I J-95-1042 12/07/95 RESOLUTION NO. rJ _ 853 A RESOLUTION RESCINDING IN ITS ENTIRETY RESOLUTION NO. 95-648, ADOPTED SEPTEMBER 14, 1995; REAFFIRMING THE ACCEPTANCE OF THE ENVIRONMENTAL STUDY PURSUANT TO MOTION NO. 95-699, ADOPTED SEPTEMBER 28, 1995; AUTHORIZING THE CITY MANAGER TO EXECUTE ALL NECESSARY DOCUMENTS, IN A FORM ACCEPTABLE TO THE CITY ATTORNEY, RELATING TO THE DEVELOPMENT OF A 134-UNIT AFFORDABLE HOMEOWNERSHIP HOUSING PROJECT, TO BE KNOWN AS "KNIGHT MANOR HOMES PROJECT", PLANNED FOR DEVELOPMENT BY THE JOINT VENTURE OF THE URBAN LEAGUE OF GREATER MIAMI, INC., AND LHL HOUSING AND DEVELOPMENT, INC., ON AN ELEVEN (11) ACRE PARCEL LOCATED IN THE MODEL CITY NEIGHBORHOOD, AT NORTHWEST 67TH AND 69TH STREETS BETWEEN NORTHWEST 7TH AND LOTH AVENUES, MIAMI, FLORIDA; AUTHORIZING THE CITY MANAGER TO ALLOCATE AND DISBURSE FUNDING FROM THE CITY'S HOME INVESTMENT PARTNERSHIP PROGRAM, IN AN AMOUNT NOT TO EXCEED $50,000, TO THE URBAN LEAGUE TO DEFRAY THE COSTS ASSOCIATED WITH THE PREDEVELOPMENT ACTIVITIES IN CONNECTION WITH SAID DEVELOPMENT; FURTHER AUTHORIZING THE CITY MANAGER TO ALLOCATE AND DISBURSE FUNDING TO THE URBAN LEAGUE, IN THE MANNER PRESCRIBED BY THE CITY'S HOME INVESTMENT PARTNERSHIP PROGRAM, FOR PROJECT DEVELOPMENT AND CONSTRUCTION COSTS IN AN AMOUNT NOT TO EXCEED $4,750,000, OF WHICH $2,375,000 WILL BE MADE AVAILABLE IMMEDIATELY TO THE URBAN LEAGUE FOR PHASE I OF THE DEVELOPMENT, AND THE REMAINING $2,375,000 TO BE MADE AVAILABLE FOR PHASE II AFTER THE -i COMPLETION OF PHASE I. WHEREAS, a severe affordability range of moderate income exii shortage of housing within the families and individuals of low and a .in the City of Miami; and CITY COM USSION MEETING OF DEC 0 7 1995 Resolution No. -9.5- d53 i WHEREAS, the City Commission recognizes that participation of both the public and private sector is necessary to foster the development of housing affordable to low and moderate income families and individuals in the City; and WHEREAS, in May, 1995, LHL Housing and Development, Inc., and the Urban League of Greater Miami, Inc., (the "Joint Venture") submitted a formal application to the City of Miami for funding in the amount of $4,750,000 to be provided in the form of a grant, in connection with the development of a 134-unit affordable housing project on a site located at Northwest 67th and 69th Streets, Miami, Florida; and WHEREAS, after several meetings with representatives of the Joint Venture, the City Administration expressed concerns relative to a portion of the development site perhaps being contaminated with hazardous or toxic materials as a result of a dry cleaning business which had operated near Northwest 7th Avenue between Northwest 67th and 69th Streets, Miami, Florida; WHEREAS, in an effort to address the aforementioned concern, the City Commission recommended that the Joint Venture carry out a study addressing the City's concern relative to the environmental status of the site; and WHEREAS, pursuant to Motion No. 95-699, adopted September 28, 1995, the City Commission accepted the environmental report provided by the Joint Venture indicating that the development site is clear for development; and i WHEREAS, in an effort to move the development of the aforementioned housing project forward, the City Administration 95-- 853 o�r recommends the provision of $50,000 from City HOME Program funds to the Urban League to defray the cost of predevelopment activities in connection with the proposed housing project; and WHEREAS, the City Administration further recommends providing an allocation to the Urban League for project development and construction funding, in an amount not to exceed $4,750,000, from the City's Home Investment Partnership Program and/or the Community Development Block Grant Program; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are hereby adopted by reference thereto and incorporated herein as if fully set forth in this Section. Section 2. Resolution No. 95-648, adopted September 14, 1995, is hereby rescinded in its entirety. Section 3. The acceptance of the environmental study, pursuant to Motion No. 95-699, adopted September 28, 1995, is hereby reaffirmed. Section 4. The City Manager is hereby authorized to allocate and disburse funding from the City's Home Investment Partnership Program, in an amount not to exceed $50,000, to the Urban League of Greater Miami, Inc., to defray the costs associated with the environmental study and predevelopment