RESOLUTION NO.
A RESOLUTION, BY A 4/5THS AFFIRMATIVE VOTE OF
THE CITY COMMISSION, WAIVING FORMAL
COMPETITIVE BIDDING PROCEDURES FOR THE
EMERGENCY RENOVATION/REPLACEMENT OF DOCKS AT
LEGION AND MORNINGSIDE PARKS; AUTHORIZING THE
CITY MANAGER TO PROCEED WITH THE AWARD OF A
CONTRACT, IN AN AMOUNT NOT TO EXCEED $90,000
AND IN AS PRACTICABLE AND EXPEDITIOUS A
MANNER AS POSSIBLE; ALLOCATING FUNDS THEREFOR
FROM TWO (2) GRANTS, IN THE AMOUNT OF $45,000
EACH, AWARDED BY THE STATE OF FLORIDA,
DEPARTMENT OF ENVIRONMENTAL PROTECTION,
OFFICE OF WATERWAY MANAGEMENT, FOR CAPITAL
IMPROVEMENT PROJECT NOS. 331312 AND 331338.
WHEREAS, the docks at Morningside and Legion Parks are in
disrepair; and
WHEREAS, said facilities will be used to accommodate the
Parks and Recreation Departments sailing program, as well as
other community needs; and
WHEREAS, the City has received two (2) grants, in the amount
of $45,000 each, from the State of Florida, Department of
Environmental Protection, Office of Water Management; and
WHEREAS, said grants will expire on December 10, 1995, for
the construction of these dock facilities; and
WHEREAS, it is necessary for the City Commission to waive
formal competitive procedures in order to renovate/replace said
docks before the grant expiration deadline;

NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the
Preamble to this Resolution are hereby adopted by reference
thereto and incorporated herein as if fully set forth in this
Section.
Section 2. Formal competitive bidding procedures for the
renovation/replacement of the docks at Morningside and Legion
Parks are hereby waived by a four -fifths (4/5ths) affirmative
vote of the City Commission.
Section 3. The City Manager is hereby authorized to
proceed with the award of a contract, in an amount not to exceed
$90,000 and in as practicable and expeditious a manner as
possible, with funds therefor hereby allocated from two (2)
grants, in the amount of $45,000 each, awarded by the State of
Florida, Department of Environmental Protection, Office of
Waterway Management, for Capital Improvement Project Nos. 331312
and 331338.
Section 4. This Resolution
immediately upon its adoption.
