A RESOLUTION OF THE COCONUT GROVE HOMEOWNERS
AND TENANT ASSOCIATION, AN ORGANIZATION
REPRESENTING THE AFRICAN-AMERICAN HOMEOWNERS
AND TENANTS IN COCONUT GROVE, URGING THE CITY
OF MIAMI COMMISSION TO ADOPT A SELECTION PLAN,
ACCORDING TO CONSTITUTIONAL GUIDELINES, THAT
SHALL ASSURE AFRICAN-AMERICAN BUYERS AT LEAST
FIFTY PERCENT OF THE UNITS LOCATED AT THE ST.
HUGH OAKS CONDOMINIUM DEVELOPMENT; AUTHORIZING
THE APPROPRIATE CITY OFFICIALS TO EXECUTE THE
NECESSARY PROCEDURES; PROVIDING FOR AN
EFFECTIVE DATE
WHEREAS, the City of Miami has financed, planned and developed
a site, hereinafter, referred to as the St. Hugh Oaks Development.
WHEREAS, the St. Hugh Oaks Development is a housing
development that consists of 23 single family units located on a
three acre tract of land in Coconut Grove.
WHEREAS, Coconut Grove is Miami's first black community, and
today, its' existence is threatened by commercial zoning proposals,
growth and economic development in its surrounding communities,
increasing taxes, a decreasing black population, an invisible black
middle-class, low quality housing, high poverty, and high
unemployment.
WHEREAS, the St. Hugh Oaks Development is located in the black
community of Coconut Grove, and sits on one of the boundaries that
separate the predominately black neighborhood from the
predominately white neighborhoods.
WHEREAS, by virtue of society's maintenance of two
racially separate communities in Coconut Grove, black residents in
Coconut Grove are denied the same opportunities as others to

WHEREAS, City of Miami Officials have represented to residents
from the black community in Coconut Grove that homes at the St.
Hugh Oaks Development would be sold at an affordable price.
WHEREAS, opponents signed a petition opposing the development
because they feared the development would depress their property
values, and become an eyesore to their neighborhood.
WHEREAS, the Coconut Grove Homeowners and Tenants Association,
at its 2/28/94 meeting, found that the median income for residents
in Miami is $27, 000 annually and the median income for residents in
the black community of Coconut Grove is $24,000.
WHEREAS, the Coconut Grove Homeoners and tenants Association
is concerned that middle -income African -American buyers will be be
denied access to the development because the city paid an excessive
price for land to build affordable housing and, thereafter, decided
to reduce the density of the development from 28 units to 23 units.
WHEREAS, the Coconut Grove Homeowners and Tenants Association,
at its 2/28/94 meeting, found that a purchase price, in excess of
$ 80,000, will have a discriminatory effect on African -American
applicants.
WHEREAS, the Coconut Grove Homeowners and Tenants Association,
at its 2/28/94 meeting, concluded that many middle -income African
Americans in Miami, live or desire to live in established black
communities with the objective of maintaining cultural ties.
WHEREAS, the Coconut Grove Homeowners and Tenants Association,
supports a transitional or integrated neighborhood at the St. Hugh
Oaks site, mainly to consist of at least eleven (11) African -
American buyers.

WHEREAS, the Coconut Grove Homeowners and Tenants Association,
supports a transitional or integrated neighborhood where, at least
one half of the units assured to African -American buyers, shall be
bought by buyers with close ties to the black community in Coconut
Grove; now, therefore
BE IT RESOLVED BY THE COCONUT GROVE HOMEOWNERS AND TENANTS
ASSOCIATION IN COCONUT GROVE, FLORIDA:
Section 1. That the City of Miami Commission adopt a
selection plan that shall stipulate that at least one half of the
23 units (11 units) located at the St. Hugh Oaks development be
sold to African American buyers.
Section 2. That the selection plan adopted by the City
Commission shall stipulate that at least one half of the eleven
units assured to African -Americans (6 units) be sold to buyers with
historic, cultural or civic ties to the black community of Coconut
Grove.
Section 3. That the City of Miami offer the units to all
median -income buyers at a price of $60,000, but not to exceed
$80,000.
Section 4. That the appropriate City Officials be authorized
to interact and consult with the Coconut Grove Homeowners and
Tenants Association in order to effectuate the intent and the
objective of this Resolution.
Section 5. Effective Date.
This Resolution shall become effective upon adoption.

