A RESOLUTION, WITH ATTACHMENT, MAKING FINDINGS, AND DIRECTING THAT CERTAIN PERMANENT BARRICADES IN THE MORNINGSIDE NEIGHBORHOOD IN THE CITY OF MIAMI, Fl-ff IDA, IN ACCORDANCE WITH AMENDED PLAN "B"- , BE DESIGNATED NON -EMERGENCY TYPE ACCESS BARRICADES; AND DIRECTING THE ELIMINATION OF THE CONDITION THAT ACCESS FOR EMERGENCY VEHICLES BE ALLOWED AT ALL TIMES THROUGH SAID BARRICADES, SUBJECT TO THE APPROVAL OF THE METROPOLITAN DADE COUNTY TRAFFIC DIRECTOR. WHEREAS, on September 11, 1991, the City Commission adopted Resolution No. 91-667 directing the permanent prohibition of vehicular access to certain streets in the Morningside neighborhood in accordance with Amended Plan subject to certain conditions; and WHEREAS, a condition of approval of said prohibition of vehicular access is that access for emergency vehicles be allowed at all times through said barricades; and WHEREAS, at the May 11, 1995 City Commission meeting, representatives of the Morningside Civic Association requested a change In designation of the permanent street closures from emergency access street closures to non -vehicular access street closures; and Amended Plan "B" is attached for reference. ATTAR' �R bI�';�a ;r ,-.o.�� CITY COi,ZTZSSIOAT MEETING OF OCT 2G195 Isalu7 3 9 52 WHEREAS, the Police Department, Fire Rescue and Inspection Services Department, General Services Administration/Solid Waste Department have re-evaluated the effects of the permanent vehicular access restrictions upon thier respective operations during the time the permanent barricades have been in place and have expressed no substantial objections to the elimination of the condition that access for emergency vehicles be allowed at all times through any of the barricades contained in said Amended Plan "B"; and WHEREAS, pursuant to due public notice, a public hearing was held before the City Commission on September 14, 1995 as to any objections to the elimination of the condition that access for emergency vehicles be allowed at all times through any of the barricades contained in said Amended Plan "B" and no objections of substance were sustained by the Commission; and WHEREAS, the City Commission finds that the herein elimination of the condition that emergency vehicle access at all times through all of the barricades contained in said Amended Plan "B" is in the best Interest of the public; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings set forth in the Preamble to this Resolution are hereby adopted by reference and Incorporated herein as If fully set forth in this Section. Section 2. it is hereby directed that all permanent vehicular access restriction barricades contained In City of Miami Resolution No. 91-667, in accordance with Amended Plan "B", be designated non -emergency type access barricades. - 2 - 95- 732 Section 3. It is hereby directed that the condition that access for emergency vehicles be allowed at all times through said barricades be eliminated, subject to the approval of the Metropolitan Dade County Traffic Director. ENCLOSURES Resolution It is respectfully recommended that the City Commission adopt the attached Resolution formalizing Motion No. 95-379 concerning the elimination of the condition that access for emergency vehicles be allowed at all times through the approved permanent barricades In the Morningside neighborhood. BACKGROUND: On September 11, 1991, the City Commission adopted Resolution No. 91-667 directing the permanent prohibition of vehicular access to certain streets In the Morningside neighborhood. A condition of the approval of the barricade plan Is that access for emergency vehicles be allowed at all times through the barricades. At the May 11, 1995 commission meeting, representatives of the Morningside Civic Association requested a change In designation of the permanent street closures from emergency access street closures to non -vehicular access street closures. The Police Department, Fire, Rescue and Inspection Services Department and Solid Waste Division expressed no objections to this request and the City Commission adopted Motion No. 95-379 granting the Morningside Civic Association's request that certain barricades within their neighborhood be designated as non -emergency vehicular type access barricades.
