HomeMy WebLinkAboutR-95-0709J-95-724(a) 09/12/95 RESOLUTION NO 9 5_ 7 0 9 A RESOLUTION AFFIRMING THE DECISION OF THE ZONING BOARD TO GRANT A SPECIAL EXCEPTION FROM THE ZONING ORDINANCE OF THE CITY OF MIAMI, FLORIDA, ARTICLE 4, SECTION 401, SCHEDULE OF DISTRICT REGULATIONS, C-1 RESTRICTED COMMERCIAL, PERMITTED PRINCIPAL USES, TO ALLOW A FINANCIAL DRIVE -THROUGH FACILITY FOR THE PROPERTY LOCATED AT 600 SOUTHWEST 27TH AVENUE, MIAMI, FLORIDA, ZONED C-1 RESTRICTED COMMERCIAL, PER PLANS ON FILE, SUBJECT TO A TIME LIMITATION OF 12 MONTHS IN WHICH A BUILDING PERMIT MUST BE OBTAINED AND, FURTHER, TO THE FOLLOWING CONDITIONS: (1) A LANDSCAPE PLAN SHOWING A LANDSCAPE BUFFER SHALL BE APPROVED BY THE DEPARTMENT OF PLANNING, BUILDING AND ZONING PRIOR TO THE ISSUANCE OF ANY BUILDING PERMITS; AND (2) THE EXISTING 6' CBS WALL LOCATED ALONG THE ADJACENT RESIDENTIAL PROPERTIES SHALL REMAIN AND SHALL BE MAINTAINED BY THE APPLICANT. WHEREAS, the Miami Zoning Board at its meeting of July 10, 1995, Item No. 1, duly adopted Resolution No. ZB-76-95 by a nine to zero (9-0) vote, granting a special exception as hereinafter set forth; and WHEREAS, Zoning Ordinance No. 11000, as amended, the Zoning Ordinance of the City of Miami, Florida, requires City Commission approval of the special exception as hereinafter set forth; and WHEREAS, the City Commission after careful consideration of this matter, finds that the application for a special exception meets the applicable requirements of Zoning Ordinance No. 11000, CITY COMMISSION MEETING OF S E P 1995 Resolution No. -� 799 as amended, and deems it advisable and in the best interest of the general welfare of the City of Miami and its inhabitants to approve the special exception and to affirm the decision of the Zoning Board; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY j OF MIAMI, FLORIDA: I i Section 1. The recitals and findings contained in the Preamble to this Resolution are hereby adopted by reference thereto and incorporated herein as if fully set forth in this Section. Section 2. The decision of the Zoning Board to grant a Special Exception from Ordinance No. 11000, as amended, the Zoning Ordinance of the City of Miami, Florida, Article 4, Section 401, Schedule of District Regulations, C-1 Restricted Commercial, Permitted Principal Uses, to allow a financial drive -through facility for the property located at 600 Southwest 27th Avenue, Miami, Florida, legally described as Lots 8 through 18, Block 1, HARDING HEIGHTS SUBDIVISION, as recorded in Plat Book 6, at Page 138 of the Public Records of Dade County, Florida, zoned C-1 Restricted Commercial, per plans on file, is hereby affirmed and the Special Exception is hereby granted, subject to a time limitation of twelve (12) months in which a building permit must be obtained and further, to the following conditions: (1) a landscape plan -a- 9"- 709 I showing a landscape buffer shall be approved by the Department of Planning, Building and Zoning prior to the issuance of any building permits; and (2) the existing 6' CBS wall located along the adjacent residential properties shall remain and shall be maintained by the applicant. ANALYSIS The Planning, Building and Zoning Department is recommending the approval of the requested Special Exception to allow a financial drive-thru facility on the subject property, with the following conditions: (1) a landscape plan with specifications depicting a landscape buffer, subject to the approval of the Planning Division, must be provided prior to issuance of any building permits. (2) the existing 6.0 ft. CBS wall along the adjacent residential areas shall remain and be maintained by the applicant. The proposed vehicular circulation pattern functions well within the site, the design also provides a by pass lane that prevents internal traffic back-up that might otherwise affect the parking areas of the proposed banking facility. NOTE: The requested Special Exception should contain an effective date which will coincide with the effective date of the previously approved changes of zoning and land use.