It is respectfully recommended that the City Commission adopt the
attached Resolution approving an increase in the contract between
the City of Miami and Associates Construction, Corporation dated
December 12, 1992, in the amount of $116,000 in connection with
the development of twenty-three (23) new single family homes on
the city -owned St. Hugh Oaks parcel in the Coconut Grove
neighborhood.
BACKGROUND:
The Department of Development and Housing Conservation recommends
ratification of the attached resolution approving an increase in
the contract between the City of Miami and Associates
Construction, Corporation dated December 12, 1992, in the amount
of $116,000, in connection with the development of twenty-three
(23) new single family homes on the city -owned St. Hugh Oaks
parcel in the Coconut Grove neighborhood.
In October of 1992, through Resolution No. 92-660, the City
Commission accepted the bid of Associates Construction,
Corporation in the amount of $2,258,000 and authorized the City
Manager to execute a contract in connection with the development
of twenty-three (23) new single family homes on the city -owned
St. Hugh Oaks parcel.
After the execution of the contract between the City and
Associates Construction, Corporation, a number of unexpected cost
increases have been experienced relative to the new South Florida
Building Code requirements imposed as a result of Hurricane
Andrew, increases in construction materials as well as new
requirements imposed by Dade County's Department of Water and
Sewer. The project cost overruns were further exacerbated by the
more than seven (7) month delay in the commencement of

construction on the St. Hugh Oaks Village Condominium Project due
to the new construction water/sewer moratorium imposed by
Metropolitan Dade County in early February of 1993.
Hurricane Andrew arrived on August 23, 1992, just two days prior
to the due date of the original bid of August 25, 1992. Due to
the Hurricane, the date for submission of the bid was extended to
September 22, 1992. Even given one month after Andrew to revise
their bid, it is believed that the Contractor did not have a
clear understanding or assurances of the effects on pricing and
the availability of labor and material, making it difficult to
attain final prices. These extraordinary circumstances should
also be given consideration in understanding this request.
In an effort to ascertain whether the cost overruns submitted by
Associates Construction, Corporation were in fact realistic, the
Department of Development and Housing Conservation retained the
services of Mr. Henry Kaufman, a construction expert associated
with the architectural firm of Andres Duany and Elizabeth Plater-
Zyberk, Architects, and it has been determined that the cost
increases are in line with the cost increases which have been
experienced by the construction industry in South Florida over
the past year.
Funds in the amount of $116,000 are available from Capital
Improvement Program Project entitled "Scattered Site Affordable
Housing Development Program", Project No. 321034, (proceeds from
the sale of affordable housing units) to provide the
aforementioned cost increase in connection with the development
of the city -sponsored St. Hugh Oaks Village Condominium Project.
In an effort to complete the construction of the twenty-three
(23) new single family homes being developed on the St. Hugh Oaks
parcel, City Commission ratification of the attached resolution
is recommended.

PLEASE ALL TAKE NOTICE THAT a public hearing will be held by the
City Commission of the City of Miami, Florida, on April 14, 1994,
at 10:00 a.m., in the City Commission Chambers at City Hall, 3500
Pan American Drive, Miami, Florida, on the proposed increase in
the contract between the City of Miami, Florida and Associates
Construction Corporation in the amount of $116,000 for the Saint
Hugh Oaks Village Housing Project.
All interested persons are invited to appear and may be heard
concerning this item. Should any person desire to appeal any
decision of the City Commission with respect to any matter
considered at this hearing, that person shall ensure that a
verbatim record of the proceedings is made, including all
testimony and evidence upon which any appeal may be based.
