A RESOLUTION, BY A 4/5THS AFFIRMATIVE VOTE OF
THE MEMBERS OF THE CITY COMMISSION, AFTER A
DULY ADVERTISED PUBLIC HEARING, RATIFYING,
APPROVING AND CONFIRMING THE CITY MANAGER'S
FINDING OF SOLE SOURCE; VdAIVING THE
REQUIREMENTS FOR COMPETITIVE SEALED BIDS AND
APPROVING THE ENGAGEMENT OF MOTOROLA, INC.,
FOR THE RELOCATION OF THE CITY'S 800 MHz
SMARTNET TRUNKED COMMUNICATIONS SYSTEM, AT A
PROPOSED COST OF $518,1G0, FOR THE DEPARTME14T
OF GENERAL SERVICES/COMMUNICATIONS DIVISION;
ALLOCATING FUNDS THEREFOR FROM THE CAPITAL
IMPROVEMENT PROGRAM, ACCOUNT CODE NO.
429402-340-311018; AUTHORIZING THE CITY
MANAGER TO INSTRUCT THE CHIEF PROCUREMENT
OFFICER TO ISSUE A PURCHASE ORDER FOR THIS
SERVICE.
WHEREAS, the Department of General Services
Administration/Communications Division, needs to relocate its 800
MHz radio communications system and equipment from its present
location within the section of the Municipal Shop Tract that was
sold to Jackson Memorial Hospital; and
WHEREAS, relocation efforts consist of moving the back-up
transmit site to a new location; and
WHEREAS, this effort can be done only by Motorola, Inc., to
preserve the quality and reliability of the operation, and all
written documentation concerning this technology is proprietary
and confidential to Motorola, Inc.; and

WHEREAS, funds for said services are available from the
Capital Improvement Program, Account Code No. 429402-340, Project
No. 3110181; and
WHEREAS, the Chief Procurement Officer has adopted a finding
that Motorola, Inc., is the sole source provider for the
relocation of the above communications system as requested by the
Department of General Services Administration/Communications
Division; and
WHEREAS, the findings of the Chief Procurement Officer have
been approved and adopted as the findings of the City Manager;
and
WHEREAS, the City Manager and the Chief Procurement Officer
recommend that the requirements for competitive formal sealed
bids be waived and the acquisition of services for the relocation
of the communications system by Motorola, Inc., the sole source
provider, be approved;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the
Preamble to this Resolution are hereby adopted by reference
thereto and incorporated herein as if fully set forth in this
Section.
Section 2. By a 4/5ths affirmative vote of the members
of the City Commission, after a duly advertised public hearing,
the City Manager's finding that Motorola, Inc., is the sole
source provider of the services required to relocate the City's
800 MHz Smartnet Trunked Communications System required by the

Division, is hereby ratified, approved, and confirmed.
Section 3. The requirements for, competitive sealed bids
is hereby waived and the Department of General Services
Administration/Communications Division request for the
acquisition of relocation services for the City's 800 MHz
Smartnet Trunked Communications Systems from Motorola, Inc., is
hereby approved, with funds therefor hereby allocated from the
Capital Improvement Program, Account Code No. 429402-340, Project
No. 311018.
Section 4. The City Manager is hereby authorized to
instruct the Chief Procurement Officer to issue a purchase order
for this service.
Section 5. This Resolution shall become effective
immediately upon its adoption.

It is respectfully recommended that the City Commission approve
the waving of the requirements for competitive sealed bids and
award the sole source procurement of technical services for the
relocation and upgrade of the City of Miami 800 MHz
communications system to Motorola, Inc., located at 5580 N.W.
36th Avenue, Suite A, Ft. Lauderdale, Florida, at a total
proposed cost of'$518,160. Funds are available from the Capital
Improvement Program, Account Code No. 429402-340, Project Code
No. 311018.
BACKGROUND:
The Department of General Services Administration and Solid
Waste, Communication Services Division, needs to relocate the
City's radio communication system and associated equipment from
its present location within the section of the Municipal Shop
Tract that was sold to Jackson Memorial Hospital.
Site must be vacated by December 31, 1995, otherwise
significantly high contractual penalties could be incurred.

An investigation was conducted by the Procurement Management staff to determine whether
Motorola, Inc. a non-minority/non-local vendor is the sole source vendor able to dismande,
transport, rebuild, recalibrate and upgrade the City's 800 MHz Smartnet Trunked Systems, which
was exclusively designed and built by Motorola, Inc.
The relocation efforts consists of moving the back up transmit site to a new iocation. Motorola,
Inc. Is the sole manufacturer of the existing 800 MHz radio system. The engineering, original
design and Installation of the system was executed by Motorola, inc. in addition, the operating
and maintenance software for the system is proprietary to Motorola, inc.
Accordingly, I am recommending that the requirements for competitive bidding be waived and the
above Findings be approved that Motorola, Inc. is the sole source supplier of the requested
services.

NOTICE OF PUBLIC HEARING
A public hearing will be held by the City Commission of the City
of Miami, Florida on November 16, 1995, at AM in the City
of Miami Commission Chambers at City Hall, 3500 Pan American Drive,
Miami, Florida, for the purpose of considering a waiver of the
requirements of obtaining sealed bids for the engagement of Motorola,
Inc., subject to finding of sole source by the Chief Procurement
Officer, confirmed by the City Manager, to provide for the relocation
and upgrade of the City's 800 MHz radio communications system for the
Department of General Services/Solid Waste, Communication Services
Division, at a total proposed cost of $518,160.
Inquiries from other potential sources of providers who feel that
they might be able to satisfy the City's requirements in 'the provision
of these services may contact Luis Selema, Communication Services
Division, at (305) 575-5188.
All interested persons are invited to appear and may be heard
concerning such proposed waiver for purchase and upgrade. Should
any person desire to appeal any decision of the City Commission with
respect to any matter considered at this hearing, that person shall
ensure that a verbatim record of the proceedings is made, including
all testimony and evidence upon which any appeal may be based.
