Dougherty, Esq. for Applicants 1221 Brickell Avenue Miami, F1 33131 REQUEST Special Exception as listed in Ordinance No. 11000, as amended, the Zoning Ordinance of the City of Miami, Article 4, Section 401, Schedule of District Regulations, R-2 Two -Family Residential, Conditional Principal Uses, for lots with more than five thousand (5,000) square feet to allow a one (1) additional unit for each additional two thousand five hundred (2,500) square feet of lot area, for a total of ten (10) existing dwelling units; zoned R-2 Two -Family Residential. RECOMMENDATIONS: PLANNING, BLDG & ZONING Approval of appeal; denial of application: PUBLIC WORKS No comments. PLAT AND STREET N/A DADE COUNTY TRANSPORTATION No comments. ENFORCEMENT HISTORY, IF ANY C.E.B. Case No: 93-524 Last Hearing Date: 09/22/93 Found: GUILTY Violations) Cited: Working without a permit, building and/or roofing, etc. Affidavit of Non -Compliance issued on: 12/10/93 Daily Fine: $200.00 Lien Recorded on: Sent 12/14 Total Fines To Date: Unknown CEB Action: Ordered to comply retroactive by 06/25/93 or a fine of $200 per diem will be applied. HISTORY A Special Exception to allow the construction of 10 units per plans on file was granted by Res. ZB 114-89 on 10/16/89 by a vote of 9-0. ANALYSIS The requested Special Exception for a total of 10 dwelling units on the subject property was constructed in a manner different than what was approved (per plans on file) by the Zoning Board on October 16, 1989. The revised plans contain the following differences: there are now six (6) separate openings onto the project from the adjacent streets (including five of which are individual driveways); one of the structures has a different orientation; the elevations and landscape plans are different; and the solid 7 ft. perimeter wall is now perforated with vehicular openings. The Planning, Building and Zoning Department is recommending denial of the requested Special -Exception finding that the traffic conditions caused by the project have an adverse impact on the surrounding residential neighborhood, particularly during peak (early morning and late afternoon hours). ZONING BOARD Granted for 12 mo. in which a bldg. permit must be obtained. APPELLANT Joyce Nelson for Coconut Grove Civic Club & James McMaster. CITY COMMISSION Cont.on 2/24/94to3/24/94.
