HomeMy WebLinkAboutR-95-0866P 1a J-95-1001 11/29/95 RESOLUTION NO. 9 5 866 A RESOLUTION ACCEPTING THE CITY MANAGER'S RECOMMENDATION TO REJECT ALL BIDS SUBMITTED IN RESPONSE TO THE INVITATION TO BID FOR THE SALE OF THE CITY -OWNED PROPERTY LOCATED AT 5500 NW 17 AVENUE, MIAMI, FLORIDA, AS MORE PARTICULARLY DESCRIBED HEREIN; FURTHER DIRECTING THE CITY MANAGER TO RETURN THE BID DEPOSITS SUBMITTED SIMULTANEOUSLY WITH SAID BIDS. WHEREAS, pursuant to Resolution 94-487 the Office of Asset Management issued an Invitation to Bid for the sale of the City -owned property located at 5500 NW 17 Avenue, Miami, Florida, more particularly described herein; and WHEREAS, on November 14, 1995. the City received two bids in response to said Invitation to Bid in the amounts of $18,500 and $19,500, and WHEREAS, Section 29-B of the Charter of the Cit} of Miami, as amended. requires. that if there are less than three proposals received, the City Commission can not consummate the sale of a city -owned real property until it is approved by a majority of the votes cast by the electorate at a referendum; and WHEREAS, pursuant to Section 18-83 of the Code of the City of Miami, as amended, all costs involved in the sale of the property shall be borne by the buyer: and WHEREAS, the cost of a referendum at a regularly scheduled election would cost approximately $20,000, an amount greater than the value of the sale property: and WHEREAS, considering that the costs involved in subjecting approval of such sale to a referendum would exceed the fair market value of the real property offered, the City Manager recommends that both proposals be rejected; :CITY COMMISSION MEETING OF DEC C 7 1995 Resolution No. 95- 866 NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA, Section 1. The recitals and findings contained in the Preamble to this Resolution are hereby adopted by reference thereto and incorporated hcrcin as if fully set forth in this Section. Section 2. The recommendation of the City Manager to reject all bids received in response to the Invitation to Bid for the sale of the City -owned property located at 5500 NW 17 Avenue, Miami, Florida, more particularly described as Lot 24. Block 13 of FLORAL PARK, according to the Plat thereof. recorded in Plat Book 5, Page 53, of the Public Records of Dade County. Florida, less however the East 10 ft. of Lot 24 in Block 13 of FLORAL PARK, according to the Plat thereof recorded in Plat Book 8, at Page 5, formerly recorded in Plat Book 5, at Page 53 of the Public Records of Dade County, Florida and less that part of said Lot 24, which lies within the external area formed by a 5 ft. radius arc concave to the northwest, tangent to the south line of said Lot 24. and tangent to a line that is 10 ft. west of and parallel to the east line of said Lot 24, is hereby accepted. Section 3. The City Manager is herebv directed to return the bid deposits submitted simultaneously with said bids to the respective bidders. Section 4. BACKGROUND. Pursuant to Resolution 94 4H7, the office of Asset Muuagerrtent issued an Invitation to Did for the sale of the City -owned propeafiy located at 5500 NW 17 Avenau,, Miami, Florida..
