
more difficult for large Fire and Rescue apparatus to respond and
handle emergencies in the requested area. If you require
additional information, please contact me at the Fire Chief's
office.

The Public Works Department has received a petition from all of
the property owners along Royal Road between .Main Highway and
Biscayne Bay requesting that the zoned street width of Royal Road
be reduced from 40 feet wide to 30 feet wide.
Royal Road currently Is Improved with pavement approximately 15
feet wide and "dead ends" near the bay with a widened paved turn
around area. The current right of way wldth-has been dedicated
30 feet wide and the remaining 10 feet is yet undedicated. The
Public Works Department does not have a roadway widening project
scheduled for this roadway and due to the environmentally
sensitive nature of the South Coconut Grove area, will most
likely not require the installation of sidewalks within this
neighborhood.
If the zoned width of Royal Road Is reduced from the current 40
feet, the homeowners will be permitted to Install fences or walls
along the new property line, closer to -the existing driving lanes
than allowed at the present time. Since any reduction In the
zoned right of way width of a roadway will affect the ability of
your Department's vehicles to serve the neighborhood, especially
a "dead end" roadway, please notify me if this proposed reduction
In zoned width of Royal Road Is acceptable for your department's
operations. This request has been scheduled to be heard by the
City Commission at their November 18, 1993 meeting. Your prompt
attention to this matter would be greatly appreciated.
