PROPOSED COST OF $5,440.00, FOR THE DEPARTMENT OF FIRE -RESCUE; ALLOCATING FUNDS THEREFOR. FROM THE SOUTH FLORIDA URBAN SEARCH AND RESCUE TASK FORCE ACQUISITION FUND, CAPITAL IMPROVEMENT PROJECT NO. 313825, ACCOUNT CODE NUMBER 802801-840; AUTHORIZING THE CITY MANAGER TO INSTRUCT THE CHIEF PROCUREMENT OFFICER TO ISSUE A PURCHASE ORDER FOR THIS EQUIPMENT. WHEREAS, the Fire -Rescue Department needs to purchase these Medical Back Packs to be used for disaster response activities; and WHEREAS, the City of Miami Department of Fire -Rescue on behalf of the Florida Urban Search and Rescue Task Force has been awarded a grant to purchase specific equipment and supplies to be used for disaster response activities and timely expenditure of the allocated funding is desirable; and WHEREAS, the purchase of the recommended equipment will not only enhance the capabilities of the South Florida Urban Search and Rescue Task Force to respond to disasters, but additionally increase the local capability of the City of Miami Department of Fire -Rescue and the organizations participating in the disaster response program; and CITY CQMMISsioN MEETING or N O V '! I~1 IT1 Aesolution No, 95- 804 WHEREAS, said equipment will be acquired through Q-Systems International, the only vendor to meet FEMA requirements, and funds are available from the South Florida Urban Search and Rescue Task Force Acquisition Fund Capital Improvement Project No. 313825, Account Code No. 802801-840; and WHEREAS, the Chief Procurement Officer has adopted a finding that Q-Systems International is the sole source provider of the Medical Back Packs requested by the Department of Fire -Rescue; and WHEREAS, the findings of the Chief Procurement Officer have been approved and adopted as the findings of the City Manager; and WHEREAS, the City Manager and the Chief Procurement Officer recommend that the requirements for competitive formal sealed bids be waived and the acquisition of the Medical Back Packs from Q-Systems International, the sole source provider, be approved; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are hereby adopted by reference thereto and incorporated herein as if fully set forth in this Section. Section 2. By a 4/5ths affirmative vote of the members of the City Commission, after a duly advertised public hearing, the City Manager's finding that Q-Systems International is the sole source provider of a Medical Back Pack required by the Department of Fire -Rescue, is hereby ratified, approved and confirmed, Section 3. The requirements for competitive sealed bids is hereby waived and the Department of Fire -Rescue's request for the acquisition of eight (8) Medical Back Packs from the above sole source provider is hereby approved, with funds therefor -2- 95-- 804 `Pq9 hereby allocated, in a total proposed amount of $5,440.00, from the South Florida Urban Search and Rescue Task Force Acquisition Fund, Capital Improvement Project No. 313825, Account Code No. 802801-840, i Section 4. The City Manager is hereby authorized to instruct the Chief Procurement Officer to issue a purchase order for this equipment. Because timely expenditure of the allocated funding is desirable, and the recommended vendor was the only vendor to meet the FEMA requirements, this recommendation is made. Cart Chief Procur m t Officer ENCLOSURES An investigation was conducted by the Procurement Management staff to determine whether Q- International, Inc. a non-minority/non-local vendor of Arlington Texas is the sole source supplier of the Back Packs as requested by the Department of Fire- Rescue. Several sporting good vendors such as Sports Authority, Sportsman Paradise, All Sport Equipment, Campground USA, Camp Basics International and Military Pursuit, Inc. None of them distributed or manufactured the requested Back Packs(MECS 2000) The requested back packs and Q-Systems International, Inc. have met FEMA requirements for the Urban Search and Rescue Task Force. According to Edwin Hodges, President of Q-Systems International, Inc. (see attached letter) they are the sole manufacturer and supplier of the Back Pack(MECS 2000) an owns the applicable copyrights and patents to these systems.
