A RESOLUTION, BY A FOUR -FIFTHS (4/5THS) AFFIRMATIVE VOTE OF THE MEMBERS OF THE CITY COMMISSION, WAIVING FORMAL COMPETITIVE BIDDING PROCEDURES FOR EMERGENCY REPAIRS AT DOUGLAS PARK TO CORRECT MAJOR ELEVATION DIFFERENCES AND ACCESSIBILITY PROBLEMS DUE TO GROUND SETTLEMENT; AUTHORIZING THE CITY MANAGER TO AWARD A CONTRACT AS EXPEDITIOUSLY AS PRACTICABLE AND To INSTRUCT THE CHIEF PROCUREMENT OFFICER TO ISSUE A PURCHASE ORDER FOR SAID REPAIRS; FURTHER, ALLOCATING FUNDS THEREFOR, IN AN AMOUNT NOT TO EXCEED $70,000, FROM AN ACCOUNT TO BE IDENTIFIED BY THE CITY MANAGER. WHEREAS, the settlement of the ground around the tennis courts and recreation building at Douglas Park over the past forty years has created elevation changes and caused access problems to said facilities; and WHEREAS, the recreation building is used as a daycare center and voting precinct, as well as for many sports and other activities; and WHEREAS, it is necessary for the City Commission to waive formal competitive procedures in order to repair said elevation and access problems due to said settlement as soon as possible; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: CITY COV94ISSION MEETING OF OCT 2 6 1995 Resolution No. 95- 762 Section 1. The recitals and findings contained in the Preamble to this Resolution are hereby adopted by reference thereto and incorporated herein as if fully set forth in this Section. Section 2. By a four -fifths (4/5ths) affirmative vote of the members of the City Commission, formal competitive bidding procedures are hereby waived for emergency repairs at Douglas Park to correct major elevation differences and accessibility problems due to ground settlement, with funds therefor, in an amount not to exceed $70,000 hereby allocated from an account to be identified by the City Manager for said repairs. Section 3. The City Manager is hereby authorized to award a contract as expeditiously as practicable and to instruct the Chief Procurement Officer to issue a purchase order for said repairs. Section 4. This Resolution shall become effective immediately upon its adoption. PASSED AND ADOPTED this 26th day of October 1995. s JAESIT: STEEMEN P.
