HISTORY Special Exception to permit a gas station was granted by Res. ZB 126-92 with a vote of 6-2 and
a Special Exception to permit 'joint parking facilities was granted by Res. ZB 127-92 with a
vote of 6-2 on 12/7/92.
ANALYSIS The proposed Special Exception is for the purpose of removing the originally planned car wash
and replacing it with a larger convenience store (the convenience store is increasing in size
from 2000 sq.ft. to 4800 sq.ft.; this change is not inconsistent with the use whici; waa
originally proposed for the subject property: however, due to the substantial incre,04 `in .size
of the convenience store, the Planning, Building and Zoning Department is recommending approval
with the following conditions: 1) unless it is required by the Fire Department, there shall be
no entrances to the.store facing South Dixie; and 2) if the convenience store, at any time in
the future, sells alcoholic beverages of any kind, they shall be separated from the remainder
of the store and limited to a total of 250 square feet of the overall store.'

I am sending you this letter as an official appeal to the City of
Miami'Commission of the decision rendered by'the Zoning
'Board as to
issues on the Tuesday, January 18, 1994 agenda regarding' the
application for special eseption/s having to do with the real
estate' property situated at the Southwest corner of US 1 and 27th
Avenue, Miami, Florida.
I am the Pastor of the Christ Allapattah'United Methodist Church
and I'm speaking on behalf of my congregation. Our church is
located at 2850 S.W. 27th Avenue, Miami, Florida.
The bases for the appeal are:
1. The use permitted by the Zoning Board are inconsistent with
the City of Miami comprehensive plan. The plan designates
this area for transportation as well as for restricted
commercial use.
2. The uses proposed for the property do not meet the SD-11
overlay standards as set forth in Section 611.1, Intent, sets
forth the purposes to be accomplished under this overlay
district, which purposes are thwarted by the Zoning Board
decision.
3. The uses proposed for the property do rtot meet the guidelines
for the 'special permits outlined in 1305.8 in applications for
special permits specifically, "...and that use will be
compatible and harmonious with other development in the area
to a degree which will avoid substantial depreciation of
a nearby property."

I am a resident and pproperty owner of real estate within 375 et
of the proposed development of a gas station. I own parc with
the following legal descriptions: PINE TERRACE LOT 6 7 OF
BLOCK 5 AS RECORDED IN PLAT BOOK 3 AT PAGE 51. ALSO -ME N40FT OF
LOT 6, N40FT OF LOT 71 S110FT OF LOT 6 AND S110FT OF LOT 7 IN
BLOCK 1 AS RECORDED IN PLAT BOOK 3 AT PAGE 47 OF DADE COUNTY,
FLORIDA. This is a total of 6 parcels.
The bases for the appeal are:
1) The use permitted by the Zoning Board are inconsistent with
the City of Miami comprehensive plan. The plan designates this
area for transportation as well as for restricted commercial use.
2) The uses proposed for the property do not meet the SD-11

Dear Ms Fernandez:
The purpose of this letter is to appear to the Miami City Commission the decision of the Zoning
Board as to applications regarding the property at US 1 and 27th Avenue, which were the
subjects of the agenda of the zoning meeting of Tuesday January 18, 1994. The appellants in
this case are. Nancy Marmesh and Cocoanut Grove Park Homeowner's Association; the owners of
property affected by the relief granted by the Zoning Board. The Homeowner's Association of
which Ms Nancy Marmesh is a member, were represented by officers of the Association including
Howard Weisberg, Joyce Nelson, and Ron Nelson.
The Bases for the appeal are:
' 1) The uses permitted by the Zoning Board are inconsistent with the City's comprehensive
plan. The plan designates this area'for transportation, as well for restricted commercial.
2) The uses proposed for the property do not meet the SD_ 11 overlay standards as set