activities in connection with the development of the proposed Knight Manor Homes Project planned for the development of a 134-unit affordable homeownership housing project on an eleven 3- 95- 853 r� acre parcel located at Northwest 67th and 69th Streets between 7th and 10th Avenues, Miami, Florida, in the Model City Neighborhood (the "Project"). Section 5. The City Manager is hereby further authorized to allocate and disburse funding, in the manner prescribed by the City's Home Investment Partnership Program, to the Urban League, in an amount not to exceed $4,750,000, of which $2,375,000 for Phase I of the Project will be made immediately available in view of the environmental study accepted by the Commission on September 28, 1995, indicating that the development site is clear for construction, with the remaining $2,375,000 to be made available upon successful completion of Phase I of the subject Project. Section 6. The City Manager is hereby authorized) to execute the necessary documents, in forms acceptable to the City Attorney, to implement said Project. Section 7. (joint venture partner), the City Administration expressed concerns relative to the economic/market feasibility of developing approximately 96 townhome units and 38 single family homes on the eleven (11) acre tract in the price range of $80,000 - $9a,o00; and WHEREAS, City staff has also expressed concerns relative to a portion of the development: site perhaps being contaminated with hazardous or toxic materials as a result of a dry cleaners business which previously operated near Northwest 7th Avenue between Northwest 67th and 69th Streets, Miami, Florida;.and WHEREAS, in an effort to address the aforementioned concerns prior to the City of Miami making any firm commitments for project funding/financing in connection with the proposed Knight Manor Homes Project, the City Administration has recommended that - 2 - , 95- 853 the Urban League of Greater Miami, Inc. carry ou,: :;everal predevelopment activities in order to further assist th:� City in assessing the economic feasibility of the proposed project, in addition to addressing the city's concerns relative to the environmental status of the site; and WHEREAS, in an effort to move the development of the aforementioned housing project forward, the City Administration recommends the provision of $50,000 in City HOME Program funds to defray the cost of predevelopment activities in connection with the proposed housing project; and WHEREAS, the City Administration further recommends providing a preliminary allocation for project construction funding, in an amount not to exceed $2, 375., 000•, over a two year period.from the City's Home Investment Partnership Program and/or Community Development Block Grant Program, subject to the Urban League of Greater Miami, Inc. securing additional project funding commitments in an equal amount from Metropolitan Dade County and/or the State of Florida; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The City Manager is hereby authorized to allocate and disburse funding from the City's home Investment Partnership Program, in an amount not to exceed $50,00o, to the Urban League of Greater Miami, Inc. to defray the costs associated with the predevelopment activities in'connection with the development of the proposed Knight Manor Homes Project, a 90 unit- affordable Homeownership Housing Project planned for development on an eleven acre parcel located at Northwest 67th and 69th Streets between 7th and.10th Avenues in the Model City Neighborhood, Miami, Florida. Section 3. The City Manager is hereby authorized to allocate funding as a preliminary commitment for project construction, in an amount not to exceed $2,375,000, over a two (2), year period from the Citys Home Investment Partnership Program and/or Community Development Block Grant Program, subject to the Urban League of.. Greater Miami, Inc. securing additional project funding commitments in an equal amount from Metropolitan Dade County and/or the State of Florida, and a satisfactory resolution of any environmental issues associated with the development site. Section 4. The City Manager is hereby authorized/ to execute the necessary documents, in a form acceptable to the City Attorney, to implement said allocations for said project. i/ The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter and Code provisions. 4 _ 95- 853 4 become, effective immediately upon its adoption.
