RESOLUTION NO.95 - 707
A RESOLUTION AFFIRMING THE CITY MANAGER'S NEW
CELLULAR TELEPHONE POLICY, THEREBY
CLASSIFYING ALL CITY -OWNED CELLULAR
TELEPHONES CURRENTLY USED BY CERTAIN
EMPLOYEES AS CATEGORY "A" SURPLUS STOCK AND
PROVIDING, IN LIEU THEREOF, A CELLULAR PHONE
STIPEND TO SAID EMPLOYEES; AUTHORIZING THE
CITY MANAGER, OR HIS DESIGNEE, TO SELL SAID
SURPLUS CELLULAR TELEPHONES, INCLUDING
BATTERIES, CHARGERS, AND OTHER ACCESSORIES TO
ELIGIBLE EMPLOYEES AT A PACKAGE PRICE OF
$100.00 EACH, UPON THE EXECUTION OF THE
APPROPRIATE RELEASE DOCUMENTS, IN A FORM
ACCEPTABLE TO THE CITY ATTORNEY.
WHEREAS, the City Manager has authorized a new Cellular
Telephone Policy that will provide a stipend to certain City
employees using City -owned cellular telephones in the performance
of their job duties; and
WHEREAS, such stipend will be given in lieu of continuing to
provide said employees with said cellular equipment; and
WHEREAS, it is necessary that said cellular equipment be
classified as Class "A" surplus stock in accordance with
Section 81-51.4 of the Code of the City of Miami, Florida, as
amended, and offered for sale to eligible employees at a package
price of $100.00 each;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:

Section 1. The recitals and findings contained in the
Preamble to this Resolution are hereby adopted by reference
thereto and incorporated herein as if fully set forth in this
Section.

Section 2. The City Manager's new Cellular Telephone
Policy is hereby affirmed.
Section 3. The City Manager or his designee is hereby
authorized, to classify all City -owned cellular telephones and
accessories currently used by certain City employees in the
performance of their job duties as Category "A" surplus stock and
to provide, in lieu thereof, a cellular phone stipend to said
employees.
Section 4. The City Manager, or his designee, is hereby
authorized to offer said surplus cellular telephones, including
batteries, chargers, and other accessories, for sale to eligible
? employees at a package price of $100.00 each, upon the execution
of the appropriate release documents, in a form acceptable to the
City Attorney.
Section 5. This Resolution shall become effective
immediately upon its adoption.
PASSED AND ADOPTED this 28th day of September 1995.

Sell Surplus Cellular
Units for $100 to City

ENCLOSURES:
It is respectfully recommended that the City Commission pass the
attached resolution classifying surplus City cellular telephone
equipment as category "A" Surplus Stock and selling the same for
the sum of $100 to eligible City employees that are currently
using said equipment but are opting for the City's new cellular
telephone stipend.

The City of Miami has a new cellular telephone policy that calls
for cellular telephone stipends to be paid to eligible City
employees in lieu of City -provided cellular telephone equipment.
Since there is no longer a City need for said equipment, it
becomes City surplus eligible for sale or donation. At the same
time the need exists, on the part of the City employees who are
eligible, to acquire cellular telephone equipment in order to
qualify for the new cellular telephone stipends.
The attached resolution formalizes the direct sale to eligible
City employees of the cellular telephones, batteries, battery
chargers and other attachments that they are currently using for
the sum of $100, after the signing of all applicable release
documents.
