July 7, 1994 FILE J-94-5W SUBJECT Proposed Charter Amendment Re: UDP Process REFERENCES City Commission Meeting July 14, 19OA ENCLOSURES (1) As directed, my office has prepared the attached draft resolution setting forth a proposed charter amendment amending provisions regarding proposed projects improving or disposing of all City property and the procedures for modifying contracts pertaining to said projects. Charter Amendment No.1 (1) adds a separate package of functions for planning and design and construction to the City's method of procuring development of improvements to property owned or to be acquired by the City, known as the Unified Development Project (UDP) process; (2) provides a method for resolving protests relative to the request for proposals (RFP) or award of contracts for improvements or the disposition of City -owned property; (3) establishes a prequalification procedure for interested parties desiring to submit responses to a UDP Request for Proposals; (4) eliminates the three proposal submission requirement for proposed projects improving or disposing of City property and the referendum requirement pertaining thereto; (5) provides for the implementation of projects of community based organizations deemed qualified by the City Commission at less than fair market return to the City; (6) authorizes amendments to existing or future contracts for improvements or disposition of City property by the City Manager where such proposed amendment does not extend the term of the contract, change the nature or the use of the property permitted under the contract, and does not lessen the existing rate of return to the City as set forth in said contract, and (7) authorizes amendments to existing or future contracts for improvements or disposition of City property by the City Commission where such proposed amendment extends that term of the contract, changes the nature or the use of the property permitted under the contract, and lessens the existing rate of return to the City as set forth in said contract, after an advertised public hearing.
