RESOLUTION NO. 95- 828
A RESOLUTION, WITH ATTACHMENTS, GRANTING
FINAL APPROVAL OF THE LANDSCAPING PLAN,
ATTACHED HERETO AND MADE A PART HEREOF AS
EXHIBIT "A", AND DIRECTING THE CITY MANAGER
TO INSTRUCT THE DIRECTOR OF THE DEPARTMENT OF
COMMUNITY PLANNING AND REVITALIZATION TO
PROCESS CLASS II SPECIAL PERMIT NO. 95-2934,
PURSUANT TO SECTION 613.3 OF THE ZONING
ORDINANCE OF THE CITY OF MIAMI, FLORIDA, FOR
DEVELOPMENT WITHIN THE SD-13 SOUTHWEST 27TH
AVENUE GATEWAY DISTRICT, FOR THE PROPERTY
LOCATED AT 3049-3053 SOUTHWEST 27TH AVENUE,
MIAMI, FLORIDA, SUBJECT TO THE CONDITIONS SET
FORTH ON EXHIBIT "B" ATTACHED HERETO AND MADE
A PART HEREOF.
WHEREAS, Section 613.3.1 of Ordinance No. 11000, as amended,
the Zoning Ordinance of the City of Miami, Florida, requires a
Class II Special Permit before a building permit may be issued
within the boundaries of the SD-13 Zoning District; and
WHEREAS, said Section 613.3.1 also requires a review by the
City Commission of the landscaping plans in conjunction with the
issuance of a Class II Special Permit in the SD-13 Southwest 27th
Avenue Gateway District; and
WHEREAS, the owners of the property at 3049-3053 Southwest
27th Avenue, Miami, Florida, which is located within the SD-13
Southwest 27th Avenue Gateway Zoning District, wish to develop
said property; and

WHEREAS, the City Commission, after careful consideration of
this matter, deems it advisable and in the best interest of the
general welfare of the City of Miami and its residents to grant
final approval of the proposed landscaping plan and to direct the
City Manager to instruct the Director of the Department of
Community Planning and Revitalization to process the herein Class
II Special Permit;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the
Preamble to this Resolution are hereby adopted by reference
thereto and incorporated herein as if fully set forth in this
Section.
Section 2. The City Commission, after having reviewed
the proposed landscaping plan, for the subject property, attached
hereto and made a part hereof as Exhibit "A", hereby grants its
final approval, and directs the City Manager to instruct the
Director of the Department of Community Planning and
Revitalization to process Class II Special Permit File No. 95-
2934, pursuant to Section G13.3 of Ordinance No. 11000, as
amended, the Zoning Ordinance of the City of Miami, Florida, for
development within the SD-13 Southwest 27th Avenue Gateway
District, for the property located at 3049-3053 Southwest 27th

Avenue, Miami, Florida, more particularly described as Lots 9 and
10, Block 12 of SAMUEL RHODES AMENDED PLAT OF NEW BISCAYNE,
according to the Plat thereof, as recorded in Plat Book "B" at
Page 16 of the Public Records of Dade County, Florida, subject to
the conditions set forth on Exhibit "B" attached hereto and made
a part hereof.
Section 3. This Resolution shall become effective
immediately upon its adoption.

CONDITIONS REQUIRED FOR SPECIAL EXCEPTION
FOR THE PROPERTY LOCATED AT
3049-3053 S.W. 27TH AVENUE, MIAMI, FLORIDA
1. The carrot wood trees depicted on the landscaping
plan described as Exhibit "A" to the Resolution
approving the same, ("Exhibit A") in conjunction
with the issuance of Class II Special Permit
No. 95--2934, for the referenced property shall be
replaced with native trees such as live oaks,
mahoganies, gumbo limbos and green or silver
buttonwood trees as may be approved by the
Department of Community Planning and
Revitalization;
2. With reference to Exhibit A, additional native
vegetation shall be accommodated toward the front
of the property, facing S.W. 27th Avenue; said
landscape shall be located in a manner designed to
discourage parking in the swale area;
3. The dumpster .for the project shall be of a
sufficient size to accommodate the density of the
complex and shall be located so as to not be
visible from the street and in such a manner that
it can be serviced.

