HomeMy WebLinkAboutR-95-0825J-95-1012 11/16/95 95-- 825 RESOLUTION NO. A RESOLUTION RELATED TO THE KING ORANGE BOWL JAMBOREE PARADE TO BE CONDUCTED BY THE ORANGE BOWL COMMITTEE, INC. ("THE COMMITTEE") ON DECEMBER 31, 1995, PROVIDING FOR THE CLOSURE OF DESIGNATED STREETS TO THROUGH VEHICULAR TRAFFIC AND ESTABLISHING A PEDESTRIAN MALL SUBJECT TO THE ISSUANCE OF REQUIRED PERMITS BY THE POLICE DEPARTMENT AND OTHER DEPARTMENTS REGULATING SUCH EVENTS; FURTHER, ESTABLISHING AN AREA PROHIBITED TO RETAIL PEDDLERS DURING THE PERIOD OF THE EVENT; SUBJECT TO AND CONTINGENT UPON THE COMMITTEE'S COMPLIANCE WITH SUCH CONDITIONS AND LIMITATIONS AS MAY BE PRESCRIBED BY THE CITY OF MIAMI, INCLUDING OBTAINING INSURANCE TO PROTECT THE CITY IN AN AMOUNT AND FORM AS PRESCRIBED BY THE CITY MANAGER OR HIS DESIGNEE. WHEREAS, the Orange Bowl Committee, Inc. ("The Committee") will conduct the King Orange Bowl Jamboree Parade ("Parade"), on December 31, 1995; and WHEREAS, certain streets shall be closed to vehicular traffic and vending restrictions shall apply during specified dates and hours to help ensure the safety of the participants and pedestrians attending this event; and WHEREAS, the City Commission, by Motion No. 88-452, adopted May 12, 1988, authorized a change to the historical route of the Parade and the use of Bicentennial Park and the Florida East Coast ("FEC") property as staging and viewing sites; and CITY COVMSSION A%EEMIG OF Resolution No. �I 95- 825 If WHEREAS, the City Commission, by Resolution No. 91-916, adopted December 5, 1991, authorized the City Manager to enter into a five (5) year agreement with The Committee for the staging of its annual Parade; and WHEREAS, the City Code, Chapter 39, Article II, specifically provides, inter alia, that Street Vending Franchises in the Downtown Miami Special Vending District may be displaced during designated special events occurring in the area; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are hereby adopted by reference thereto and. incorporated herein as if fully set forth in this Section. Section 2. In order to effectuate safe passage and establish a temporary pedestrian mall during the King Orange Bowl Jamboree Parade, the following streets are hereby closed to through vehicular traffic from 6:00 p.m. to 11:00 p.m. on Sunday, December 31, 1995, as specified below: Biscayne Boulevard from Northeast 13th Street to East Flagler Street. Flagler Street from Biscayne Boulevard to North River Drive. Northeast llth Terrace from Northeast 2nd Avenue to Biscayne Boulevard. Entrance ramp to eastbound I-395 from Biscayne Boulevard at Northeast 11th Terrace. North River Drive from Southwest 2nd Avenue to Northwest 5th Street. -z- 95- 825 South River Drive from Southwest 2n.d Avenue to Northwest 5th Street. Included in the herein closure are all streets, avenues, alleys, ways and thoroughfares which intersect the enumerated areas delineated in this Section. Section 3. Such closing of streets is subject to requisite State approval and issuance of permits by the Police Department, Fire, Rescue and Inspection Services Department, and such other departments as may be specified in the City Code. Said permit from the Department of Police is to be issued upon the full approval of the Chief of Police after giving all due consideration to the safety and traffic needs of residents, businesses, and religious institutions in the area for entering and crossing through said arterials and upon the favorable exercise of the City Manager's judgment predicated upon all factors set forth herein. Section 4. Pursuant to the provisions of City Code Sections 39-13 and 39-17(5)c.6, all retail peddlers' occupational licenses issued under the provisions of Chapters 31 and 39 of the City Code, as amended, shall not be valid on Sunday, December 31, 1995, during the hours of 12:00 a.m, to 11:00 p.m. on the above designated streets and on all intersecting streets for two blocks in all directions ("Designated Area"). In the Designated Area, only business entities duly licensed by the City specifically for this event will be permitted to advertise their .3. 95- 825 products, sell their products, or distribute free samples to the public. Section 5. The aforementioned authorizations are hereby subject to and contingent upon The Committee's compliance with any and all conditions and limitations as may be prescribed by the Administration of the City of Miami, including obtaining insurance to protect the City in the amount and form as prescribed by the City Manager or his designee. Section G. This Resolution shall become effective immediately upon its adoption. PASSED AND ADOPTED this 16th day of November 1995. STEP EN P.
