A RESOLUTION TO RESTRICT VEHICULAR ACCESS TO N.E. 55 TERRACE AT ITS INTERSECTION WITH THE EAST SIDE OF NORTH BAYSHORE DRIVE IN THE CITY OF MIAMI, FLORIDA, SUBJECT TO THE PROVISIONS CONTAINED WITHIN THIS RESOLUTION. WHEREAS, N.E. 55 Terrace between North Bayshore Drive and Biscayne Bay is a public right of way developed as an entrance road to the City of Miami Morningside Park; and WHEREAS, N.E. 55 Terrace is insufficiently developed to safely accommodate vehicular parking; and i I WHEREAS, a majority of property owners abutting N.E. 55 Terrace have expressed concern about unsafe conditions and, illegal activities occurring within this right of way and have i requested the City to restrict vehicular access to N.E. 55 Terrace at its intersection -with the east side of North Bayshore Drive; and WHEREAS, the Police Department, Fire, Rescue and Inspection Services Department and General Services Administration/Solid" i Waste Department and Public Works 'Department have been notified of the proposed vehicular access restriction of N.E. 55 Terrace and have expressed no substantial objection to the restriction of vehicular access to N.E. 55 Terrace at its intersection with the east side of North Bayshore Drive; and RESCINDED CITY COMIIZI "oSION MEETING OF OCT 26 10,15 Resolution 'N)(o.. /y 95- O WHEREAS, the proposed vehicular access restriction shall be accomplished by the placement of a fence with a swing gate across N.E. 55 Terrace at its intersection with the east side of North Bayshore" Drive and all locking control and hours of operation shall be maintained by the City of Miami; and WHEREAS, Section 54-17 of the Code of the City of Miami, Florida, gives the City Commission the power, after a properly advertised public hearing, to recommend that vehicular access to a particular street be prohibited at an intersection where such prohibition is found to be in the best interest of the public; and WHEREAS, pursuant to due public notice, a public hearing was held before the City Commission on this date as to any objections to the implementation of prohibition of vehicular access to N.E. 55 Terrace at its intersection with the east side of North Bayshore Drive and no objections of substance were sustained by the City Commission; and WHEREAS, the City Commission finds that the herein prohibition is in the best interest of the public; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings set forth in the Preamble to this Resolution are hereby adopted by reference thereto and incorporated herein as if fully set forth in this Section. - 2 95 - 731 Section 2. The restriction of vehicular access to N.E. 55 Terrace at its intersection with the east side of North Bayshore Drive in the City of Miami, Florida, is hereby authorized and permitted, subject to the following conditions: (a) the Department of Public Works shall design the temporary fence and swing gate to prohibit vehicular access; (b) the locking control and hours of operation of the swing gate shall be maintained by the City of Miami; Section 3. BACKGROUND N.E. 55 Terrace between North Bayshore Drive and Biscayne Bay is a public right of way developed to serve as an entrance to the City's Morningside Park. The roadway is insufficiently improved to provide adequate and safe parking or other public amenities. The property owners in the Morningside neighborhood and Morningside Park staff have expressed concerns about loitering, parking in the grass swales, dumping of trash and illegal activities occurring at the easterly end of N.E. 55 Terrace, especially during the hours when Morningside Park is closed.