ENCLOSURES
It is respectfully recamnended that the City Commission approve the attached
Class II Special Permit for the landscape plan in connection with the new
construction of a five story, 30 unit residential development proposed at
3049-53 S.W. 27th Avenue; said approval should be conditioned on the
following: 1) the depicted carrot wood trees should be replaced with native
trees such as live oaks, mahoganies, gumbo limbos and green or silver
buttonwood trees; 2) additional native vegetation should be accommodated
toward the front of the property, facing S.W. 27th Avenue; said landscape
should specifically be placed in a manner to discourage parking in the swale
area; and 3) the dumpster for the project should be of a sufficient size to
acccmTodate tl>e density of the complex and should be located so as to not be
visible from the street and in a manner in which it can be serviced without
obstructing the adjacent sidewalk.
On August 16, 1995, the Director of the Department of Comrunity Planning and
Revitalization accepted an application for Class II Special Permit #95-2934
for the new construction of a five story, 30 unit residential development to
be located at 3051 S.W. 27th Avenue. The subject property is located within
the SD-13 S.W. 27th Avenue Gatevray District; Section 613.3 of the Zoning
Ordinance specifies that a Class II Special Permit shall be required for any
landscape plan within this district, with final approval by the City
Commission.
The Department of Community Planning and Revitalization is recommending
approval of the submitted landscape plan, with the following conditions: 1)
the depicted carrot wood trees should be replaced with native trees such as
live oaks, mahoganies, gumbo limbos and green or silver buttonwood trees; 2 )
additional native vegetation should be accdated toward the front of the

property, facing S.W. 27th Avenue; said landscape should specifically be
placed in a manner to discourage parking in -the swale area; and 3) the
dumpster for the project should be of a sufficient size to acccxmx)date. the
density of the complex (approval of durripster size shall be subject to the
Division of Solid Waste) and should be located so as to not be visible from
the street and in a manner in which it can be serviced without obstructing the
adjacent sidewalk.
A final site and landscape plan as well as a mvmorandum from the Solid Waste
Division, which ccntplies with the above referenced conditions should be
submitted to the Director of the Dent of ComTuuty Planning and
J J Revitalization prior to the issuance of the Class II Special Permit.
The recommendation for approval of Class II Special Permit #95-2934 is based
on findings that upon compliance with the conditions specified herein,, the
proposed project will be in compliance with the criteria specified in Article
13, Section 1305, and Article 6, Section 613, of Zoning Ordinance 11000, as
amended.

This permit shall expire one year from the ate of its approval.
Any project requiring a Class II Special Permit must first be reviewed by
the Building and Zoning Division (2nd Floor) to insure that each project
conforms to all. zoning requirements. Therefore, this form must be signed
by the Chief Zoning Inspector before the project will be considered for
final approval by the Director of the Planning, Building and Zoning
Department. Both pages must be completed prior to granting of a permit.

The following comments are in refcrernce to the Class IT application for the subject
property.
• The landscaping proposed for the development is insufficient. The tabulation for
project areas does not show a total for the green space required. Please advise if the
total landscaping for the proposed project meets the zoning requirements. In
reference to the tree types, it is recommended that the carrot wood trees suggested by
the developer be changed to native trees sucb as mahogany, live oak, gumbo limbo,
green or silver buttonwood trees. It would also be an enbanccrnent to 27th Avenue if
the developer would include more. vegetation to the front of the property, particularly
in the swale area to discourage parking.
• In reference to the dumpster area, please ensure that the dumpster is sufficient for the
size of the development, not visible from tiie street, and can be accessed by the
service trucks without obstructing the Sidewalk.
