A RESOLUTION AUTHORIZING AN INCREASE, IN AN AMOUNT NOT TO EXCEED $76,000.00, IN THE CONTRACT BETWEEN THE CITY OF MIAMI, FLORIDA, AND CONE CONSTRUCTORS, INC., DATED JUNE 2, 1993, FROM $3,229,899.02 TO $3,305,899.02, FOR DIiv'NER KEY MARINA RESTORATION, PHASE II - PIERS AND BAYWALK, PROJECT H-10008; ALLOCATING FUNDS THEREFOR FROM DINNER KEY MARINA REVENUE ACCOUNT NO. 41000, CAPITAL IMPROVEMENT PROJECT NO. 414503. WHEREAS, there exists a contract dated June 2, 1993 between the City of Miami, Florida, and Cone Constructors, Inc., for construction of Dinner Key Marina Restoration, Phase II, H-1008, Capital Improvement Project No. 414503; and WHEREAS, the increase in the contract will not exceed $76,000.00 and is required to cover the cost of delays resulting in extended field and home office charges; and WHEREAS, the Director of Public Works and the City Manager recommend the increase in said contract to cover the additional costs; and WHEREAS, funds to cover the increase are available in Dinner Key Marina Revenue Account No. 41000, Capital Improvement Project No. 414503; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: .CITY CCZ MISSION MEETING OF NOV 1 6 1995 Resolution No. gar- 808 Section 1. The recitals and findings contained in the Preamble to this Resolution are hereby adopted by reference thereto and incorporated herein as if fully set forth in this Section. Section 2. An increase in the contract between the City of Miami and Cone Constructors, Inc., dated June 2, 1993, in an amount not to exceed $76,000.00, thereby increasing said contract from $3,229,899.02 to $3,305,899.02, for Dinner Key Marina Restoration, Phase II, H-1008, is hereby authorized, with funds therefor hereby allocated from the Dinner Key Marina Revenue Account No. 41000, Capital Improvement Project No. 414503. BACKGROUND The City Commission awarded a contract to Cone Constructors, Inc. for the complete repair of hurricane damaged piers at Dinner Key Marina. Also included in the work were repairs to landside facilities for the Baywalk, Vacuum Sewer Building and related equipment. The contract called for the Contractor to remove and re -install utility pedestals and light pedestals being refurbished by another supplier under a separate contract with the City. During the re -construction of the piers, the supplier of the refurbished pedestals was unable to meet Cone Constructor's delivery schedule on some piers. Deliveries lagged because of the greater damage to the pedestals than originally anticipated by visual inspection and there was greater difficulty in getting replacement parts and accessories due short supply after the Hurricane. Additionally, after the sewer plant was repaired, the vacuum sewer valve assemblies were found to have sustained severe corrosion from submersion in salt water. There were 113 vacuum sewer valves affected. The City made application to FEMA for the eligibility of the costs of said valve replacements. Initially FEMA disapproved reimbursement but after the City's appeal, they subsequently approved it. FEMA approvals for these items were not timely and required that Cone Constructors, Inc. remain at the job site awaiting receipt of the Utility and Light Pedestals and Vacuum Sewer Valves. These delays resulted in extended field and home office cost by the contractor of $76,000.00. Funds for the increase in costs by the contractor are available from Dinner Key Marina Revenue Account No. 41000. The Public Hearing has been scheduled for November 16, 1995• v l� CITY OF MIAMI, FLORIDA NOTICE TO THE PUBLIC A public hearing will be held by the commission of the City of Miami, Florida, on November 16, 1995, at 9:00 a.m. in the City Commission Chambers at City Hall, 3500 Pan American Drive, Miami, Florida, for the purpose of hearing any objections from any interested parties affected by an increase in the contract between Cone Construction, Inc. and the City of Miami in an amount not to exceed $76,000 for Dinner Key Marina Restoration Phase 2-Piers & Baywalk, Project H-1008 for Hurricane Repairs, C.I.P. Nos. 414501 and 414005. All interested persons are invited to appear and may be heard concerning these items. Should any person desire to appeal any decisions of the City Commission with respect to any matter considered at this hearing, that person shall ensure that a verbatim record' of thF proceeding is made, including all testimony and evidence upon which any appeal may be based.
