ENCLOSURES:
At a community meeting with neighborhood residents on Thursday
night, June 17, 1994; I told the attendees that finally after six
years we are going to discuss the construction contract for the
Hadley Park Pool at the July 14, 1994 commission meeting.
A vote was made by the residents in 1988 to build an Olympic
Service pool in the Charles Hadley Park. Please schedule this
as an item, for after 5:OOPM at the July 14th, commission
meeting.

Dear Me. McNally:
As Chief Procurement Officer of the City of Miami, i received your
protest letter of July 111 1994, reviewed pertinent documents and
researched the issues, pursuant to my duties under the amended
Section 18-56.1, City of. Miami Code, Rgsolu:Li(�n gf_. Pro ash
Soli citations and Awards .
You allege that Sealand Contractor, (Sealand) Inc.'s bid was
incorrect in that their base bid was not the total of the bid items 1
through 15, but was greater than the sum of the individual items.
You further stated that Sealand's bid was nonconforming and should
therefore be thrown out.
I have reviewed the bid documents submitted by Sealand and find that
the contractor's bid response was responsive and responsible, met the
bid's requirements and offered a competitive price.
I have also reviewed the language contained in the general and
supplemental sections of the Specifications and Contract Documents
for this bid and inspected Sealand's response to the bid. It appears
that the contractor made a good faith effort to interpret the bid's
requirements. I have found that it was reasonable for the contractor
to interpret the sections in the manner in which he did.
Sealand itemized prices for Items 1 through 15 of its bid on pages 2a
through 2f which amount to $2,333,415; it also listed its base bid
price of $2,448,415, on page 2 o;; the bid's price proposal form. The
$115,000 difference between the two amounts results ;from the
inclusion of overhead costs corresponding to all (fifteen) 15 items
listed in the bid, and is included in the base bid prase of
$2,448,415. Notwithstanding the above, Sealand still remains the
low, responsible and responsive bidder for this project.
Having carefully evaluated all the facts of this protest, it appears
to have been appropriate for the City to have accepted this bid.

Based upon the foregoing, 1 am rejecting your protest. The City
Manager and City Attorney have approved my decision.
The matter has been scheduled on the City Commission agenda for
Thursday, July 14, 1994, at approximately 5;00 P.M. The meeting will
j be in the City Commission Chambers, City Mall, 3500 Pan American
Drive, .Miami, Florida.
