For City Commission ENCLOSURES Meeting of 6/9/94 This memorandum serves to request placement of a discussion item on the June 9, 1994 City Commission agenda regarding a new License Agreement with the School Board of Dade County. If you are in agreement with the new formula outlined below, a vote to adopt it will be appropriate. BACKGROUND The School Board of Dade County, Florida (School Board) entered into six individual Lease Agreements on December 29, 1987 with the City for use of six playgrounds: Athalie Range Park; Gibson Park; West End Park; Grand Avenue Park; Lemon City Park; and Shenandoah Park, which are all located adjacent to elementary schools. Over the past five years, School Board has paid an average of $240,000 annually for the use of these six parks based upon a sixty percent (60%) reimbursement basis of the City's quarterly costs. Said agreements have expired and the terms and conditions for use of the playground areas have been renegotiated. A new License Agreement is being proposed with the School Board which will effectively increase the percentage reimbursement to the City based upon the prior years' reimbursement schedule. As consideration, the School Board will pay the City approximately 5309,350.00 for FY 194-195, representing a 22% increase to the City over prior years' payments. The new reimbursement schedule includes paying previous expenses plus approximately $69,000 in FY 194-195 representing the School Board's proportional share of eight (8) administrative salaries and water and electricity charges previously absorbed by the City. The new reimbursement schedule effectively increases the consideration to the City while maintaining the School Board's proportionate share of reimbursement costs at 60%. The School Board will also continue to pay for maintenance of the areas, including recreational and maintenance personnel assigned to perform maintenance to the areas; costs of equipment and materials; general maintenance expenses and utilities. Said License Agreement includes the use of one additional park, Biscayne Park, and will allow for the addition and deletion of park playground areas as requested from time to time by the School Board and approved by the City Manager upon the terms and conditions set under the new License Agreement. /
